Hi Arthur, thanks for updating the permission on this file. It is currently stated as insufficiently verified (Ticket https://ticket.wikimedia.org/otrs/index.pl?Action=AgentTicketZoom&TicketNumber=2018041010006863). I forwarded the form by the photographer to the OTRS which was sufficient as far as I can tell. Can you give me details on what was wrong with it so I can coordinate with the source? A tenth photo from Number Ten Architectural Group has been accepted by Wikimedia as licensed: File:Winnipeg Convention Centre, 1974.jpg

My problem is that the creator of all ten Number Ten photos - Number Ten Architectural Group, sent a signed Wikipedia Creative Commons License releasing copyright for all ten photos, to permissions-commons@wikimedia.org on April 18, 2017. The license clearly followed, verbatim, the template for such a license as published by Wikimedia. It was signed by a duly authorized representative of Number Ten, Doug Hanna, who is partner of the partnership. So there was an "explicit release under a free license" given, contrary to your template statement, the above. Also, the email from Mr. Hanna came from his work email address, so the statement that the "email address that the permission came from is not associated with the location where the content was originally published", is wrong.

I re-emailed Mr. Hanna's email and the Creative Commons License he signed to Wikimedia yesterday, because the OTRS rep who tagged the nine photos for removal said, in numerous emails to me, that proof of the license had to be sent. But, clearly, the original email and license was originally sent from a Number Ten Architectural Group email address.

Can you please let me know what the real problem is? Did Wikimedia fail to process the original Creative Commons License sent by Mr. Hanna on April 18? Or is it just a problem of correlating that original correspondence/license to the photos that I uploaded yesterday? Please let me know.

It has been an unbelieveable hassle getting Wikimedia to acknowledge copyright licenses for this website. Any help you can provide would be appreciated. --Jack Coop (talk) 14:55, 7 June 2017 (UTC)

@Jack Coop: We received your email a few hours ago, please consider that we have a lot of requests to handle. We have currently a 2 months backlog for this queue. We received the autorisation from Doug Hanna with Template:OTRS ticket on 18.04.2017.

By adding the OTRS template on the files pages, these files can not be deleted for the moment.

If I can give you an advice: while you've not access to the deleted files, you can process more recent tickets. Recent uploaded files without permission aren't generally deleted right away, and you can still check them. You can access to the last tickets by clicking on ">|" on the top right. Actually it's the same (that's why I'm telling you). Authorized pictures

I'll ask Christian Lu to send you a permission for all remaining pictures asap. Hi, thanks for your OTRS work on these. I had been directing the user who uploaded them to OTRS from en.wiki, and glad he figured it out. I saw that that you placed the OTRS tag on File:George Baldanzi 4.jpg, but didn't see that all the others in Category:George Baldanzi have been deleted and wondered if this were an oversight or whether OTRS had not confirmed their status. I noticed a tag placed on File:155ufca Reconstruction 004a.jpg after the OTRS verification was sent that claims the message was "insufficient" regarding the permission of this file. I have sent so many requests already the author of these renderings and would like to save him as much time as possible, so I was hoping something could be worked out to keep this file in the commons, as it is used on a few Wikipedia pages. Hello Arthur. I am just asking this for my own information. I was reviewing Ticket:2017080610000111 when you replied to that email. I was going to send an email asking them to explain KIMBERLY PENNY in Exif metadata. I have encountered this situation several times: a high-resolution image with complete Exif data, but a different author/copyright holder. I assumed that the photographer was paid for taking this picture and so copyright has been transferred. Indeed, the place is empty and it's an high quality picture. @Gatien Couturier: En fait si l'étiquette n'avait pas comporté ce dessin, il n'y aurait pas eu de problème particulier. L'étiquette utilisant des formes plutôt simples avec du texte, elle aurait été considérée dans le domaine public.

On peut aller plus loin et regarder si le dessin de l'artichaut n'est pas lui aussi dans le domaine public. Mais comme cet alcool a été créé en 1952 (et en supposant que l'étiquette avec l'artichaut a été utilisée depuis sa création), le dessin de l'artichaut a vraisemblablement été créé il y a moins de 70 ans. Néanmoins, je ne comprends pas très bien les demandes de suppression relatives à ces mêmes fichiers. Sont-elles toujours d'actualité ?

Selon moi, ces images ont un intérêt, notamment encyclopédique, puisqu'elles peuvent servir à illustrer l'article Wikipédia consacré à la taverne L'espérance. Cette taverne est en effet classée au patrimoine immobilier de Bruxelles.

