RE: "Copyright violations"

Hi INeverCry,

Before deleting or blocking my account for copy violation consider that the burden of proof is on YOU and that these files are not copy right violations as far as I'm aware. Please note that Wikipedia requires affirmative proof, beyond a Reasonable Doubt in such situations!

Actually, the burden is on the uploader to show that uploads are in fact free. Most of your's are not. I just tagged one that's a screencap from a Youtube video. These aren't your "own work". If somebody upload photo on rail.phototrans.eu then he can not upload it also on commons? Sometimes peolpes write articles about things, which they have never seen. Hi! I recieved an e-mail notificating that you deleted a photo (Olga Behar.JPG) that I upload on wikimedia commons because of Copyright permissions. However, I do believe that my use of the image was not inadequate due to it is a justified use. and also, I put in the commentaries of the photo the sourse and moment of the video. Actually it is just a piece of the video, so I do not really see why it should be prohibited. Anyways I would like ypu to share your reasosn to do it. But seriously I would love if you understand my point of view and let me put the photo again, I repeat, I think it is a justified use of the pic. This was deleted because the source http://www.youtube.com/watch?v=NcCne-mVlAs is under a standard Youtube license, which is unacceptable for Commons. In order to upload a screencap from a Youtube video to Commons, the video has to be under a Creative Commons free license. See Commons:Video#Finding videos online. INeverCry 20:33, 15 May 2013 (UTC)

Autoportrait Hubertine Heijermans

Hello INeverCry, I can understand that a mistake might happen when a painter makes a 'Selfportrait'. The image I am talking about is just that, but in french it is called 'Autoportrait'. The reason that I probably make a mistake for which I am sorry, is that I corrected the image myself, because it was too dark and my computer slightly disformed it, which I corrected. I did not know how the same person goes about a painting of himself. But how can another person upload my own selfportrait? Thanks for an answer, I will appreciate, because the portrait is 54 years ago, an oilpainting painted by the young girl I was. Now I am old I see it suddenly deleted, but the rules are the rules, and I did not know it is difficult for paintings I make of my own face. This Major DR

Dear Admin INeverCry,

Stefan4 has launched a DR on uploads by a certain user (Bru216) who appears to be engaging in mass license laundering on his flickr and panoramio account. I have made comments. Admin Lymantria has been notified on his talkpage but he is away (at this time of day). But you are invited to make a comment in the DR (to delete, keep, etc) if you wish. This all started when user Glabb sent me a complaint here

How exactly did it violate copyright? Yes a picture with the same name was deleted a year ago, it wasn't the same picture, this one passed the commons criteria 2.0. It wasn't the "right licensing" at all. The source http://www.flickr.com/photos/martindo/3571714858/sizes/l/in/photostream/ is under a non-commercial, non-derivative license (CC BY-NC-ND 2.0). The image was deleted as coming from http://photoscopie.prophoto.fr/photoscopie/uploads/images_thumbs/0b/ryan-obermeyer-0b2679db.jpg. I don't know if you have ever flickrmailed people to get them to license images freely from flickr but if you have--like I have in this case--you should read the above message. It concerns the newly redesigned flickr website and how it reduces a flickr account owner's ability to license an image freely. Like Bidgee, I dislike this feature of the new flickr design sadly. I sympathize of course, but I deal with free Flickr images only. I think it's unfortunate that so many Flickr users put what I see as completely unnecessary non-free licenses on what often ammounts to snapshots, but that's their prerogative. But this 'design change' by flickr means that many flickr account owners won't even know how to license their images feeely since the redesign by Yahoo hid the 'edit' button for license changes. Please comment

INeverCry, if you have some time, will you please have a look at the second discussion thread on File talk:'Schloss' in Uster, Ansicht von der Talackerstrasse 2012-11-14 13-28-32.JPG. I removed,with this edit, a gallery of photos which were not other versions of the file but simply different photographs from the other_versions entry of the file description. User:Roland zh reverted it soon enough with edit summary "potentially vandalism reverted, next one will be handled as 'Commons User Problems'". I tried to start a discussion with him on the file talk page, since he has made clear on his talk page that he does not like the messages to be posted there and erases any such message zealously saying he is too busy. He replied saying that "forced discussion" is a "personal attack" and frankly, it might also be a bit about language problem as English is not the mother tongue for either of us!

I know it is not a big deal but for future purposes, I would just like to know

  1. Whether putting all of these files as the gallery on the file page was correct? Please evaluate each individual file entry if you can.
  2. Is there some limit to what can be put in the other_versions entry in file description?
  3. Was I so wrong in removing them that it should be called "potentially vandalism"?

