Hi, you marked Image:Kaarma kirik, 2007.jpg for deletion saying it was not Kaarma Church - would you happen to know what church it is? The deletion request is incomplete as the subpage was not created, and the image is NOT considered for deletion at the moment. Deadstar 10:37, 28 August 2007 (UTC)[reply]

Image deletion warning Image:Kaarma kirik, 2007.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this image, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. If the file is up for deletion because it has been superseded by a superior derivative of your work, consider the notion that although the file may be deleted, your hard work (which we all greatly appreciate) lives on in the new file.
In all cases, please do not take the deletion request personally. It is never intended as such. Thank you!

Re:Image:Alfons Rebane in Estonian Army.jpg[edit]

Hello. On the English Wikipedia, the image was tagged with w:Template:PD-Estonia70. I looked, but I could not find the template here. Also, I'm not sure where the image came from. The original en.wii upload log just states it came from the Estonian Ministry of Defence. If you could help out, that would be great. Thanks, Nishkid64 (talk) 16:36, 30 September 2007 (UTC)[reply]

ok. --Raul6 17:20, 30 September 2007 (UTC)[reply]

Template:PD-EstoniaPub[edit]

Hi Raul6, I've noticed you tagged the Template:PD-EstoniaPub. The idea was to make one that would cover the freedom of panorama parts of the Estonian copyright law for uploading pics of Estonian art and photos from the WWII era etc. that are not covered by PD-OLD or PD-EE § 5. of the Estonian copyright law. Or at least the PD-EE doesn't specify on the Template the parts of the copyright law § 19 and that might cause confusion.

meaning § 19 Free reproduction of works for scientific, educational, informational, judicial and administrative purposes. 2) the use of a lawfully published work or parts thereof for the purpose of illustration for teaching or scientific research to the extent justified by the purpose and on condition that such use is not carried out for commercial purposes etc.

I think such an Estonian Template would be needed for WP purposes. Can you help me out with this and finish the started one or make a new one since it seems you have more experience finding your way around on commons. Thanks!--Terker 09:35, 12 November 2007 (UTC)[reply]

§ 19 2) is for non-commercial (..and on condition that such use is not carried out for commercial purposes) use so this case can't be used here.
for more than 70 year old and anonymous pictures (with good source) there is Template:Anonymous-EU. No need for new template.

--Raul6 18:06, 12 November 2007 (UTC)[reply]

Thats not what I'm talking about, the Template:Anonymous-EU in essence is no different from PD-OLD. They both cover + 70 years and in that sense it doesn't matter really if the author was or wasn't known. Please take a look at the copyright law § 19. The current PD-EE-exempt does not cover it. Or at least it doesn't say it on the template. Perhaps the text from Commons:Copyright_tags#Estonia, Freedom of panorama in Estonia is restricted to non-commercial uses only, or to overview photos. should be added to the tepmlate? Meaning, there are a lot of photos from Estonia published after 1937 not covered by any copyright that would fit under this criteria + works of arts produced by Estonian painters etc. later than 1937 etc. that would fit under it. Thanks!--Terker 19:38, 12 November 2007 (UTC)[reply]

Works of art younger than 70 years are always copyrighted. Authorship belonging to author or to publisher. --Raul6 20:11, 12 November 2007 (UTC)[reply]

thats not the case. Works of art younger than 70 years are not always copyrighted! Please take a look at Template:PD-Russia, Template:PD-US-not renewed, Template:PD-US-no notice Template:PD-National Photo Company etc.. Please finish the the started Template:PD-EstoniaPub according to the Estonian copyright law § 19, § 20 COM:FOP#Estonia or update the PD-EE or else please let me know, I'll do it. Thanks!--Terker 20:30, 12 November 2007 (UTC)[reply]

That is: Works of art (under Estonian Copyright Law) younger than 70 years are always copyrighted. Authorship belonging to author or to publisher. --Raul6 20:35, 12 November 2007 (UTC)[reply]

So are you saying that Template:PD-Russia should be used instead for the cases I'm talking about since Estonia was a part of Soviet Union? Another thing is that Estonian copyright law came into effect in 1992 and therefore it can't cover and is not relevant really for anything published before that date--Terker 20:50, 12 November 2007 (UTC)[reply]

And what does § 88 say about protecting works created prior to 1992. (when the current usage of these works is concerned ) --Raul6 22:58, 12 November 2007 (UTC)[reply]

::It says that Template:PD-EE is in conflict with Template:PD-Russia regards of 'work of performers, producers of phonograms or broadcasting organisations up to the year 1953. Seems like another reason to bring PD-EE out from Category:PD-exUSSR-exempt_license_tags. At the same time the § 88 doesn't say anything about images, photos etc. what's important for wiki purposes like §19, 20 clearly allow it. For example, I'd like to upload photos of forest brothers that are taken during the 2nd WW, the images that are clearly not copyrighted by any means but there is no appropriate tag for this. these would not fit under PD-OLD or PD-EE but would require an additional template, Est-pub for the Estonian version of freedom of panorama, non commercial purposes that is allowed by the law. --Terker 23:51, 12 November 2007 (UTC)[reply]

