Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Hi Shizhao - the author of both stamp-scans is unknown, the company, which produced those stamps doesn't exist anymore since (I guess) end of WW II. So no chance to ask anybody about that topic, though I tried, as I contacted the local townhall. If you believe that under those conditions any authors' rights are touched, you have to remove. Scan was done by me from original stamps, which I own.--Wistula (talk) 15:18, 16 April 2009 (UTC)

Last changes in the foto-description done: that is really all I can say about. I firmly believe, that there are nobodies' author rights touched as I am sure those fotos have been done by an employee of the publisher, with all rights kept by the publisher. The publisher (Polte Armaturen- und Maschinenfabrik (OHG)) has been liquidated under sowjet government in the Eastern part of Germany 1945. There is no legal entity following the former owner anymore, so nobody existing, who could have or claim any rights to this foto (which eventually anyway could be nearly 100 yrs old). rgds --Wistula (talk) 21:54, 26 November 2009 (UTC)
Thanks for the information. I have edited after you, trying to limit visible info to the bibliographical details. I can't read German though, I hope it still looks consistent. Copyright status should be ok, but it is probably more {{Anonymous-EU}} than {{PD-old}} (don't bother changing that). Scan from a book - welches Buch? Wenn schon kein Urheber rausgefunden wurde sollte wenigstens die direkte Quelle dokumentiert werden. Bitte Quellenangabe für das Buch nachtragen. Leafnote, that is already very nice, great job ! And you are right - it would be good, if the Warsaw fortification map fits to the one, you did already about the Region Fortification (incl Modlin, Zegrze). In the region map you have nine forts in the inner circle of Warsaw (incl X, which officially counts as the outer one), which follows the map of Ostrowski - I guess, at a later stage of the construction. And it would be absolutely perfect, if you could do another (small map) about the citadel and its 6+1 forsts, as to show them in the existing map would be too tiny ... btw - are you Warsawian ? --Wistula (talk) 10:20, 16 June 2010 (UTC)
OK, so if I find some free time, I'll update all the diagrams to reflect the final state of the Warsaw Fortress, just before the decision to abandon it. Es handelt sich um meinen Urgrossvater. Er ist 1936 gestorben, mithin vor 74 Jahren. Das Foto befindet sich in meinem Besitz. Es wurde vermutlich in einem gewerblichen Fotostudio der Zeit gemacht, ein rückseitiger Stempel ist nicht entzifferbar. PD-old gilt nur für das Todesdatum des Urhebers, nicht des Abgebildeten. Die ausschließlichen und vollumfänglichen Rechte sind auch damals normalerweise nicht automatisch an den Auftraggeber übergegangen, und falls doch eine solche Vereinbarung getroffen wurde, so müsste der heutige Rechteinhaber bzw. müssten ggf. seine Erben der Veröffentlichung zustimmen. Ob die Rechte betr Fotografien dieser Institution an die Reichwehr und von da an die Bundeswehr übergegangen sind und wer dann bei Letzeren zu befragen wäre, entzieht sich meiner Kenntnis. Hallo, Urheberrechte entstehen auch ohne Kennzeichnung und sind in Deutschland unverzichtbar. Die Entstehung in einem gewerblichen Studio besagt noch nicht, dass die Nutzungsrechte vollumfänglich an die abgebildete Person übertragen wurde; das war zu der Zeit jedenfalls nicht Usus. Mit Vermutungen kommen wir nicht weiter. Und wir sprechen hier nicht über eine einfache, einmalige Veröffentlichung, sondern PD oder eine freie Lizenz wie GFDL und CC bedeuten, dass jedermann dieses Bild zu jeglichem Zweck bearbeiten und nutzen darf, auch kommerziell. Bei PD sogar ohne jegliche Bedingungen. Deshalb ist es unerlässlich die urheberrechtliche Situation eindeutig zu klären. --Martina Nolte (talk) 20:30, 20 November 2010 (UTC)