I've commented there. I don't know why people put on the confused act with such simple terms as "other versions". What else could it possibly mean? One thing about the discussion there: your comments are a bit hard to follow because of the lack of indenting. : should follow the first comment, then ::, then :::, then ::::, and so on. I do strongly feel that the files are good PD-India images very similar to File:C. D. Deshmukh.jpg recently closed by you as "kept", as they are "Photographs created before 1958" and, therefore, in public domain in India as per Template:PD-India itself. All the DRs has been open for almost a month now with comments/votes from me and Roland only. Can you take time out and close them or atleast comment on them. There was plenty of sense in deleting it:

1. The file was uploaded by User:Pescailla, so we have no way of knowing if this is really the artist themselves. COM:OTRS permission from them would be needed.

2. Jordi Colomer doesn't have any wiki articles, and doesn't seem to be a notable artist. This means that, aside from copyright concerns, a work like the above may be out of COM:SCOPE. INeverCry 18:36, 22 May 2013 (UTC)

I don't know why people here mark everything without knowing anything, but I can tell you that those files are mine and I can prove it, just tell me how you'd like me to do it and I'll do it. Please undelete them as soon as possible, it took me a long time to understand how this Wikipedia thing works to create my pages, now please bring my files back!

This football league needs to grow and I need my page and my files, please undelete them and if you can help me to not let others delete them again. You won't find those pictures anywhere else in this world by any other person than me. So please, undelete them!

A blank template showing what your email should contain and how it should basically be formatted can be found at COM:OTRS#Declaration of consent for all enquiries. You should also give the whole COM:OTRS page a quick read. Once you've sent the email, it will be handled by an OTRS member. Sorry, another problem came up, I can't seem to find a way to link to the files because they're now deleted. In regard to further uploads, you should mention that in your email to OTRS. An OTRS member can tell you what you need to do. To edit your userpage, just click the edit button at the top. There's no set guideline on what you can put on your userpage. You might want to look around at other people's userpages, to get an idea of what others do for their userpages. As for the files, I would suggest copy and pasting the list you gave above into your email to OTRS and indicating that the files have been deleted on Commons. INeverCry 03:19, 21 May 2013 (UTC)

Maybe replace the key with one of those dynamite plungers, or get a handyman to connect it to the flush button :) waste a lot of water that way I guess, but it would be funny for a change. Maybe one of those video-game guns that you point at the screen is the ideal way to do mass deletions, yes, I think so. I created a UserPage yesterday but I saw you deleted it. It astonishes me, as I just copied and pasted the content of my Userpage on Wikipedia, which wasn't deleted. Could you explain me why you deleted it, and also what I should put on it so that it doesn't get deleted when I'll recreate it ?

File:Rajko Korošec.jpg is just one of my images on Commons, Eleassar marked as copyvio or wrong licenced. It would cost much less energy if there were a week time between the warning and the deleting instead of immediate deleting of the marked files by you or by Eleassar, so the author could have corrected the licencing of the source.
You should know that the Slovene wiki community as a whole has had long lasting periodic conflicts with Eleassar due to his radical and isolated positions and »scribal« decisionmaking (look at my appeal on Wikimedia to stop his excessive deleting passion). E. g. the following two Eleassar's interventions.
1. File:Milan lipovec.jpg. I've gained the OTRS-code for this image of mine, which I uploaded onto Slovene Wikipedia years ago and was transfered on Wikimedia in 2010. E. is not satisfied with the OTRS, demanding: »For the file Milan lipovec.jpg, please post it at your web page so that the free license will be verifiable. Thank you. --Eleassar (t/p) 13:14, 23 May 2013 (UTC).«  As there is the evidence of my uploading the image onto Slovene Wikimedia in the log, I find his demand for an additional inventive proof arbitrary and discriminatory. (FYI, the videorecorded writer Milan Lipovec, who died 1996, was my relative.)
2. File:Miran Hladnik.jpg. This photography of me was taken back in 2006 by self-timer or by my wife. As my wife has been mentioned in the image's log, E. demands she has to apply for an OTRS licence, which we both find redundant; my wife cleared the ambiguity of the photo's »author« to the person who volonteers by giving the OTRS codes, (in Slovene) however, the OTRS code hasn't been granted because the request couldn't be formulated in an official form. (BTW, OTRS ticket sent to me don't include numbered codes - {{OTRS|-}} - which raises assumption they are fake.)
I would appreciate if you check his proposals with more caution in advance, as he is simply too quick in his decisions and changes his own corrections and proposals frequently, returning his editions back to previous ones, after recognizing his fault, thus making the refferencing in the debate difficult and causing bad temper among the uploaders. Most users simply give up, because they don't have enough time, energy and nerves for the pedantic scribal intercourse with Eleassar. Eleassar's reliability has been recently deminished also by the sloppiness of his corrections, e. g. in File:Pasica_portal_literatura.jpg he repeatedly quoted a wrong source supposedly checked by him. --Hladnikm (talk) 11:46, 26 May 2013 (UTC)
With images tagged for speedy deletion, I don't delete without a copyvio url or a convincing reason. With deletion requests, I only delete uncontested FOP cases and others with convincing rationales and/or ones with convincing delete votes by other users. As for Eleassar, I won't treat him any differently than anyone else. I assume that he does his deletion requests and CSDs in good faith according to his understanding of applicable copyright law. I think I need to clarify this properly, Chittagong High Court Building is a public building (or public architecture), so if anyone takes a photo of it, the photo would be exception to the right of the photographer according to the copyright law. Hi, would you be able to separate file histories into two pages? The issue is with File:BSicon dSTRr+1h.svg and File:BSicon dSTR2h+r.svg. It was decided that the versions of these files prior to Axpde's messing with histories on the 9th of May 2013 (currently hidden from public view) should be restored at File:BSicon dSTRr+1.svg and File:BSicon dSTR2+r.svg, respectively, while his own and later uploads and revisions should be at titles with an "h". Hi, I have noticed something strange. Some weeks ago I found a copyright violation with File:Jindřich Hudeček.jpg (the image was taken from here: [2]), so I added {{Copyvio}} and you deleted the file: [3].