Hi,

If you find permissions for files that you requested undeletion invalid, please mark them {{Speedy}}. Few potential examples:

• File:Touching Victory.jpg
• File:ERSTE Foundation Logo 2018 and later.jpg
• File:SMA AVEROS.png

If there is no evidence that they are free, we do not want to keep them undeleted too long. Ankry (talk) 13:23, 5 August 2018 (UTC)

De manière générale, les logos ne peuvent pas être hébergés sur Wikimédia Commons (ou il faut l'autorisation du détenteur des droits d'auteur). Plus particulièrement, on peut uploader sur Wikimédia Commons un logo qui ne contient que du texte ou des formes géométriques simples car il fait alors parti du domaine public.

Le logo File:Star Trek Nemesis Logo.png a été considéré par la communauté comme étant au-dessus du seuil d'originalité. Cela signifie qu'il utilise des formes géométriques complexes ou est artistiquement développé. I thought this logo may be useful to illustrate the section about senate election. Remember that files are hosted on Wikimedia Commons mainly to be used on Wikipedia pages... There is nothing outrageous here. I prefer to use a file on a Wikimedia project rather than delete it.

The author of the work has written via e-mail:

"Since John Clark was my employee during the creation of my 1976 B-17 mural in the Smithsonian Institution's National Air & Space Museum, any contribution to the effort created by my assistant John was created as part of his regular duties thereby covered as a work for hire as described by situation (1) in copyright law.

"Whether a work is a work made for hire is determined by facts in existence at the time the work is created. There are two situations in which a work made for hire is produced:

"(1) when the work is created by an employee as part of the employee’s regular duties and (2) when a certain type of work is created as a result of an express written agreement between the creator and a party specially ordering or commissioning the work. When a work is produced under these conditions, the employer or the party ordering or commissioning the work is considered the author and copyright owner."

I offered the United States Copyright Office brochure, "Works Made for Hire" to corroborate the author's provided citation.

Please let me know whether anything further is required to complete the process. I'll look for a reply, here.

Copyright Violations for photo upload?

Hi,

Recently you and user:Patrick Rogel flagged my Ali Abbas Zaffar profile.jpg pic (https://commons.wikimedia.org/wiki/User_talk:Rush922#File:Ali_Abbas_Zafar_profile.jpg.png)

I just wanted to let you know that since I am relatively new to uploading pics, it was done entirely in good faith and that I honestly believed I was following the rules. A few days ago I had also changed profile pics for other celebrity accounts, but I had no idea about the copyright rules and so I was flagged for that, but stopped doing so after learning the proper way to do it (or so I thought). So for the next day or so I stuck to just editing words on pages, which went well. But yesterday I tried to upload a pic the proper way, with a photograph I rightly thought was copyrighted by Bollywood Hungama - as it fit all their criteria for their Creative Commons License 3.0 - it was published on their page, taken by their photographer at an event, etc. So I was not sure why it was taken down today. Patrick Rogel sent a link where that same photo was used by another news site, but according to the Bollywood Hungama Creative Commons copyright captions below...

...Bollywood Hungama allows you to use a pic from their site as long as you directly reference them; since that same picture was used by Bollywood Hungama, I assumed that the photo was fair game under their Creative License. But I guess I was wrong.

Just to be clear - how I can be totally sure that a Bollywood Hungama pic is copyrighted by them the next time I get a pic from their site? Does it specifically have to have their logo on it?

Since it was a misunderstanding, and since my edits were in good faith, I believe its unfair to flag me for Copyright Violations and give me a final warning, or else block my account. If you look at my last few errors, I have always tried to talk to the flaggers on their talk pages to understand the nature of my error. Some of them have responded, some have not. But on my end, it was always from a place of understanding the reason behind the rules. I am one who believes in trial by error, so why punish me for experimenting when I believed I knew the rules, but made a mistake? So I also request that you please remove that Copyright Violation due to good faith errors.