Der Artikel wurde von Albrecht von Thaer verfasst. Das war mein Urgrossonkel. Da er vor meiner Geburt verstarb, konnte ich nicht mehr fragen, ob er mit einer Verwendung bei Wikimedia einverstanden gewesen wäre. Heute sagt er nichts mehr. Ihn hätte es sicher gefreut. In welchem Medium der Artikel veröffentlicht wurde, ist nicht bekannt, auch eine Recherche hat das nicht ergeben. Ross und Reiter oder so ähnlich. Existiert aber sicher nicht mehr. Die Nutzungsrechte werden beim Tod des Urhebers auf seine Erben übertragen. Die müssen 70 Jahre lang der Veröffentlichung (auch für kommerzielle Zwecke) und Bearbeitungen zustimmen.

Schon mal positiv, dass das mittlerweile gelöscht wurde; erspart mir und den rund 40 Nachkommen verschiedener Generationen den Weg zum Notar, um die Erbschaftsverhältnisse an dem Foto zu klären/fixieren. Ah, deine de-WP-Seite bringt Licht in die Sache. Du müsstest bei diesen Bildern unterscheiden, ob der tatsächliche Urheber seit mehr als 70 Jahren tot ist und ihn als Urheber nennen (bei unbekannten Personen am besten mit Todesdatum und wenn vorhanden optimalerweise belegt). Falls aber der Urheber ein noch innerhalb der 70 Jahre verstorbenes Familienmitglied ist und du der Alleinerbe der Nutzungsrechte bist, ist PD-old unzutreffend und du solltest entsprechend kennzeichnen, dass du über alle Rechte verfügst. Bei unbekannten Urhebern geht PD-old naürlich nicht so ohne weiteres. Dass sich ein Abzug oder Bild im Familienbesitz befindet, begründet keine Urheberrechte. --Martina Nolte (talk) 17:52, 20 November 2010 (UTC)

  • What is the source of the photo? Is it from a family collection or from another source, please would you give more detail. It is a good idea to provide as much detail as possible, to stop queries like this, and for historical purposes.
  • What actions have you taken to identify the person who took the photograph?

Thanks for the switch, I couldn't contribute much new info. I guess, that most fotos of this age, specially from the eastern part of Germany (due to ww and socilizm) wouldn't state infos about the photografer ? Die Lizenz für dieses Bild wurde nun von PD-old in PD-EU-no author disclosure umgewandelt. Dafür ist folgendes notwendig: Der Urheber ist unbekannt, seit einer Veröffentlichung vor mehr als 70 Jahren wurden keine urheberrechtlichen Ansprüche geltend gemacht. Da diese Veröffentlichung eine Eigenpublikation der Firma war, ist aber nicht sichergestellt, dass keine Rechtsansprüche erhoben wurden. Es ist stark davon auszugehen, dass die Firma die Fotos selbst beauftragt hat, dass die Veröffentlichungsrechte mit einem Verzicht auf Namensnennung gegenüber der Firma, möglicherweise sogar mit der vollständigen Rechteübertragung an die Firma gekoppelt waren. Dann hat sie bzw. ein eventueller Rechtsnachfolger der Firma die vollständigen Rechte inne. Das Buch (inkl. der enthaltenen Fotos) wird vermutlich mit "(c) Polte Armaturen- und Maschinenfabrik" versehen und damit die Urheberrechte geltend gemacht worden sein. There is no legal entity following the former owner anymore, so nobody existing, who could have or claim any rights to this foto". Dann hat sich dies hier erledigt. Bitte Freigabe einholen /Todesjahr nachtragen für