Today another user has re-uploaded the file (File:Jindřich Hudeček.jpg), but he has also uploaded the file on flickr ([4], same resolution, uploaded today), so it seems a correct upload.

Kr222 isn't actually saying he's the author. He's just uploading a free-license image from Flickr. I've corrected the author attribution. This Flickr account may very well belong to HUDYsport, as indicated, which would mean the image is ok. Also, the deleted image and this one are different, though they both come from the Hudy website. I guess you could email the HUDYsport website and attempt to confirm that the Flickr account is theirs, but as it sits, I would have to assume that the website and Flickr accounts are connected and that the images are free. Sorry about the confusion, I had just cut and pasted verbatim from the one Oursana had filled in to the new ones, rather than leaving them blank. So they don't really have meaningful descriptions (or paperwork as I call it), just yet.That comes from the silly hounding I get about FX lab requests, I just cut'n'paste to the new image as it shuts up a lot of harassers, and I let the requester know to fill in the details. The requester invariably knows more about the images than the artist does, and the flip-side of that is unfortunate, People don't really know what I am capable of and so they don't ask. I like the map on my talkpage with the moving arrow, (sigh) but nobody is going to know to ask for one of those.

Las fotos que subí y borraste las tomé yo mismo con el celular que tenía en ese momento. La calidad de mi celular no era la mejor para fotografiar pero me pareció bien incorporar las imágenes que YO MISMO TOMÉ a artículos que estaba escribiendo en ese entonces.

Insisto en que yo saqué las fotos y las subí yo tras editarlas con Paint. Así que no entiendo porqué han sido borradas.