Actually, what it says is that This Act also extends to works and results of the work of performers, producers of phonograms or broadcasting organisations which are created before 12 December 1992. Since photographs are not any of this listed in the law concerning the retroactivity of related rights, the copyright law does not currently extend to any photos made in Estonia before 12 December 1992. Thanks for pointing out the § 88 --Termer 22:41, 9 December 2007 (UTC)[reply]

It does apply to photos becuase photos are also works. --Raul6 19:03, 10 December 2007 (UTC)[reply]

Sure, just that the retroactivity of the rights are not protected with the 70 years rule. Please see juridica.ee by Heiki Pisuke, Professor of Institute of Law The 1992 text of the Copyright Act did not provide a direct answer to the question of whether works created before the entry into force of the Act (12 December 1992) are also protected under copyright. The 1999 amendments make it clear: such works are protected under copyright within the whole term of copyright which, as a rule, is the life of the author plus 50 years after his or her death. -related rights are protected during the entire term of protection (as a rule, for fifty years). That also makes sense since it is similar to Template:PD-Finland50--Termer 00:57, 11 December 2007 (UTC)[reply]

PS. You haven't completed your deletion requests since the images are not added onto the deletion log. Also, an image made in Estonia in 1940 Image:Tallinn - 17 July 1940 - 0-153447.jpg carries Template:PD-Russia for some reason and nobody has questioned it so far. --Termer 00:57, 11 December 2007 (UTC)[reply]

My mistake, the commentary by the professor above appears to be outdated since Estonia had joined the EU in 2004, and therefore life+70 according to the general EU rules apply. I've listed the images at the deletion log. --Termer 05:28, 23 January 2008 (UTC)[reply]

Another thing I just noticed: the legal system in the US or in the UK does not and has never recognized Estonia as as a legal entity of the USSR like suggested on Category:PD-exUSSR-exempt_license_tags, what are we going to do about that?--Terker 20:57, 12 November 2007 (UTC)[reply]

Please take a look at this and see what you think, made a quick one in the sandbox. You'd need to scroll down to it FOP-Estonia. Thanks!--Terker 09:11, 13 November 2007 (UTC)[reply]
It's for non-commercial use only and doesn't fit to Commons:Licensing policy. --Raul6 17:00, 15 November 2007 (UTC)[reply]

Got it! Thanks for pointing it out!--Terker 01:34, 16 November 2007 (UTC)[reply]

I'm also in the middle of figuring out how exactly to use templates for different eras in the Estonian/Baltic history. There is ongoing discussion at Category_talk:PD-exUSSR-exempt_license_tags. It’s not like its going anywhere but. Anyway I think it would be good to sort it out what tags exactly should be used for any kind of era for specific sources. For example tell me if I got it wrong. Template:PD-EE-exempt would apply to anything relevant published by Estonian entities from Feb. 24 1918 on up to annexation by the USSR, meaning August 1940? From that on since the legal systems in the US and in the UK didn't recognize the Soviet Estonian government as legitimate and the US continued to recognize as the only legal representative of the republic of Estonia it's consulate in NY, the Template:PD-EE-exempt would apply to anything related that's published by the consulate in NY and any other sources related to the Republic of Estonia. From 1991 on as the sovereignty of the country was restored the Template:PD-EE-exempt would apply again to anything relevant that’s published by any Estonian sources. Now, the German occupation, anything relevant that’s published in Estonia 1941-1944 , the Template:PD-GermanGov Template:PD-BW would apply? Now, the soviet era, anything relevant that's published under the Soviet jurisdiction in Estonia, meaning 1940-1941, 1944-1991 "Russia and former Soviet Union" , that's covered with Template:PD-Russia would apply? Thanks!--Terker 01:34, 16 November 2007 (UTC)[reply]

PS. The thing that someone has figured that Template:PD-EE-exempt that covers everything relevant from 1918 on, includes the relevant publications of Estonian consulate etc. between 1940-1991 is exSoviet, is another discussion.--Terker 01:34, 16 November 2007 (UTC)[reply]

Thanks for commenting. I notice that it was stated being anonymous work, and the source is given, and the source is quite trustworthy - Estonian Literary Museum. No I have never claimed that I created it myself. I have specified where I found it. No it's not derivative.

Added the copyright tag two minutes after uploading. No I have not created it myself.

It is sourced and tagged and it shouldn't be speedy deleted. Yes I have uploaded other media, if you think they are untagged let me know. Thank you! --Raul6 16:49, 24 January 2008 (UTC)[reply]