Die Illustratoren selbst sind bekannt und namentlich angegeben. Hier sind die Lebensdaten, sofern mir bekannt, mit Quelle benannt - alle seit 70 Jahren tot. Die Rechte der Illustrationen könnten auch bei den Verlagen gelegen haben. Selbige sind hier aufgeführt. Die überwiegende Anzahl dieser Verlage (insbes der Erstauflagen-Verlage - die die Rechte gehalten haben werden) lagen in Ostdeutschland und sind bereits vor oder nach WW II untergegangen. Bisherige Recherchen förderten keine Rechtsnachfolger zutage. Die Erstauflagen lagen aber sowieso alle in der zweiten Hälfte des 19. Jahrhunderts.
Freigaben und Ticket zu Image:KLAN 10 LECIE 14.11.2007 (32).jpg und Image:Suzanna von Nathusius, interview Warsaw.JPG sind erfolgt. Die Freigabe zu Image:Gerhard Fels, portrait 2007.JPG wurde vom Fotografen an OTRS gemailt, hier ist also demnächst ein Ticket zu erwarten. Der Fotograf zu Image:Kratervase Porzellanfabrik Nathu0001.JPG wurde von mir um Freigabe-Benachrichtung an OTRS gebeten, derzeitiger Status ist mir unbekannt. --Wistula (talk) 07:54, 28 November 2010 (UTC)

Ausgehend davon, dass ein bei Werkentstehung 20 Jahre junger Urheber 1939 realistisch 80 Jahre gewesen sein könnte, beziehe ich hier Werke bis ca. Mitte des 19.Jh. ein.

