Hi, is there an exact source on the library's website for this image? I can't find it.

It seems pretty important to me to get the response to this right. We certainly don't want to upset libraries after all. But I don't know if we can comply with their wishes that permission be obtained to use a PD image. That doesn't seem right.

So I suggest you forward their email to The Board and ask them for guidance. If it is overkill they will probably forward the message to OTRS and someone there will figure out a response. And just say to the library that you've passed their request onto the Wikimedia Foundation board and you hope to hear from them soon. how does that sound? pfctdayelise (translate?) 07:08, 19 July 2006 (UTC)

Will do. I agree - its very important - they have all sorts of good pix that would make excellent additions to NZ and Pacific articles. And I deliberately asked them for permission to use old ones - they agreed to all 16 that I asked for, but they seem to be a tad OTT - I mean the pix are on their Timeframes website anyway (see my contribs for the others so far, I havent uploaded the whole 16 yet). I've been intrigued by the Polynesian culture, especially how it relates to my own Filipino culture. I felt quite at home in Tahiti. Actually within a couple of days, locals were speaking to me in French or Tahitian. It helped that my tall stature is closer to the Tahitian people than the petite Filipinas.

BTW, I'm going to post a couple more photos from the same marae grounds, which you may use as well, if interested.

Several of your other recent uploads from Flickr pages also appear to be either "All rights reserved" or use the non-commercial version of Creative Commons (examples: Image:WharenuiRotorua.jpg, Image:RotowhiuView.jpg, Image:CarvingTePuia.jpg). Do you have simliar emails from those authors? If so the licensing sections should be similarly changed I would think. According to Commons:Licensing and Commons:OTRS, a specific email template should be used, the reply should be mailed or forwarded to a permissions mailbox for archival, and possibly the resulting permission should probably be linked to from the image page.... it seems like it would be best to have the email text archived somewhere better than this talk page. Any photos from Oahu?

I noticed you are heavy into polynesian subjects. I live on Oahu and have transfered some images from early Hawaiian art. If you have particular interest in particular kinds of images, I can prioritize my work better in photos I take locally. One really cool collection is at the Bishop Museum. Re Alexander Turnbull Library

Hey. I am really, really sorry I have been so slack and not done anything about this. I am emailing foundation-l as we speak. I'm not sure how much good it will do, because they're really not keen on giving advice from on high, and everyone's wrapped up in the board elections. But we will see.

OK actually.. I'm going to write to a private mailing list of OTRS volunteers. They're a bunch of people who regularly deal with public enquiries so maybe they will have some idea about how to handle this. If no response there I will fwd it to foundation-l.

Hm. It sounds like they were rather terse to you. There was a good discussion about it, which well and truly convinced me. I think the Wikimedia position, more or less, is that these big institutions are being deliberately misleading about the status of such images, and even though they may be wellmeaning, such restrictions make free information less free and therefore should not be conceded. Hello, you asked "why have you deleted Category:Araucariaceae from my photos?" Answer: Take, for example, Image:Agathis robusta2.JPG. Your photo is now part of the article Agathis robusta, together with other fine photos. You can see this on your photo page down near the bottom where there is "Links" and "The following pages link to this file:". Now, the article Agathis robusta has the category:Araucariaceae, so your photo is still in this category. Explanation: we have to clean up family categories from time to time, and put all the images into species articles. Although it is not said in the documentation, the plant and animal categories differ in the handling somewhat from other parts of Commons. Hope this helps. Kawakawa

Hi, thanks for correcting the common-name link to the disambiguated wikipage for the tree, but I changed the english displayed link name back to Pepper tree so that the page will be found when searching for Macropiper, Pepper tree or Kawakawa. You also may be able to sort out the interwiki link to the mi.wikipedia page that I previously added, there isn't actually a page by that name yet, and I don't have any way of checking whether it's there by another name. :-) --Tony Wills 04:43, 12 March 2007 (UTC)

I must be showing my age, but it has always been the Pepper Tree, there is no reason two different trees can't have the same common name (isn't there some distinction made, one called a Pepper Tree and the other Pepper plantPepperwood?). I agree that NZ is tending to adopt Maori names and sometimes even trying to pronounce them properly!. Should the Maori pronunciation of Kawakawa have any inflections marked? --Tony Wills 23:30, 12 March 2007 (UTC)

Well if you thought it was just english common names that are a bit variable, I was intrigued to find this article (also on the net in PDF form) [1] - basically kawakawa = kavakava = kava. The theory being that just as the english settlers named similar plants/animals after the home version, so did the first Maori. (first time I've heard this naming before). --Tony Wills 08:37, 14 March 2007 (UTC)

Not news to me the Kawakawa/kava theory - coincidentally I added a note about it on the English Wiki article today - tho its probably incorrect since it must have happened in Polynesia before anyone even thought about going to Aotearoa, since there are Macropiper species in tropical Polynesia that are called Kavakava, which the theory doesn't take into account. That the name also occurs in Samoan (which replaces 'k' with the glottal stop) as 'Ava'ava suggests considerable antiquity, back to proto-Nuclear Polynesian. Which means the Māori didn't coin the name Kawakawa - they were already familiar with the name in the islands. Of course there are a great many NZ plants and animals that are named after similar plants and animals in the tropics. Pōhutukawa prob after hutukava, Barringtonia sp., with similar flowers; Phormium tenax = harakeke which means 'strange pandanus'; P. cookianum = wharariki = little pandanus; and given the considerable tropical element in the NZ flora, a lot of the plants were practically identical anyway. And of course two names for the Breadfruit tree, kuru and pōporo were preserved in old chants Kahuroa 09:52, 14 March 2007 (UTC)

Birds

I see you have been reasonably active in adding to NZ Birds so you might be interested: I am going to start Commons:WikiProject Birds and are experimenting with using a suggestion from User:Pfctdayelise and have made a template {{Template:WikiProject Birds}}. This is simply to mark images and pages etc that the project has categorised - to avoid having participants duplicating others work. It has the advantage that it doesn't add a category, but rather can be searched for using the ScanCat tool which allows us to select not only images that are tagged with a template, but alternatively, and most importantly, those that have not yet been tagged. eg see [2].

