Grafiki - własność rządowa III Rzeszy i zasady autorskich praw materialnych - na marginesie PD-Polish[edit]

Na marginesie dyskusji o Commons:Deletion requests/Template:PD-Polish cały pakiet spraw dot.

1. Grafik, których prawnym właścicielem był rząd III Rzeszy (np. MSZ III Rzeszy),lub agencje państwowe ( jak Deutsches NAchrichten Buro) - A NIE OSOBY PRYWATNE- prawa wygasły w maju 1945 po likwidacji III Rzeszy jako państwa -podmiotu prawa cywilnego. Prosi się o stworzenie Template:PD-NaziGov.

2. Zauważyłem ,że niektórzy administratorzy (konkretnie-niemieccy) próbują wykorzystać dyrektywę harmonizującą EU dla generalnej blokady foto sprzed 1945 r.- niezależnie od proweniencji.

3.Tymczasem podstawową sprawą jest kwestia istnienia lub nie MATERIALNYCH praw majątkowych do dzieła, ktore są zbywalne i mogą ulec umorzeniu nawet przed datą śmierci autora.

4.Przykładowo - zdjęcie , do którego prawa zostały sprzedane np.Ilustrowanemu Kurierowi Codziennemu czy DNB,albo wykonane przez pracownika Ministerstwa Propagandy Rzeszy czy DNB , a osoba prawna uległa likwidacji bez następców prawnych prawa nabytego jest zdjęciem w domenie publicznej (prawo zbyte skutecznie nie wraca do zbywcy -autora)

5. Poza tym bardzo dużo starych zdjęć to zdjęcia legitymacyjne, paszportowe etc robione przez rzemieślnicze zakłady fotograficzne , które albo w ogóle nie są ( i nie powinny być )przedmiotem prawa autorskiego , albo jeśli traktować to restrykcyjnie - prawa do nich zostały zbyte przez wykonawcę (twórcę)- fotografa w chwili wyjścia klienta z zakładu fotograficznego po zapłaceniu za wykonanie zdjęcia, niezależnie od tego gdzie pozostał negatyw ( i nikt po wydarzeniach II wojny i komunizmu badać tego nie będzie)

6. Pozostaje kwestia zdjęć amatorskich - bez autorstwa. Jeśli już dziś niektórzy niemieccy admini chcą usuwać zdjęcia egzekucji dokonanych przez Wehrmacht w 1939 r vide : Commons:Deletion requests/Image:Ciepielow.jpg

pod pretekstem dyrektywy harmonizacyjnej i poszukiwania autora ( gdyby się znalazł - to pierwszy do zawiadomienia - Prokurator IPN)...

a zdjęcia z powstania w getcie warszawskim zostały usunięte to aż się prosi o rozwinięcie tematu.

A prawna sytuacja jest taka,że w prawie europejskim ciężar dowodu faktu spoczywa na osobie,która z tego faktu chce wyciągnąć konsekwencje prawne. Dotyczy to zarówno prawa karnego ( domniemanie nieiwnności) jak i cywilnego , którego częścią jest prawo autorskie. Tzn. o ile nie ma dowodu na zastrzeżenie prawa o tyle ono nie istnieje . W polskim prawie autorskim przerzuca to ciężar dowodu na autora ,zaś wydawca ma jedynie OBOWIĄZEK ZACHOWANIA NALEŻYTEJ STARANNOŚCI - tzn. wiedzieć to co może uzyskać przy zachowaniu zwykłych wymogów staranności. Prawo zakłada domniemanie dobrej wiary użytkownika rzeczy czy prawa tzn. ewentualne naruszenie prawa materialnego może stwierdzić tylko właściciel tego prawa zwracając się z żądaniem do użytkownika o zaprzestanie naruszenia prawa ( i udowadniając swój interes prawny). Tzn. trzeba wykazać naruszenie prawa.