Arthur, non malheureusement, je ne peux pas fournir de Google Maps/Street View plus ancien, la comparaison n'est faite que sous le même angle mais date de 2017, le fichier est techniquement très médiocre (àmha) et ressemble à ces captures d'écran recadrées et agrandies que l'on peut faire à chaque moment sur Google Maps. Je me suis intéressé au problème en regardant la catégorie car j'ai moi-même téléversé un fichier il y a 11 ans et j'ai eu besoin de voir l'article qui concerne la rue de la Madone et ainsi je suis tombé sur ce fichier, ce qui explique mon intérêt pour le fichier du contributeur qui figurait également dans l'article de fr.wp, j'ai remplacé la photo et de fil en aiguille j'ai été voir les informations détaillées de ce fichier et lorsque que j'ai vu je suis resté très, très dubitatif. Il fut un temps où sur Street View le filigrane Google n'apparaissait pas. En bref et faute de preuves irréductibles je ne veux pas m'impliquer dans une éventuelle polémique pour ce fichier et je respecte ta décision, de plus l'intéressé m'a envoyé un message voir File:Statue de la Vierge au coin de la rue de la Madone, Paris.jpg, ce message laconique n'apporte rien de plus et je vais lui demander des vraies explications gentilles :-) .--Doalex (talk) 10:08, 27 September 2018 (UTC)

They have claimed "own work" for all their uploads except for those that have been uploaded on 13 August 2018. One might wonder why they have used "document familial" rather than own work. They have used at least four cameras: SM-J320F, ALE-L21, DMC-TZ57, and DMC-FZ200. They have claimed own-work for photos which have been taken by the first three cameras, but they have not done so for the pictures taken by the last camera.

I think there are enough grounds to ask the user for clarification.

Hi Arthur C. Hope its ok , that I write you here. As I told you before , most of these lately uploadet files , were done with the upload wizzard....and I do not have ticketnumbers for them....I am sure about this.The best would be, if you could find them by their filename? If you cannot , I will give you ticketnumbers to the versions uploadet with the release generator. Late in the proces I created a system for the filenames: Name of the artwork. Name of the artist. Material. Year of creation.Those uploadet with the releasegenerator, do not have correct names and some dates are not correct. Hi Arthur Crbz. You helped me so much , half a year ago, getting photos into the Elisa Maria Boglino article, and I hope you can still remember I managed to prove about copyright and all that stuff. I have taken a long break from the article, and its nearly finished but I would like very much to get in this last photo. This time I am trying with a photo wich is taken by my uncle , when he visited the museo GAM in Palermo. He and I and my sister own the copyright together to the works of Elisa Maria Boglino who died in 2002. Unfotunately it is not a good and sharp photo , but its the best at the moment.There has been a very beautyfull one at Flickr for more than 10 years , but it dissapeared some month ago. I have tried to get it in, but it was rejected by Jcb, because I did not have URL adress or the name of photographer. Now this one taken by my uncle , has been nominated to delete by De728631, suppose he does not know about the copyright? I have written about all this on the discussionpage...also tried with another photo taken by the museum , but thinking it over , maybe its better to use the one taken by ourselves. I think you didn't read my comments in my discussion page about the picture you just deleted. The picture was and still is a background in all wiki-pages, if you use timeless skin. You can actually see it though only when the page is fast empty. I already thought to put this information in the discussion page of the picture, but it was already away :-)... So, if it really has copyright problems, then it should be immediately deleted from the background of the timeless skin, if it doesn't have copyright problems, then you can just inform me and the rest of the community (for example explaining what it's license status is, which I myself couldn't find out, apart that it stays as background in the timeless skin) :-) thanks. PS: I reloaded the picture with the rest of the wiki environment, so that you can also clearly see what I mean. Request

I understand that you're trying to be careful and protective about permission to post photos on WP, but the Michael Conahan photo should stay and I wrote to a concerned Wikimedia administrator about it days ago without receiving a response. The photo is by definition public domain. It is a mug shot I got by filing a FOIA with the U.S. Marshals Service 10 years ago. All such photos are public. The only photos I've ever posted on WP Media have been public domain mugshots, or photos I've taken myself. The Conahan photo is no different than an official one taken of POTUS or from the Library of Congress. Please restore it. Thank you very much. The subject of the photo, by the way, is scheduled to be released from federal prison in six more years, after imprisoning hundreds of children in a for-profit facility, kids who never should have been prosecuted in the first place many of whom had their educations and lives permanently ruined and even committed suicide. @Arthur Crbz: What needs to happen to establish acceptable copyright provenance for two files by User:Henry M. Stoever that were deleted?

These were written by Henry M. Stoever, submitted to Wikimedia Comments by Henry M. Stoever, with my help (as I watched). What needs to happen so you can accept that he has legal right to release them to Wikimedia Commons?

