  • A few points regarding the above DRs in order presented:
You wrote for each, The image relies on the scheme presented at Cornell. FWIW, this is the first time I personally have ever seen the word "scheme" used as a synonym for "laws."
You wrote, The challenge is whether an appropriate search for a copyright notice has been completed sufficiently . . .. However, this implies that a search is even necessary. As per numerous commons uploads by We Hope's license info, ie. File:Jersey Joe Wolcott Robert Culp Cains Hundred 1962.JPG, the basic legal requirements are presented clearly.
When I have had copyright questions or complaints in the past, I took them to the commons village pump, en copyright forums, or asked admins on either their talk page or general board. Declaring the above isolated DRs as "test case," without doing so, seems like the issue would not get the immediate community-wide exposure you want, and as yet no one has commented. A guideline-relevant matter which could affect thousands of images should probably be posted to the community, not just to me as uploader, especially now that I can't reply there anyway.
You requested that for the period that the deletion requests are under discussion, they avoid uploading any files that would introduce similar concerns (i.e. UPI photographs). Naturally, I have no problem with that kind of reasoning and would be willing, if able, to comment. However, with an ABF block in place ("until we sort out the mess you have created,") that's unlikely.

  • Edit request: I would like to have a link or text added to the above 6 image DRs restating at least my 2nd paragraph above. That last time I failed to respond to blitz-tagged images they were deleted, despite the rationale being clearly faulty, only because I couldn't take the time to reply to each one.   • Addendum to reasons to keep: The Precautionary Principal, relied on for the DRs, requires "significant doubt" as to whether the images were not copyrighted. However, as both We Hope and Moonriddengirl noted in a previoius image discussion, the conclusion by the Library of Congress with regards to UPI photos (between 1923 and 1963): "It was found that only a few images were registered for copyright and those copyrights were not renewed." After searching for other UPI images online, MRG found that while some of the images found had text material on the reverse side, none found had a copyright notice. Hence there seems no reason for "significant doubt," or even minimal doubt, that the photos were not copyrighted (ignoring the missing, but legally required notices.) --Wikiwatcher1 (talk) 23:45, 21 August 2012 (UTC)
  • Adding future files to En/WP only: I am again considering avoiding Commons and adding images in the future to En WP only. I asked about doing that in a copyright forum, and it was apparently OK. Only User:Denniss, who deleted many Commons images, stated in response, "What they failed to have was the option to verify this claim as copyright notices may have been on the back or in the cropped-out borders." For such images, I will also add a "Do not move to Commons" template. On many occasions, images uploaded to En WP as PD, before I began adding to Commons directly, were later moved by another editor to the Commons. Unfortunately, some of those were deleted, ie. John Huston, which I discovered by accident, since I was not notified of any DR. The template will hopefully prevent that.
The six images listed above have now been deleted. My understanding from the explanations during the AN/U discussion, was as claimed, that "these 6 images are treated as a test case and all six have Commons deletion requests created. Everyone then has a chance to either confirm the license as valid . . ." Although the DR was somewhat based on speculation, inviting others to submit opinions, no one but me has replied (above).
If anyone has valid reasons why avoiding the Commons and uploading to En WP instead is not a good idea, they can give them. --Wikiwatcher1 (talk) 02:14, 27 August 2012 (UTC)
If images are truly and documentably public domain, you can upload them anywhere...but should upload them here, where they can be used on any project. If they are truly and documentably public domain, they should not be deleted. Uploading them to English Wikipedia will not help if the documentation is not thorough. They will be listed at w:WP:PUF as they have been in the past and deleted there as well. As I've told you before, you upload some wonderful images that are of great benefit to users of all projects, but the issue is with the boundary cases. These require more care. The risk is that if you continue uploading images to En Wikipedia that are nominated for deletion, you may wind up blocked there as well. It would be much better for all of us to avoid that, since nobody wants to lose the good material you contribute, which is of great benefit to our readers. --Moonriddengirl (talk) 11:15, 28 August 2012 (UTC)
While I agree that the issue is with the boundary cases, the real problem with most of the deletions is that the boundaries keep moving. Examples: some editor unilaterally wants to see the back of photos, so I try to comply, even though I've never seen a copyright notice on the reverse. Another non-admin editor machine-gun tags 70 images because he doesn't agree with U.S. copyright laws relating to publicity stills. Despite being warned in the past for such behavior, he was ignored and the images were deleted. Another editor suddenly decides that "film stills are derivative works, textbook copyright violations," and ignored my well-cited explanations. Another editor suddenly decides that maybe the "precautionary principle "is involved, overriding documented PD laws, and requests opinions. No one comments, I dispute it, still, six more deleted. Another editor thinks that some new webzine placing a 2012 copyright notice on their website pages, suddenly owns a 1946 still of John Huston.
The ever-shifting PD boundaries on the Commons are the problem. And the "good material" that is supposedly of "great benefit to readers" has earned me a CCI, RfC, AN/U and a month Block without even a warning. Your rational violates the precautionary principal, it seems. Simply because some editor has some doubts, not even explained, would not warrant effectively deleting images arbitrarily. And tagging them when I can't even respond there leaves a lot to be desired in the "common courtesy" area.
As for that extremely rare copyright notice on the back of a "production still," this image is a "publicity still," and as We Hope explains in their own uploads, ""Publicity photos (star headshots) have traditionally not been copyrighted." --Wikiwatcher1 (talk) 23:35, 16 September 2012 (UTC)