Also a query, on your upload Image:AnthornisMaleFemale.jpg the description says male on left, female on right, isn't this visa-versa (ie male to the forefront) (assuming left/right is from the viewers point of view, not the bird's :-)?? --Tony Wills 20:35, 14 March 2007 (UTC)

Looks like he's right and the picture on the original website is mis-labeled so the file here is misnamed and description and category are wrong (I'm just going by what google images shows for these two birds, I'm no expert). category:Maori-influenced architecture

Hi again :-). I'm not sure about that category name, I deliberately hadn't actually created a category originally (just linked to a potential category) until a more appropriate category came to mind. What is Maori architecture?, is it only classical Maori architecture?, what about post-european Maori architecture? Not sure whether John Scott[3] considered himself Maori but he did have Maori heritage. Thanks for creating a category just for those images, I hope other images that fit into the same category will eventually be added ... :-). --Tony Wills 05:54, 12 April 2007 (UTC)

You raise interesting points - there will never be an easy way to shoehorn one culture's concepts into another's. I'm sure there are plenty of buildings in NZ that would fit the category. Even the SkyCity casino in Auckland has a rather Māori-inspired foyer. Kahuroa 08:04, 12 April 2007 (UTC)

Wellington should be rich pickings. Te Papa? The outside courtyard near the marae? Not so much the 'house' in the marae itself (rather bizarre in my book). Maybe some more subtle aspects of the building or of others might be MIA, and possibly more interesting for being subtle rather than in your face. I have an inkling of what you mean by shoehorning, you mean the way there is a concept of 'architecture' as something separate from place, society, spiritual connections? Now for something completely different - Weta

I was looking at the en:Weta page and someone has flagged they want a reference for the comment about traditional use of weta carapaces - do you have any knowledge about this? I had a brief look on the web for places to cite but didn't find anything authoritative enough (though I did find an amusing page about sheep eating weta[4] ... perhaps a sequel for the killer sheep film :-) --Tony Wills 11:34, 12 April 2007 (UTC)

Great photo. I was going to say that it's not a plant that I recognise, then I saw the description on your user page and I see why - probably not very common in Wellington :-). Is the orientation right? Quite striking despite the lack of colours, is this fertilised by moths or bats? (ah, I now see the article suggests bats). The file size is modest for a picture of that resolution - a bit too compressed perhaps, this might be showing up as a 'soft' focus on things like the stamens when viewed at full resolution. Are the flowers yellow or white (or does it vary), and how big are they? --Tony Wills 09:24, 5 June 2007 (UTC)

Thanks! Is the orientation right - yep. The colour is subtle in these plants, varies a little from plant to plant it seems, from creamy white to slightly greenish white - yellow greenish tinge as well - the pix on Tecomanthe speciosa are all more or less accurate tho on second thought I think the very white ones are too white. The length of the flower is slightly less than an index finger - full technical description. It was a slightly compressed photo, so I have uploaded again - see what you think now. My camera is a small point and shoot, and I must admit the soft focus drives me a bit batty, and I have been thinking about getting something better... but whaaat.... the compactness of the camera is great but I do want sharp !!! • Yes an improvement. I'll certainly recognise it if I ever come across one in my wanderings :-).
• I commiserate about the soft focus and see why expert photographers go on about their lenses so much! My camera is also just a standard consumer product, not really good enough for serious photography. The most annoying aspect is its difficulty in focusing on things in low lighting conditions or things with poor contrast, and the auto focus is quite slow, the manual focus just about impossible to use. And try as I might, it's very hard to get really good, sharp images - and even when I think I've got a really good image, not everyone agrees - my wikipedia FP candidate (feel free to vote :-) --Tony Wills 08:46, 9 June 2007 (UTC)

Hi,

I had a look at that discussion on the NZ board. It seems more or less good, except that the issue was discussed within OTRS rather than the Board per-se. However Brad Patrick, our then-legal counsel, and Jimmy Wales, were both aware of the issue and agreed that we (Wikimedia) should only respect copyright claims that are steeped in, you know, law and evidence and stuff. :) That's my summary of that discussion. So it's not that "great, we can tell libraries to go to hell with their fake copyright claims" but more, "we believe that the term of copyright has expired on X item and we respectfully disagree that any further copyright can apply to this item". Something like that.

There's no published summary and there's kinda unlikely to be one, because of the difficulty of making a broadly applicable statement that is actually true. Copyright is painfully difficult and there's many "exceptions" and "what about...?" cases in every country and every situation.

So I would just say that any 2D copy of a 2D document whose copyright has expired according to the relevant copyright laws, is {{PD-old}} and acceptable on Commons. Note the two important weasel clauses:

• 2D document - coins are not 2D, vases are not 2D, statues are not 2D, etc. basically only paper is 2D more or less.

1. relevant copyright laws - can be tricky to work out, depending on whether or not the document was ever published, if so in which country, and which country was the author born in, which country did the author live in, was the document a 'work for hire' etc etc etc. But most of these caveats won't affect your old images under discussion I think.

Sorry I can't be more helpful, but IMO the Foundation is really unlikely to ever make any official statement about copyrights given their complexity. However the good news is the Foundation recently hired a new legal counsel. So if you do get any truly curly questions, we have someone official to ask. yay.

Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]

[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").