Ponieważ jest to powszechna zasada prawa rzymskiego ,obowiązująca zarówno w prawie polskim, jak i niemieckim inne postępowanie jest uzurpacją i po prostu robieniem ludziom wody z mózgu poprzez świadome mieszanie pojęcia autorskiego prawa osobistego, autorskiego prawa materialnego, zasady należytej staranności, domniemania legalności i zasady cięzaru dowodu po stronie tego, który zgłasza zarzut naruszenia prawa.

Generalnie: często słyszany argument,że każda grafika ma autora należy uzupełnić następująco: KAŻDA GRAFIKA MA AUTORA ALE WCALE NIE KAŻDA MA WŁAŚCICIELA i nie ma to nic wspólnego z datą śmierci autora.

To takie wstępne uwagi , które IMHO warto przemyśleć w długi weekend a potem przegadać z innymi adminami na Commons i na wikipl.

Prośba o tłumaczenie[edit]

Cześć. Zwracam się do Ciebie z prośbą (czytaj: zawracam ci głowę), gdyż z polskich adminów commons najlepiej znasz francuski. :-)) Chodzi mi o tłumaczenie opisu grafiki image:Paul Chardot beax.jpg na język francuski. Głównie chodzi mi o tego starszego pana, bo z tego co zdążyłam o nim znaleźć to jakiś lokalne guru i w zasadzie wszystko co dziś wiemy na temat zabezpieczenia ogniowego budynków (nie tylko we Francji, ale na całym świecie) - to zasługa badań tego pana. Images from cepes.com.pl[edit]

User:Koniczek has uploaded images from www.ceper.com.pl/got/got.html and licenced them under Copyrighted free use and one image self-made under GFDL Cc-by-sa-2.5,2.0,1.0 licence even though he has got it from ceper.com.pl. File Deleted by you[edit]

Why did you delete the file, Mounttahomalogo.jpg from the commons. You stated that it is a logo, so? I created it for my school district and there is NO copyright on it!..

Responsible Linguist Needed[edit]

My problem may (or not) involve a usurpation in support of my unified account (a.k.a. Single User-Login), but I would have come to you even if I were sure that a Bureaucrat will be needed for eventual renames of the accounts User:Jerzy and (my current account here at Commons) User:enJerzy.
I say that because User:Jerzy's native language is Polish, and mine English; they have declared themself as de-2 and en-1, and I am probably also de-2, but otherwise monolingual. I've written to User:Jerzy on this subject, in both English and my wretched German, and had no response (even tho User:Jerzy edited since then, 9 days ago). From a selfish point of view, that is nothing serious for me: I haven't contributed on Commons at all in the 4.5 years preceding this month, and the inconvenience of logging in (and remembering why I have to here) on the probably rare occasions when I return after getting my unified acct should be minor.
On the other hand, I am compulsive, and if User:Jerzy eventually asks for renaming, after I've activated my unified account -- perhaps to get their own -- someone may have to deal with deleting and restoring mine for me. And of course the clarity of unified accounts is a convenience to other users, so many users' minor interests are affected.
So in light of your linguistic skill and general wiki-savvy, would you be willing to serve as an interpreter between us in this matter? I'd hate either to just give up, or to ask a bureaucrat to consider notifying User:Jerzy of pending usurpation if there continues to be no objection stated, as a means of ensuring there is nothing more than awkwardness and uncertainty preventing a well informed resolution of this.

I'm not sure I need a full real translation; perhaps i should ask you to correct any misconceptions, and fill in any gaps that are worth worrying about. I detect a polite and cooperative tone. I gather we will need someone like you, as intermediary even if we can forgo full translations. It appears he is saying that he is pl:User:Thornan (and I see that their language profiles match), but User:Thornan was not available; however, it appears to me (without benefit of admin tools) to be free. My impression is that he would be happy to be renamed to User:Thornan with (as I understand is routine) his contributions reattributed to that new username. In that hope, I shan't bother stating my understandings of the roles of Thornanem and JerzyD.
Do i need more translation help?
Should I have you inform him that you or i will approach a bureaucrat, saying that he has agreed subject to those steps succeeding?
(It doesn't appear that you mentioned to him that I would set up a box on the new user & user-talk pages pointing to his new one, but perhaps that is a detail that won't matter.)

