Twój wkład do Commons

Proszę, nie ładuj do Commons grafik i zdjęć, do których nie masz wyraźnych zezwoleń ich autorów na objęcie ich wolnymi licencjami. Zgody typu "Właściciel zdjęcia udziela zgody na jego wykorzystanie na łamach Wikipedii." nie są poprawne - bo musi być pisemna zgoda artysty na objęcie zdjęcia/grafiki konkretną licencją, przy czym artysta musi być poinformowany, że licencje te zezwalają na dowolne kopiowanie - także poza Wikipedią. No więc właśnie problem jest w tym że:

• Ładujesz te zdjęcia zanim uzyskasz zgodę - kolejność powinna tu być odwrotna - najpierw zgoda przysłana na OTRS, akceptacja zgody przez jedną z osób obsługujących OTRS a dopiero potem ew. załadowanie zdjęcia.
• Prosisz o zgody, które są niepoprawnie sformułowane - zgoda ma dotyczyć objęcia treści określonymi licencjami - nie na publikowanie ich na łamach Wikipedii, bo wszystkie te licencje zezwalają także na publikowanie poza Wikipedią. Jeśli autor przysyła zgodę typu, że zgadza się na publikowanie w Wikipedii to nic nam to nie daje od strony prawnej.

Prawidłowa zgoda powinna wyglądać tak:

Ja, XXX, oświadczam że jestem właścicielem (dysponentem) majątkowych praw autorskich do YYY i udzielam zgody na objęcie tej twórczości licencją GNU FDL 1.3 oraz CC-BY-SA 3.0 z pełną świadomością skutków prawnych tej decyzji oraz, że jest ona nieodwoływalna.

Autor musi być poinformowany, że te licencje zezwalają na dowolne kopiowanie i modyfikowanie objętych nimi treści - nie tylko w Wikipedii, ale ogólnie wszędzie.

• Stosujesz szablony typu "self", które służą do znakowania tych zdjęć i grafik, których faktycznie jest się jedynym autorem. W pozostałych przypadkach należy stosować szablony zwykłe.
• Wreszcie ładujesz zdjęcia archiwalne z opisem "autor nieznany" a następnie opatrujesz je szablonem PD-Old, który stwierdza, że autor zmarł 70 lat temu lub dawniej. Skoro autor jest nieznany to nie wiemy kiedy zmarł i nie możemy uznać, że zdjęcie jest w domenie publicznej. Np: jeśli zdjęcie zostało wykonane w 1910 r. - fotograf miał wówczas np: 30 lat i żył przez dalsze 40, to mógł umrzeć dopiero w 1980, a prawa autorskie do zdjęcia wygasną dopiero w 2051. Jest to typowe dzieło osierocone - którego niestety nie możemy użyć w projektach Wikimedia.

Rzecz dotyczy niedawno załadowanych przez Ciebie zdjęć i grafik, nie wiem więc o jakich dawniej udzielonych zgodach mówisz. Pan Henryk Waniek przysłał niedawno zgodę - ale zupełnie niepoprawną - to znaczy udzielił zgody na publikację swoich dzieł tylko w Wikipedii, co jak już tłumaczyłem nie pozwala ich objąć wolnymi licencjami, którymi one są teraz opisane.

Zgromadzenie Sióstr przysłało zgodę na zdjęcie archiwalne, do którego raczej prawie na pewno nie ma praw autorskich. Prawa autorskie do zdjęć nie należą do tego, kto je trzyma w swoim archiwum, lecz do fotografa, a po jego śmierci do spadkobierców. Po 70 latach od śmierci autora przechodzą natomiast automatycznie do domeny publicznej i niepotrzebna jest już niczyja zgoda na ich publikowane.

Nie chodzi tu o żadne "komunistyczne" podejście do sprawy, tylko o przestrzeganie prawa autorskiego. Przestrzeganie prawa jest akurat charakterystyczne raczej dla innych ustrojów niż "komunizm", który zasadniczo nie respektował nawet prawa ustanowionego przez siebie i często wywłaszczał ludzi z ich własności.

Odpowiedź:

Jeden z admin. pisał do mnie, że powinienem w szablonie wyrażającym zgodę na publikację, (którego adres mi przesłał: http://commons.wikimedia.org/wiki/Commons:Szablon_zapytania_o_prawa_autorskie) podać adresy stron na których grafiki się znajdują – wynika z tego że powinny być wcześniej załadowane.

Jeśli prześle się zdjęcie na commons, którego autorem jest ktoś inny to należy się liczyć z tym, że zostanie ono oznakowane szablonem ostrzegającym, że status prawny tego zdjęcia jest niepewny. Po tygodniu takie zdjęcie powinno być usunięte, jeśli na OTRS nie zostanie przysłana wiarygodna zgoda autora tego zdjęcia. W takim przypadku dobrze jest aby autor zamieścił w mailu link do strony z opisem zdjęcia na Commons, bo wtedy nie ma wątpliwości, do którego zdjęcia jest zgoda. Jeśli zgoda zostanie przysłana przed załadowaniem zdjęcia to wtedy wystarczy np: podać docelową nazwę tego pliku pod jaką zamierza się go do Commons załadować. Wtedy zdjęcie od razu można oznakować szablonem OTRS i nie będzie co do niego żadnych wątpliwości. Można też przysłać zgodę autora na zamieszczanie wszystkich jego zdjęć czy grafik na określonej licencji.

Jak mam rozumieć skasowanie jeszcze przez innego admin. z 13 wstawionych przeze mnie grafik do hasła „Pałac w Kamieńcu (województwo śląskie)” nie wiadomo dlaczego 5. Wszystkie grafiki powstały na bazie współcześnie wykonanych, dobrym aparatem, doskonałej jakości zdjęć, zrobionych tego samego dnia przez tą samą osobę. Wszystkie 13 grafik zostało opisane identycznie i z taką samą licencją. Owemu admin. nie spodobała się Kaplica Pałacowa i Mysia Wieża.

Tego nie wiem - być może do części z tych zdjęć przyszła zgoda, a do pozostałych ich nie było.

Zgromadzenie Sióstr poprosiłem o zgodę na publikację tylko przez grzeczność – zdjęcia które chciałem wykorzystać na Wikipedii są powszechnie dostępne w publikacjach polskich i zagranicznych, których strony podałem w opisie do zdjęć.

To że jakieś zdjęcie zostało gdzieś wcześniej opublikowane, to nie znaczy, że możemy je automatycznie użyć w Wikipedii.

Kto ma udzielić zgody na publikację zdjęcia, którego autora nie da się ustalić, lub zostało ono zrobione na zamówienie.

Nikt nie będzie mógł udzielić takiej zgody, a to znaczy, że my nie możemy tego zdjęcia użyć, do czasu aż istnieje uzasadnione domniemanie, że autor tego dzieła żyje albo zmarł później niż 70 lat temu. Jest to tzw. problem dzieł osieroconych, który niestety bardzo utrudnia korzystanie z materiałów archiwalnych nie tylko nam, ale ogólnie wszystkim, którzy chcą je legalnie udostępniać. Patrz: [1]

Jeżeli już liczymy dokładnie i zdjęcie zostało wykonane w 1910 r. a fotograf żył przez dalsze 40, to przeważnie zmarł w 1950 r.

Racja, ale to i tak oznacza, że prawa do tego zdjęcia jeszcze nie wygasły. Jakby autor zmarł w 1950 to prawa wygasną w 2021, przy czym trzeba wziąć pod uwagę, że mógł żyć dłużej.