Secondarily, these were legal documents entered as evidence in a trial in the Municipal Court of Kansas City, Missouri in the US. As such, I would think they should be in the public domain. I'm fairly sure that would be the case for any court of record in the US, unless there were a specific court order sealing those documents. That may not be true in this case, because Kansas City, Missouri, is NOT a court of record. However, that should be beside the point, I would think.

Because this is not a court of record, and because I wanted a transcript for other purposes, I posted a partial transcript of that trial to Wikiversity as Wikiversity:Fifteen anti-nuke protestors tried for 2019 trespass on the Kansas City Plant. Now these documents that were part of that record are no longer available for reasons I do not understand.

Please help me understand what needs to happen so these documents can be restored and made available, as the author and copyright owner clearly intended when he created an account in Wikimedia Commons and uploaded those files under my instructions. I see that you closed several UnDRs today soon after they were opened. All three were completely obvious and uncontroversial, thank you for your work.

However, for your future activities there, please note that the denizens who inhabit UnDR have an informal agreement that we will not close UnDRs for at least 24 hours after the last substantive comment. À la suite de ma demande de vérification d'autorisation de publication de la photo de Laure Darcos (demande que j'avais faite le 23/01), vous avez ainsi supprimé la photo de Laure Darcos hier à 12:17 du fait qu'aucun ticket OTRS n'avait été reçu dans les délais.

Mais cette photo vient d'être réimportée aujourd'hui. Dois-je reposer un bandeau "No permission" ? Un bandeau "Speedydelete" ? Ou faire une demande normale de suppression? À moins que vous ne puissiez procéder à la suppression immédiate vous même.

J'attends vos suggestions.

Photos uploaded of Assyrian Reliefs for Allan Gluck

Hi, Arthur. On January 9, 2020, you deleted a batch of images that I uploaded for photographer Allan Gluck of Assyrian Reliefs on view at the Getty Villa. I had tagged them as OTRS pending but you deleted them for insufficient permissions. Allan Gluck had already sent permission, indicated I was the Wikimedia Commons user who would be doing the upload and his communication was assigned Ticket #2019102210009673. Could those images please be restored? It is a hassle for him to have to send a permission statement for every single image of his that I upload. I have been uploading images to Wikimedia since 2007. Arthur, can the confirming email from the OTRS agent be resent? Is there somewhere I can see a list of the filenames of the images that were deleted? I photographed the same exhibit and have uploaded a number of my own images as well and used a similar naming scheme for his images but apparently made a few changes to his filenames during the upload process and cannot locate them all. The copyright holder is willing to send individual permissions with each file URL if absolutely necessary but it is asking him to do a lot of unnecessary work. Can you check your contributions list for January 9 and provide the deleted filenames from it? Most were photographs of Assyrian reliefs but I had also uploaded some of his images of bronze Roman sculpture from the "Buried by Vesuvius" exhibit at the Getty Villa as well. He is a docent there. Arthur, thank you so much for providing the file names. I also checked with the copyright holder and he has received the confirming email and will respond naming me as the uploader and listing the file URLs. I'm afraid I may have inadvertently caused the confusion around these uploads. I normally upload only my own work or work clearly in the public domain so have little experience with the current OTRS policy. When Mr. Gluck asked if I could upload images for him I researched the OTRS procedure, found a permissions template where he could verify that I am the Wikimedia user that would be doing the uploads and specifying that he was agreed to the CC BY terms. I did not realize he needed to confirm each file URL as uploaded. Mr. Gluck has actually given me thousands of his files on hard drives with the hope that I could upload them over time as my schedule allows. Is there a way that a specific OTRS permission can be granted for his entire collection that I could reference in the file description so he doesn't have to verify his permission for every single file of his that I upload? Achim55 has posted the marking of possible copyvio on the edit #511971762, however the original file I uploaded on Wikimedia Commons is in the entirely different resolution, aspect and format from those of the suspected file on the unknown server that Achim55 provided its URL.

The original file ๓ ค Ր ງ น ค ૪ ( շ օ շ օ ).png's properties: resolution: 5,625 × 10,000 pixels, file size: 102.13 MB, MIME type: image/png

The suspected file on the unknown server's properties: resolution: 690 × 1035 pixels, file size: 0.208 MB, MIME type: image/jpeg

It is impossible to regard the suspected file in even lower quality and resolution as the formerly existing reference of the original one.

In addition, there is no watermark on the original file ๓ ค Ր ງ น ค ૪ ( շ օ շ օ ).png meanwhile the suspected file on the unknown server has a line of letters on the bottom of it.

Therefore, I have committed no copyright violation and the deletion request should be removed.