Dann wären alle Werke unbekannter Urheber gemeinfrei, die bis 1910 erstellt wurden, obwohl ihre Urheber 30 Jahre später (1940) durchaus noch quicklebendig gewesen sein könnten, so dass ihre Erben heute noch die alleinigen Nutzungsrechte beanspruchen könnten. Meiner Auffassung nach ist eine solche 100-Jahre-Rechtslage also eher sehr unwahrscheinlich. Diese Frage wird aber gerade hier diskutiert. Theoretisch kann auch ein 10-Jähriger, der 100 Jahre alt wurde, ein Foto gemacht haben. Damit würde sich die Grenze auf 160 Jahre verschieben. Es geht also um Wahrscheinlichkeiten/Mittelwerte ? Die "100-Jahre-Regel" ist eine "pragmatische Regelung" - man könnte auch sagen: eine Erfindung - in der deutschsprachigen Wikipedia, die nicht auf rechtlichen Grundlagen beruht, sondern auf der Annahme, dass das Risiko für eine Verfolgung durch einen Rechtsinhaber gering ist. Solche Dateien sollen ausdrücklich nicht ohne sorgfältige Prüfung auf Commons hochgeladen werden. Aus gutem Grund: Geschützte Werke, die vor 100 Jahren geschaffen wurden, wären nur dann frei, wenn der Urheber spätestens 30 Jahre danach gestorben wäre. Ich bin ein grosser Freund pragmatischer Regeln. Ohne solche Regeln wäre vieles, was möglich ist, nicht möglich. Umso mehr, wenn es sich um Fotos zu Familienangehörigen oder Familienbesitz handet, die ganz offensichtlich nicht von freien Fotografen gemacht worden, die sich ihren Lebensunterhalt durch mehrfachen Verkauf der Rechte zu Einzelnutzung verdienten. Es handelt sich doch erkennbar zum überwiegenden Teil um typische Privataufnahmeen bzw Firmenmaterial-Illustrationen der Zeit. Nach meinem Dafürhalten kann hier die Verletzung von Copyrights mit hoher Wahrscheinlichkeit ausgeschlossen werden. --Wistula (talk) 06:21, 7 December 2010 (UTC)
Vor allem scheinst du ein großer Freund von PD-old zu sein, unbeachtet der tatsächlichen urheberrechtlichen Situation. ;-) Wenn du potenziell geschützte Fotos unter der "pragmatischen" 100-Jahre-Regelung veröffentlichen möchtest, geht dies eventuell auf deWP, aber wie gesagt nicht auf Commons. Vielleicht willst du dort mal auf de:WP:URF fragen, ob diese Bilder dort geduldet würden? Richtig: ich habe die meisten dieser Dateien zu meiner Anfangszeit bei Commons hochgeladen und mich nicht tief in die Lizenzbestimmungen eingelesen, die ich bis heute nicht im Detail kenne und übrigens auch kompliziert und teilweise undeutlich finde. Interessiert mich auch nicht wirklich, hatte also irgendetwas mir einigermassen sinnvoll Erscheinendes gewählt. Eine Korrektur der Lizenzierung durch Fachmann bzw frau fände ich begrüssenswert, ein Verschieben nach de:WP wäre nicht ideal, weil ich gerne auch Artikel in en:WP schreiben möchte und mich fotomässig bei de:WP gar nicht auskenne. Bei nachfolgenden Bildern handelt es sich um Scans von Fotos aus Produktverzeichnissen oder Briefkoepfen von Firmen (Polte, Flechtner, Pilz) , die nach Krieg und Wende endgueltig untergegangen sind. Es scheint mir bei einem Wiki allerdings nicht ganz ungewöhnlich zu sein, dass Mehrere am Ergebnis mitwirken. Zum konkreten: "verschieben" würde für dich lediglich bedeuten, es auch auf :de hochzuladen, was du hier machen kannst. Die Beschreibung kannst du ja mitnehmen. Danach könnte es hier ggf. mit weniger Bedenken gelöscht werden, wodurch quasi eine Verschiebung nach :de erfolgt ist.
Zum allgemeinen: da ich nicht zum OTRS-Team gehöre, wo ein Teil der Beschwerden wegen URVs eingeht (ein anderer Teil kommt direkt zur Foundation), kann ich deine Frage nicht wirklich beantworten. Die allermeisten Dateien, die ich als admin auf OTRS-vermitteltes Verlangen der Urheberrechtsinhaber löschen musste, waren natürlich neueren Entstehungsdatums. Dennoch gibt es m.E. gute Gründe für die auf Commons geltende Richtlinie des vorbeugenden Prinzips, vor allem in Sinne einer höchst möglichen Rechtssicherheit der Nachuser, aber auch aus Gerechtigkeit (warum sollten nur von Getty Images stammende copyvios sofort gelöscht werden?). Da weder die admins noch die anderen in der Metaarbeit tätigen User auf Urheberrecht spezialisierte Juristen sind, kann die Richtlinie bzw. die dadurch natürlich auch geprägte Haltung immer wieder mal dazu führen, dass auch Bilder gelöscht