I am not sure if this picture you uploaded is of the Tren del Valle or the Belgrano Railway (I cannot tell the track gauge from the image). But the same image was also published under an article about the Belgrano Cargas along with other images a week before the source you gave: http://prensa.argentina.ar/2015/07/10/59308-llega-financiamiento-chino-para-el-belgrano-cargas.php I find often on the prensa.argentina.ar website, many images are incorrectly titled and obviously in this case it can't be both railways. In fact, it could be from other line rather than Roca Railway so I'm not sure if recent works on Tren del Valle tracks included the installation of concrete sleepers. I'll be checking this. Concearning {{PD-AR-Gov}} — so far as I could verify — laws, decrees etc. at municipal level (creating coats of arms etc.) are NOT published at the Official Bulletin, which "es el diario oficial en el que se publican los actos emanados del Poder Ejecutivo Nacional y las leyes sancionadas por el Congreso de la Nación" link but as a starting point: where I could found "(...) are not included as subject to copyright according to Law 11.723" in http://infoleg.mecon.gov.ar/infolegInternet/anexos/40000-44999/42755/texact.htm? La imagen en cuestión una de Menem con los Rollings Stones que servía para ilustrar la mediatización política de los 90 y el estilo de Menem. Algunos presidentes, como Cristina evitaban estas fotos y preferían artistas nacionales, y ahí radicaba mi interés en estas fotos... Ya no importa, espero aceptes mis disculpas. Copa Interamericana 1994

Hola Fma12, esto fue un grave error. La copa tuvo diferentes diseños en algunas ediciones. La edición de 1994 tuvo un diseño especial para ese año. La fotografía fue creada en una exhibición del equipo campeón de 1994, Universidad Católica, puedes buscar en youtube "Feria cruzada 2012" y "feria cruzada 2013". Obviamente la fotografía era original. No sé como se podrá reparar el daño hecho, en commons escasea esta clase de material de calidad. Columna de Razta (talk) 15:05, 5 April 2016 (UTC)

Hola User:Columna de Razta, en realidad, en el deletion request no se discutió la originalidad de la fotografía (de la cual jamás se dudó), sino que los trofeos y copas se consideran "esculturas" y trabajos en 3D protegidos bajo derecho de autor. Por lo tanto, un trabajo de 1994 es un trabajo protegido porque deben pasar más de 70 años de la muerte del autor (en este caso del trofeo) para que sea libre de derechos. Ese es el motivo por el cual se borró, no sólo este, sino incluso el trofeo de la Copa del Mundo entre otros trofeos. - Fma12 (talk) 15:36, 5 April 2016 (UTC)

Yankees Uniform Discussion

Ooooh. I am very upset now. See, I never read further down this page, so I did not realize the things that were being said about me. so let's put this all in one place and get some real honesty in here. So, to make things clear, here's my discussion with Fma12. First, he contacted me about our edits.

NY Yankees

Your rendering of the New York Yankees uniform was inaccurate and it was corrected. Incorrect information has no place in an encyclopedia. The image was changed and any attribution to you was removed, as the new version had nothing to do with your work. If the image is changed, then you have no further claim to it and no reason to become defensive over a work that is not yours being attributed correctly.

The first time I corrected your work, I made the mistake of not changing the attribution and therefore incorrectly attributed my work to yours. I'm used to just changing the images when something needs to be changed, so I forgot that I needed to make sure the information was changed to attribute image's creator. That's my fault. However, this time I correctly made any necessary changes to the page. Nothing disruptive was done. It was just a change to a more accurate version. Silent Wind of Doom: You are completely wrong. I rendered the NY Yankees uniform in Corel Draw, then converted it to PNG and uploaded to Commons. So simple like that. Nothing related to "your" image, which you had uploaded as a fair use image, therefore not suitable for Commons (I'm not sure but I think it was like this). What "attribution" are you talking about if the uniform was drawn by me?
If you want to upload your rendition to the project, do it, but don't overwrite my file ("that" is disruptive because you are replacing an image for another different). Moreover, if you think that the current uniform on NY Yankees article is incorrect or needs to be updated, replace it with your work, but don't overwrite other user's files instead uploading your own drawing. Quite a busy few weeks. Didn't realize you'd answered on your page.
So THAT'S what this was about? You want your own image somewhere else? You inserted your image into the team's page, causing it to become part of the lineage of uniform images that have existed since 2007. Because it became part of the project, it was renamed in line with the rest of the uniform images. The page isn't an image itself, but rather a placeholder for an image of whatever the current uniform is. You saw "File:ALE-Uniform-NYY.png" as the name of your own personal image rather than a part of an overall project which is constantly flowing and being updated. That would explain why you were so incensed when the image was corrected, even when accreditation was corrected to insure that the image was no longer attributed to you and so there was no connection to you. The NHL and NFL images have long since wandered out of my control and are still being updated at the same filename because they're not my images. They're whatever's correct.
If you want to keep your versions of the images elsewhere, separate from the project, then that's no issue. We just need a new name for it, so the name it currently has can still be used as it is needed to be used. --Silent Wind of Doom (talk) 18:43, 8 November 2015 (UTC)

And so I waited. We had a simple conclusion to this. Fma could have his precious image, even though he could easily upload it to a name he wanted. No. I'll do the work of getting it changed over and then upload a correct image under the project's filename. That was November. I never heard back from him, but I patiently waited. Maybe he got busy. I don't know. I assumed good faith.

Then today I notice that a couple days ago other people have asked Fma about this inappropriate image.