Jennifer Jones publicity still "The Song of Bernadette"

Hi Wikiwatcher1; I think I need your help if that's all right. I'd be grateful -- as I've noticed you have worked on the photos for celebrities on Wikipedia. I wanted to add that you do a good job. Excellent work I feel; outstanding I may add. The TCM program owes a lot to you for getting the info out there and into the hands of its audience! I watch TCM often, and look up the old movie stars on Wikipedia in the process. Anyway, my Mother got me a nice ebay photo Christmas gift of Jennifer Jones (one of my very favorites) of her in a still from the 1943 film, "The Song of Bernadette." I just need your help with getting this thing placed inside Jennifer Jones' Wikipedia biography. I want it to replace a photo that was recently deleted. I don't know how to classify its source ...? TribunePhotos sold it to me on Ebay. I almost uploaded it a while ago, but with my limited experience -- I stopped immediately, and thought to turn directly to you. Charles Bronson

Hey Wikiwatcher1. I've been noticing the Wikipedia bios a little more on the Hollywood generation from the not-so-distant past. Man, I've noticed that some how or another, Charles Bronson lost his main photograph -- and his Wikipedia biography has been without a lead photo since 2011. I'd like to see a good black and white picture of the legend. Anyway, I just thought I'd mention his biography since we seem to have a similar interest. Now, if you're busy -- then don't bother. I just came across Bronson's by chance. He was great in "The Battle of the Bulge." That's all right. Charles Bronson and Rod Serling will be on tomorrow plus several of the stars (Burgess Meredith, Jack Klugman, etc.) you've done so much work on will be on the old black & white Twilight Zone episodes all day (24 hours) tomorrow which I'll record about 80% of them off the SyFy Channel's Twilight Zone Marathon. Sad about Klugman who just passed away at age 90 this past weekend; prayers are with his family. I was just wanting to add that y'all have done an outstanding job on Rod Serling's Wikipedia bio plus several others. My mother named me after him. FWIW, my focus, Wikiwatcher1, is on the college football as I serve as a sports writer for several college football players as I've noticed your focus is on photography. The administrator that has helped me out tremendously with Wikipedia is user, Eagles 24/7. He's great. Right now though, I'm ultimately behind on covering those ball players. Hi Wikiwatcher. I was just noticing a few more of the bios lately. Dana Wynter needs an upgrade bad -- if we can find her photograph. Actually, I was more concerned for actor Kevin McCarthy (he died 2 years ago at age 96) as I saw that he only has a trailer screen shot to pick up his Wikipedia bio. McCarthy and Wynter were both in "Invasion of the Body Snatchers" (1956) FWIW. Wynter is stuck with a trailer screen shot though that is worse than McCarthy's. IMDB.com has an excellent black & white photo of Wynter. Great Hollywood actor Yul Brynner can also use some work too.

It's just that I've noticed the fantastic effort you and several others (We Hope, etc.) have put into developing the actors/actresses from the 1940-60s on Wikipedia. And they represent my favorite era in film. Gregory Peck, Burt Lancaster, Lionel Barrymore, and a host of other movie stars now have these wonderful biographies on Wikipedia now. I remember what these Wikipedia bios were like before their upgrades.