werden (oder die Löschung beantragt wird), die bei genauester Prüfung vielleicht doch o.k. wären. Und dass sich jemand ärgert oder schockiert ist, weil er seine Bilder in gutem Glauben hochgeladen hatte, kann ich auch verstehen. Deinen Ausdruck "Säuberungsaktion" finde ich aber doch ein bißchen heftig. Wenn ich bei einem User (damit bist du jetzt nicht gemeint) einen groben URV-Upload finde, dann überprüfe ich natürlich auch seine vorherigen Uploads. Dass manchmal vor längerer Zeit hochgeladene Dateien "plötzlich" überprüft werden, liegt auch daran, dass es auf Commons in Relation zur Anzahl der Uploads viel zu wenige admins und andere User gibt, die sich um die Überprüfung des Urheberrechtsstatus der von anderen hochgeladenen Dateien kümmern. Ich hatte Dich auch nicht gemeint. Betr den Mangel an Mitarbeitern, die nach URV suchen - da bin ich ganz froh drüber, ich habe schon etliche Artikel in WP geschrieben und dankbar mit anderer Leute Dateien bebildert, die vermutlich auch eine URV darstellen aber ernsthaft keinen Menschen stören sollten. Ich bin auch kein Jurist, aber Zeitschriftenverleger, habe täglich im echten/gewerblichen Leben mit der Beachtung von Copyrights (auch bei Fotoverwendung) und dem Schützen meiner eigenen zu tun. Von daher kann ich zumindest die gelebte Praxis etwas beurteilen. Da gibt es schon einen Unterschied zwischen einem aktuellen Tusk-Foto und einem 100 Jahre alten Privatfoto aus Familienbesitz. "Säuberungsaktion" ist in der Tat schweres Verbalgeschütz, mit einem historischen und politischen Rucksack behaftet. Zur Sache: Wir sprechen hier über Hunderte von fremden Werken rund um deine Familiengeschichte, die du als gemeinfrei deklariert hast. Du bist in dem Glauben, dass eine Rechtsverfolgung wohl unwahrscheinlich sei. Commons hat jedoch den Anspruch eine Sammlung Freier Medien aufzubauen, die von jedermann und für jeglichen Zweck genutzt werden dürfen. Projektziel ist nicht, rechtsverletzende Dateien anzuhäufen, für die sich nur mutmaßlich und nach gefühlten Wahrscheinlichkeiten kein Kläger findet. Ich habe dir nun reichlich Unterstützung bei der Einordnung der Dateien in "Problemgruppen" und wochenlang Gelegenheit gegeben, fehlende Informationen (z.B. über Buchtitel und -veröffentlichungsdaten, die eventuell eine Gemeinfreiheit erschließen ließen) nachzutragen sowie die falschen Urhebernennungen und die Lizenzierungen zu deinen Uploads in Ordnung zu bringen. Ich habe dir Tipps gegeben, bei welchen Dateien eventuell mangelnde Schöpfungshöhe eine freie Verwendung erlauben könnte. Ich habe dich (samt Link) auf die großzügige "Hundert-Jahre-Regelung" in der deutschsprachigen Wikipedia hingewiesen, unter die du manche Dateien retten könntest. Das alles ist dir zu lästig. Kann ich bei der großen Anzahl an Dateien verstehen. Ich find's ja genauso mühselig dir hinterher zu räumen. Meine Dankbarkeit für Deine Bearbeitung der von mir hochgeladenen Dateien, die ausschliesslich meine Familie betreffen, hält sich allerdings stark in Grenzen. Offenbar fühlst Du Dich berufen, im vorliegenden Falle ohne jede praktische Notwendigkeit Prinzipien zu reiten auf dass es der Welt dann besser gehe. Das erinnert allerdings an die ähnlich sympathischen Leute, die vom Fenster aus Falschparker auf der Strasse notieren und der Polizei melden. Machen das ja auch im Interesse des Gemeinwohls. Und auf wirklich historisch rucksackbehaftete Vergleiche im eifrigen Befolgen von Regeln verzichte ich jetzt. Mir ist es zwar unverständlich, welche Befriedigung jemand wie Du aus solchem Tun zieht, aber das muss ich ja auch nicht verstehen. Hallo Wistula, du hattest auf der Bild-Disku geschrieben, dass du bzw. deine Firma die abgebildeten Skulpturen besitzt. Das Problem ist aber, dass in den meisten Ländern das bloße Eigentum eines noch geschützten Kunstwerks nicht das Recht an dessen Abbildung verleiht. Dies liegt weiterhin beim Künstler. Falls das also in dem Land, wo diese Skulpturen stehen, nicht anders geregelt ist oder du dir von den betroffenen Künstlern auch die Abbildungsrechte hast übertragen lassen, darfst du die Abbildung, auch wenn selbst photographiert, nicht unter einer freien Lizenz hochladen. --Túrelio (talk) 14:00, 8 January 2011 (UTC)