Yankee jersey

Please update your jeresy because it is really wrong and out of date. One the chest NY logo is wrong, the one you have doesn't look like the one on the jersey. Plus you don't have cleats or shoes on the jersey. Please update your logo or let other people update it. Thank you

All right. Same tune. I'm unhappy to see that he is holding conversation with others while I still awaited his response, but it's okay. Then things take a turn when the next person asks about it.

Yankee jersey

What happen to the other guy who updated the jersey. Because he updated it then you changed it. I saw that it something to do with him not changing smelt hint on the file or whatever, but when he fixed it why did you keep changing it?

Well, I'm so tired about the "dispute" over the jersey I updated, therefore I'll try to be as clear as possible: Some time ago, there was another NYY jersey updated to Wikipedia as a fair-use image (therefore not free). The jersey I updated (see here) was rendered by me (own work) and then uploaded to Commons under a creative commons license.
On Wiki's NFCC page, it says: "Non-free content is used only where no free equivalent is available, or could be created, that would serve the same encyclopedic purpose" (more details here). According to that criteria, the previous non-free version was replaced by my file. That doesn't mean that "my" version is the definitive or the best uniform ever created.
The problem came when the other user (and some socket puppets like this) overwrote my file with his version of the jersey (see file history) which is wrong, because if he or whoever has another version of the uniform, it should be uploaded separately instead of overwriting other users' files.
I just edited the NYY article on the en.Wiki, replacing the uniform according to NFCC #1. Is there anything wrong with that? I don't think so. In fact, any user can create a more accurate version of the jerseys, upload to Commons and then placing it on the infobox. I hope this issue is clear now - Fma12 (talk) 22:27, 7 April 2016 (UTC)

Admittedly, I did not know that my original images counted as free. Given that they included copyrighted logos, I considered them all to be non-free. When I had my first few transferred to Commons, I found out that the copyright information was for the work itself, the drawing, not for what the image was of. So, yeah, the old image was as free as the new one. It seems Fma came in before I rectified this, however. I have no doubts that his original intent was fine, but it seems that he has no interest in what actually serves the project best. And then, while I was patiently waiting for him to respond to me, he accuses me of creating new usernames to push my edits? That is a rather serious accusation, and I am greatly insulted at his horrible way of "handling" this dispute.

But apparently the person believed this lie.

Thank you a lot, I understand much better now but I need your help. Is there any way I can reupload his work to the Yankees page? Because his work is better than anything I can make, and every time I tried to get back with the silent wind of doom guy I would never get a answer. You probably don't know but is there any chance I can upload it? And if I can't is there any way you can help me message him because I'm a little lost when I use this. If you can help me I would really appreciate it, a lot.

I haven't received this user's request, but I wish I did. I haven't come to Commons for a while, until my updating of the baseball images brought me back. And now I'm back, and I will fix this issue. A reviewer at a PR where the picture is being used has asked "How do you know 'it was first published at least 20 years ago'? That's part of the criteria for PD-Argentina". Do you have any proof the photo was published at least 20 years ago? Are you able to link the image to the right source, or to any available evidence? SchroCat The most of images posted by the AGN are +25 years old, therefore public domain in Argentina (although some may be in the PD in the US due to URAA). The rest of the images are under license {{CC-AR-Presidency-2015}} as the AGN is an organism under the Presidency of Argentina (which specifies the license at bottom). - Fma12 (talk) 15:15, 25 April 2016 (UTC)

Hi,

AFL flags Threshold of Originality?

Hi, I noticed that you nominated a Brisbane Lions flag for deletion about a month ago at Commons:Deletion requests/File:AFL Brisbane Icon.jpg due to the fact it wasn't own work and was complex enough to be copyrighted due to a low threshold of originality, I was wondering what your opinions are on the following AFL flags due to the same reasons as the Brisbane flag?

Hi Flickerd; well, in the case of Carlton, the wordmark was designed before 1923 (which made them PD in the US) and also {{PD-Australia}} (created before 1955) therefore they are exempt of copyright. Regarding Gold Coast, I consider it only contains a simple text logo, so there is no any infringement of copyright. The only flag above the TOO is (the West Coast symbol) due to the Eagle figure. Reguarding File:Saints uniforms12.png

Since you are the original author of this file, I was wondering if there could be 2 fixes on this file.

1.The Saints have a second (black) pants, usually in combination with the white jersey. Maybe use white side to present this?

2.They also fixed their collars. (evidenced by Saints twitter)

If you don't want to change it, you don't have to. But since you are the original author, of course I wouldn't do this myself and place a new version over yours. These two fixes would accurately present the Saints modern uniforms, and based on this template, doing it would be super easy. Postcard licensing

Please do not change {{PD-1923}} to {{PD-US}}. PD-1923 explicitly gives the reason for the image being in the public domain, whereas PD-US does not. Thank you, Pi.1415926535 (talk) 23:34, 9 October 2017 (UTC)

@Pi.1415926535: As far as I know, {{PD-1923}} is for works published outside the US (according to Commons:copyright tags). That's the reason because I put the PD-US license in works originally printed in the US. If I'm wrong, please let me know. Thanks, Fma12 (talk) 12:06, 10 October 2017 (UTC)
The page is a bit confusing in its wording - it's just saying that works originally published outside the US, and in the public domain in the country of origin, must also be PD in the US. That's a legal technicality of the Wikimedia servers being located in the US. PD-1923 establishes that a work is legally PD in the US, and thus it's sufficient for any work originally published in the US. PD-US should be avoided when possible; it's a very general tag that doesn't specify why the image is in the public domain, which can be problematic if the PD status is challenged.