Przepraszam, że dopiero teraz, ale to ze względu na wakacje. Będę wdzieczny za pośrednictwo, gdyż są to sprawy, w których nie czuję się mocny po polsku, a co dopiero w innych jęz. Oczywiście, ze idea konta uniw. wydaje się słuszna, więc zasadniczo jak najbardziej Pan Enjerzy może je mieć i to w takiej formie, jaka Jemu odpowiada. A ja mogę figurowac jako - chyba - "JerzyD". Jeszcze lepiej by jednak było, gdybym mógł się podpisywać tak, jak w Wikip.pl - czyli "Thornan". Ale to zostało odrzucone przy pierwszej próbie rejestracji, a Jerzy nie! Stąd jest jak jest. Zatem: chętnie, ale w takim razie, czy mógłybym po pierwsze: zostać Thornanem w Wikim.C., a po drugie zachowac mój "dorobek"? Odette Krempin images[edit]

Hi, you deleted File:Odette-Krempin.jpg as flickr washing. The same user uploaded File:Odette-Krempin-and-Roberto-Cavalli.jpg and File:Odette-Krempin-Charity-Works.jpg but also claimed to be the author on the incomplete request Commons:Deletion requests/File:Odette-Krempin.jpg, which could mean the images (including the deleted one) are valid because the licenses are non-revocable. Błędne kategorie i lansowanie swojej wersji historii[edit]

Dzień dobry. Zgłosiłem właśnie dwa poniższe zagadnienia do admina "Sfu", wiem że nikt nie przebywa tu "non-stop" i dlatego proszę o zwrócenie uwagi na poniższe także innych polskojęzycznych adminów. pozdr

Category:Personifications of Poland[edit]

W tej kategorii jako 3 i 4 plik znajdują się plakat niemieckich nazistowskich władz okupacyjnych w Polsce i propagandowy plakat niemiecki z okresu plebiscytu na G. Śląsku - żaden z nich nie jest ani personifikacją ani też symbolem Polski tylko propagandystycznym narzędziem twórcy plakatu. Pliki 6,7,8,9 są znaczkami pocztowymi Generalnej Gubernii - wymowa ideologiczna tych znaczków to "Goralenvolk - Germanie" i blonwłosi Polacy to potomkowie "Germanów". Przypisujący te pliki do owej kategorii (jako użytkownik zalogowany wielonickowiec z pacynkami i IP) wielokrotnie sprawił już sporo kłopotów na wiki.pl, wiki.en i wiki.de stosując własne "prawdy" oparte na "źródłach" pseudonaukowych. Zwróciłem mu kilka razy uwagę, niestety spotkałem się z agresją i obrazą. Bardzo proszę o zwrócenie uwagi na przytoczone przeze mnie przykłady.

Category:Polish areas annexed by Soviet Union[edit]

Dotyczy tego samego użytkownika co wyżej. [1], [2] i [3] dokonał kolejnego revertu wg własnej wizji historii. Obszary te po ataku na ZSRR nigdy nie zostały zaanektowane przez III Rzeszę, zawsze miały status obszarów zajętych (po niemiecku Besetzte Gebiete). Użytkownik nie widzi różnicy pomiędzy "okupacją a aneksją", "Besetzung a Annexion", "Military occupation a Annexation" i świadomie wprowadza sfoją wersję historii opartą na fałszu. Obawiam się, że niestety jest to czubek przysłowiowej góry lodowej i pod swoimi wieloma nickami "zasiał" na commonsie więcej takich "kwiatków". 77.187.26.183 12:09, 6 June 2012 (UTC)[reply]

Tsarnaev maps[edit]

Hi, I can see the maps are (to be) deleted. I guess the fact that I created them in good faith does not help. :P

I was assuming that using a screenshot of a Google map and making the rest - the much bigger part - of it myself would be fair use (actually, both were accepted by some editor with reviewer rights). Wouldn't it be?