Ich habe völliges Verfügungsrecht über die Skulpturen sowie die dazugehörenden Stellkästen, kann sie zerstören oder auch hinstellen, wo ich will - muss ich die 120kg-Dinger jetzt also erst nach draussen vor das Gebäude (Uni, also öffentlich) tragen und kurz aufstellen lassen, um sie dann dort panoramafrei zu fotografieren und gleich danach wieder reinbringen zu lassen ? Oder soll ich mir das sparen und meinen Grafiker gleich einen Aussenhintergrund hinter die Skulturen montieren lassen ... ? Wilanowska Ave. in Warsaw

Right, my edition was a mistake. In fact I thought that the Royal Tract category was attributed to the tiny Wilanowska St. in Solec, which is close to Ujazdowskie Aves., the central part of the Royal Route. It made me think this categorisation was completely wrong as I just forgot about this southmost part of Wilanowska. In a perfect world category:Aleja Wilanowska in Warsaw could be splited into subcategories like category:Aleja Wilanowska in Warsaw - north-western part and category:Aleja Wilanowska in Warsaw - south-eastern part, and the latter one would be also a subcategory of Category:Royal Tract in Warsaw. Hi, you've mentioned, that some Jolanta's categories are at your watch-list. Are you perhaps going to make some order with them? It seems Jolanta left the project, so we cannot try to persuade her to do that. Well, Jolanta Dyr apparently seems to feel offended easily, so while talking with her I try explain everything patiently and without patronising attitude. I think she learns a lot and her pictures' quality is much better than used to be the previous year (the photos you listed as the worse ones are from 2011's Wiki Loves Monuments). in response to your question - as far as I can understand the available resources, I am confident about the location of the bridge and its historic character. As the pictures show, these are three different bridges, and all three may be historic in nature and probably they have.

I introduced today three files for a moment that soon I will remove [5]:

  • Currently Streets Wiertnicza and Przyczółkowa meet each other at a height of Wilanowska Avenue. In 1988, the course of the street was a bit different - the plan is evident [File: 0 - Wilanow - Plan of 1988r.jpg]. Today between the streets Janczarów and Vogel is not ul Wiertnicza but is ul.Kostki-Potocki.
  • In the study of conditions and directions of development of Warsaw - [File:0 - Wilanow - study uwarunkowan.jpg] bridge, which I have indicated as historical is shown near the streets Wiertnicza and Przyczółkowa - for so this is my place, which I have indicated.
  • The third picture sent to the commons today to plan Wilanów monuments within and around the Palace [File: 0 - Wilanow - przewodnik.jpg].

These three bridges actually exist in Wilanów, are located in the area known as "The Royal Wilanów", and have a historic character. For me everything is okay with them. The categories in the Commons it is all right.

Liebe/r DE728631, danke fuer den Hinweis. Du meinst, ich als Scanner des Werkes muesste selbst noch eine Erlaubnis zur Nutzung erteilen? Meinst Du also damit, dass ich jetzt Autor des Fotos/Scans geworden bin ? Dbgl gab es bei früheren Disks auch schon andere Ansichten, da hatte ich mich als Autor eingestellt, was als falsch kritisiert wurde. Wie auch immer: ich habe gerade 19 dieser Coverscans (alle Vorlagen aelter als 100 Jahre) eingestellt. Bitte zeige mir an vorliegendem Beispiel doch einmal, wie ich Deiner Meinung nach meine Genehmigung zu freier Weiternutzung einstellen soll, Danke im Vorab und Gruss --Wistula (talk) 11:07, 7 April 2013 (UTC)
Bei solchen Scans/Abbildungen kommt es immer darauf an, ob die Vorlage und das Ergebnis wirklich zweidimensional sind (Gemälde, Fotos), oder, wie in diesem Fall, 3D (Skulpturen, Architektur, Bücher inkl. Ränder und Falze). Ich würde daher einfach irgendeine freie Lizenz wählen, z. B. Template:Tl wie beim Bahnhof Friedland, und zusätzlich Template:Tl. Bei wirklich flachen, rand- und rahmenlosen 2D-Scans braucht man tatsächlich keine weitere Lizenz, da hier die Reproduktion als gleichwerting zum abgelaufenen Original angesehen wird.