I've reviewed the 3 Kuzmin photos. The gun image details are confusing. The first upload, in 2010, is to Deviant Art. I don't see the need for the second source, which was uploaded in June, 2011. I also don't see the need for the details about "per Age of Atom Wiki standard license". This is released clearly at Deviant Art under {{Cc-by-sa-3.0}}, and so the Atom Wiki stuff, and the explanation of the license requirements look to be superfluous. I would suggest removing the Atom Wiki source/details, and the "Permission confirmed by mr. Kenshin personally. Commercial re-use require full attribution of the author in any case of such use", as this seems confusing and unneeded. No problem, but if you want to upload tests in future, make sure you upload free images. This looked like a possible copyrighted quote with a copyrighted flower background. Sometimes I patrol and tag new images very quickly, and you wouldn't want an upload of yours to be tagged as a copyvio before you had the chance to tag it for deletion yourself. By the way, just now you flagged File:MAN_NL363NF.jpg for speedy deletion due to source being watermarked for having a non-commercial license. I am actually acting on behalf of the author and licensor, and I can confirm that the image was correctly licensed, as shown by the watermark, as CC BY-NC-SA. The files in the first part of the above deletion request are paintings labeled as "own work". It looks like the signed examples are by Ilja Bereznickas. Is this User:Origati? Also, there's no indication/proof of if/where these are displayed publicly? Israeli FOP requires this information. As for the second part of the deletion request, User:Origati's authorship was questioned. Israeli FOP allows you to take photos of art, but it doesn't allow you to claim authorship of other people's images. You must be the author of the image itself. Hi INeverCry; some days ago this image was deleted. I think that it is not a clear case of derivative work from a protected photo. The limits between inspired and derivative works are blurred, then I think that this kind of images needs a discussion previous to delete them. Anyway this kind of discussions could be useful; we are promoting the involvement of art students to contribute with images in Wikipedia (this work was one of this) through the wikiArS initiative. Discussions could be a good reference, even if ends in delete, to improve our assignments for future works. Please restore the deleted image and initiate a discussion about it. I love wild squirrels and monkeys. You can cause some trouble for ants where there are carnivorous varieties about. You scatter blood and bone and stuff over the top of the nest of the target ants, the carnivorous ones come and eat it, get the idea it is a dining room, and eat and war against the target ants. It reminds me of the insight into the minds of colony animals that was outlined in the book called "Ender's game" which is really cool. The war between workers was almost incidental, but when the humans targeted the ship with a queen, it was such a social faux pas to do that in battle, they just couldn't believe it. Just in case you start wondering about this file you just deleted: I have reuploaded a freely licensed version. The original uploader JonayID actually happens to be the author of his file: at this website the "Heráldica y Bandera" subpage with the image in question was created by one "Jonay". But as you saw he never licensed his file over here nor at the official website. That's why I opted for a quick copyvio deletion instead of going the "no license" or "no permission" path. The 2 sources you listed in the CSD were violating Dmitry's copyright by not attributing the image to him. The images were posted there after Dmitry uploaded the image to Commons. I suspect the tagger has been told that it is wrong, but they are continuing to nominate these files for speedy deletion anyway. See dispute page here for detailed sources, especially at bottom of page for sourced proof that under certain cases in Canada copyright never expires. Also note the Treasury Secretariat (the organisation that governs the use of the Arms) explicitly states that all versions of the Arms are currently under copyright. Girllover png image

Hey, I saw how you closed that discussion and, while I fully support deleting the SVG given the editor's concerns, the png seems to have been deleted due to a claim by another editor that authorship and permission were not known. The problem is that I had linked to where the original permission was given soon after that claim was made. Seems the site is down, but there are still archives of it indicating the author explicitly said, when asked, that the image was for anyone to use without attribution.--The Devil's Advocate (talk) 22:19, 7 July 2013 (UTC)

The votes from Turelio and Alison, along with Delicious Carbuncle's comment about the FBI source raise a question for me in regard to scope, atleast as far as the consensus in the DR goes. As for the en.wiki deleted image, the history of which I can see, it says: "This rendition was created by Apakal who released it into the public domain." Hey, I've done my first move. It seems that using the "Move & Replace" button from the drop down menu has done everything, including renaming in other projects. I deleted your userpage per COM:ADVERT. Commons isn't the place to link/promote your product or business. As for the gem images, it would be better if they were higher quality/resolution, but either way I have no intention of nominating them for deletion as they do have direct educational value. Thank you for deleting logo of Palembang. But you didn't answer, whether to upload it to Wikipedia. Is that file worth be vectorized on Wiki? Or CoAs of Indonesian cities are sufficient to be as bitmaps? Polish cities have vector CoAs on Wikipedia, so why not Indonesian cities? And what about CoA of Makassar? Well, I did nominate three images of his for deletion (which is how the templates got to his talk page), but that was before he create his user page (yesterday) claiming he administers that website. Before yesterday, his account was inactive since 2011, and even back then it was only active for three days, so it didn't seem likely that I would get a response. Ah, well, use the fast way. If a website has lots of copyright images like that one does, then they are probably for sale. People who sell stuff respond quickly to requests and have lots of ways to contact them on their website. Check the website for a quick way to contact the admin and ask them like that. Easy. It wasn't any kind of "personal attack" at all, I was speaking about general problems with Azerbaijani nationalists on other projects. My comment was constructive and later reply was also very friendly. I simply can't find out how "nationalist" (or "liberal", etc.) can be insult for someone. People has right to have personal views about anything, as long as they make constructive contributions. I found yours very well speaking in general, and you should keep in mind that I'm two years here with hundreds of uploads and over 2000 contributions with clear block log. Why should I spend my time on requests? This user pushed his version by edits war. I think it's not right. I suggested that he give up rollbacks and called administrators but he refused [13]. As for the extended reasoning, this topic is out the scope of the project. Is convenient to discuss in more language section (en wiki for example).