If it is not, how about making a similar map using OpenStreetMap?

Dobry wieczór. Czy mogłabyś temu userowi (Lienhard Schulz) wytłumaczyć żeby przestał wstawiać pod arboretum Wirty kategorię West Prussia ? Ostatecznie pod takimi historycznymi kategoriamii miały znajdować się tylko pliki historyczne z przed 1918/19 oraz historyczne mapy, herby i flagi a nie kompletne kategorie obejmujące komplet mediów. Wielokrotnie usuwałem już takie kategorie z kategorii polskich dworców, kościołów, zamków, pałacy itd ... niestety zawsze znajdzie się jakiś "wieczniewczorajszointeligentniejszy" zza Odry. Dla kategorii obiektów i instytucji nieruchomych (jaką bez wątpienia jest Arboretum Wirty) obowiązuje przecież współczesne kryterium geograficzne a nie epizod z okresu zaboru pruskiego w XIX wieku. Podobne dziwolągi tworzy user (Thoma) patrz tu przypisując je ostatecznie pod ... dwory w Niemczech i Siedliska arystokratyczne w Niemczech ... gdyby to robił tylko z plikami historycznymi z przed 1918/19 lub 1945 to "pal sześć" ale on podwiesza pod to całe kategorie (patrz np. tu dwór Sierakowskich w Waplewie Wielkim, Pałac w Krokowej, dwór obronny w Grocholinie na Pałukach itd..). The 2013 Picture of the Year competition has ended and we are pleased to announce the results: We shattered participation records this year — more people voted in Picture of the Year 2013 than ever before. In both rounds, 4070 different people voted for their favorite images. Additionally, there were more image candidates (featured pictures) in the contest than ever before (962 images total).

  • In the first round, 2852 people voted for all 962 files
  • In the second round, 2919 people voted for the 50 finalists (the top 30 overall and top 2 in each category)

We congratulate the winners of the contest and thank them for creating these beautiful images and sharing them as freely licensed content:

  1. 157 people voted for the winner, an image of a lightbulb with the tungsten filament smoking and burning.

Pliki na Commons[edit]

Dzień dobry. Pomóż, proszę, w tej sprawie. W dniu 17 października 2014 otrzymałem zgodę na opublikowanie dwóch zdjęć "File:Janusz Indulski.jpg" i "File:Henryk Rafalski.pdf" (Ticket#2014101510003325 - Zgoda na publikowanie zdjęć prof. Indulskiego i Rafalskiego). Wykorzystałem te zdjęcia w Janusz Indulski i Henryk Rafalski.

Na mojej stronie Wikimedia Commons, widnieją jednak ciągle uwagi „Ten plik może zostać usunięty”, pomimo moich prób porozumienia się z autorami tych uwag. Wolałbym, aby te pliki istotnie nie zostały usunięte. Pozdrawiam, Stanisom (dyskusja) 21:34, 23 gru 2014 (CET)

Czy mogę cię prosić o wsparcie w kwestii weryfikacji licencji książek z tej listy? Licencja jest podana na stronie źródłowej każdej z nich; czasem są dwie - wtedy druga jest wewnątrz książki. Czy i na jakiej licencji[edit]

Hej. Mam pytanie, a biegły na vikimedia commons zupełnie nie jestem. Chciałbym umieścić zdjęcia ze strony pewnego archiwum. Uzyskałem na swoje pytanie o możliwość wykorzystania tych zdjęć na Wikipedii taką odpowiedź: "Tylko w przypadku wykorzystywania ich do prac popularyzatorsko naukowych z podaniem odnośnika, że pochodzą z archiwum Warszawskiego etc...". Witam, kiedyś mieliśmy kontakt w wikipedii. Teraz proszę o pomoc. Chciałbym umieścić w commons kilkanaście ekslibrisów. Znam autorów (w dwóch przypadkach nie żyją). Nie bardzo wiem jak wystąpić o zgodę {{otrs}} do nich (i ich spadkobierców). A jesli autor nieznany choć eksslibris sprzed 50 lat? I zupełnie banalna sprawa – jak umieścić szablon

Witam, dziękuję za nowy babelek skopiowałem i zamieściłem, chyba nie popełniłem błędu. Dziękuję!!! Co do ekslibrisu już wiem jak wystąpić o zgodę, ale proszę o doprecyzowanie w dwóch przypadkach:

  • znasz ich autora i udzielił Ci on ustnej zgody na publikację [to cytat];
  • zamierzam umieścić kilkanaście różnych ekslibrisów jednego autora, które nie mają swojej nazwy (jedyną identyfikacja jest imię i nazwisko posiadacza ekslibrisu, ale on może być posiadaczem kilkudziesięciu różnych ekslibrisów).

That is why the Wikimedia movement is working on establishing a global guideline called the Universal Code of Conduct, often referred to as UCoC.

After the months-long policy consultation, we have prepared a policy (available in many languages) that has been ratified by the Board of Trustees. We’re currently in the second phase of the process. During this round of consultation, we want to discuss the implementation of this policy. As a member of the functionary team of Wikimedia Commons, your opinion on enforcement is of great value. We want to hear from you on how this policy can be enforced on the Wikimedia Commons community and what might be needed to do so. There are a few enforcement questions so you can easily outline your answers based on them. Please do not hesitate to bring any more questions/challenges you think are not yet discussed.

How we will see unregistered users[edit]

Hi!

You get this message because you are an admin on a Wikimedia wiki.

When someone edits a Wikimedia wiki without being logged in today, we show their IP address. As you may already know, we will not be able to do this in the future. This is a decision by the Wikimedia Foundation Legal department, because norms and regulations for privacy online have changed.

Instead of the IP we will show a masked identity. You as an admin will still be able to access the IP. There will also be a new user right for those who need to see the full IPs of unregistered users to fight vandalism, harassment and spam without being admins. Patrollers will also see part of the IP even without this user right. We are also working on better tools to help.

If you have not seen it before, you can read more on Meta. If you want to make sure you don’t miss technical changes on the Wikimedia wikis, you can subscribe to the weekly technical newsletter.

We have two suggested ways this identity could work. We would appreciate your feedback on which way you think would work best for you and your wiki, now and in the future. I am messaging you because a contest for a sound logo for Wikimedia is being developed and your opinion as a Wikimedia Commons admin is appreciated. My team would like to know if it is possible for the top finalist sound logos in the contest to have attribution temporarily hidden from public view until all the votes are final? Domyślne ilustracje w infoboksach[edit]

Cześć. Czy możesz mi podpowiedzieć jaka jest przyczyna, dla której ilustracja domyślnie zasysana do infoboksu kategorii nie jest zgodna z tą, która jest wstawiona w Wikidanych? Ostatnio wstawiam zdjęcia portretowe polskich aktorów i kilkukrotnie spotkałem się z takim zjawiskiem. Np. W infoboksie kategorii Category:Jerzy Duszyński figuruje fotografia File:Film nr 51 - Jerzy Duszyński - 1948-10-15 - tył.JPG, choć w Wikidanych jest ilustracja File:Jerzy Duszyński.jpg? Zdjęcia legitymacyjne[edit]

Cześć. Nie pamiętam jakie jest podejście do praw autorskich, a tym samym do możliwości umieszczenia w Commons zdjęć legitymacyjnych? W konkretnym przypadku mam namyśli fotografię Franza Jägerstättera, wykonaną najpóźniej w latach 40. stąd wiemy, że było to zdjęcie legitymacyjne. Oczywiście autor-fotograf nie jest znany, więc nie można się odnosić do daty jego śmierci. Ale czy umieszczenie fotografii w dokumencie jest traktowane jako jego publikacja?
