C.G.E. Mannerheim's autograph

You are indeed right in that I do not possess the copyright for Image:CGE Mannerheim autograph.png, however I believe should there exist a concept such as public domain in Finnish law then Mannerheim's signature would fit. My reasoning is that he is a strong figure in the public mind of the Finns, his signature alone has been prominently on display in public places (the Order of the Day that I photographed was in the Cathedral of Turku, his signature has also been prominently shown on posters for the roving Mannerheim exhibition).

Immidiately after uploading the image I sent an e-mail to mannerheim.fi asking for opinions & approval, they did not take any action which I interpreted as their silent approval. A more direct approach would have been to directly contact Carl Gustaf Mannerheim, the Mannerheim family's representative at mannerheim.fi.

All in all, I believe that the various articles in different language Wikipedias about Finland's greatest statesman are enchanced by his signature. At the very least I'd consider its usage fair use.

I assume you did not see this before you wrote at en:User talk:Scoo. As the image page say, the signature I photographed is on marshal Mannerheim's Order of the Day (päiväkäsky) on May 10 1942 as, which has been copied and printed, with one example having ended up in the Cathedral of Turku (behind the pillar farthest away on the left in this image).

See also www.mannerheim-museo.fi/kauppa.htm for more info, apparently it was for Mother's day 1942. I'm no copyright expert, but I've assumed that since it's an official document that is widespread in public places (churches etc.) then it would be OK to upload. Perhaps even Template:PD-FinlandGov may be applicable. Please respond on my commons talk page, interwiki discussions may be hard to follow ;) Scoo 10:07, 23 May 2006 (UTC)

I'll have to thank you for making me look up the image source better (and it's nice that User:Hautala made that PD-FinlandGov template in April this year, wasn't around in December when I uploaded Mannerheim's signature). Hello! Can you tell me what is the problem? I didn't see any copyright notice when I was uploading this pictures. But firs of all - it should be the government work whoever making pictures. What is the current Finnish law about it? I want to keep this images on Wikipedia very bad. Hope we can find a solution. An article about this award on russian Wikipedia also very good. I know, and it really grieves me to make the deletion request. The Finnish copyright law is not like the US, but like the Russian: not all government works are PD, only those that are a part of the official statement or decision (or a law, decree or regulation). The web sites of the Orders are not official statements meant by the Copyright Act, and thus the Orders own the copyrights. They don't need a copyright notice, as they have the copyright in all cases. In order for us to use the material there, they must specifically licence it. Thus, the photos are under copyright, although they represent PD objects.

However, not all is lost. The designs are part of the respective acts and statements on the orders. You can make a vector images of the decorations by using the photos as models. Then, the designs are PD and any creative work involved in making the images is yours to licence. This way, you can make the illustrations for the fine Russian article that are free to use in all Wikiprojects. --MPorciusCato 10:43, 31 March 2008 (UTC)

Unfortunately, no. This is simply an informational webpage. It does not convey any statement of official nature. On the other hand, also all these designs are part of the presidential decrees concerning the orders of the White Rose of Finland and Lion of Finland, so the designs are PD. In practice, if you make a one-to-one vector drawing on the basis of the photos, your work is legal. However, the photo you linked to is under copyright protection. And, you know, I am truly sorry. I'd like to have these photos too. In fact, I went to Finnish national museum in Helsinki and photographed the decorations there, but the glass above the decorations gives so bad reflections that my photos are unusable. To get good photos of the decorations in the National Museum, you'd have to ask the staff to remove the glass and that takes a lot of preparation. Finnish copyright on governmental works

As a non Finnish speaker I misinterpreted Finnish law regarding the copyright status of governmental works in good faith. In many jurisdictions everything published/communicated by public authorities like ministries are free of copyright or free unless copyright restrictions are stated in/on the work.

Would you be so kind to explain the current copyright situation better than now described in the PD-FinlandGov template in English. Lots of non Finnish people reading the template will think PD-FinlandGov applies to much more being not copyrighted in Finland, than Finnish legislation only. The template does link to the actual relevant Finnish law where things are surely adequately defined for those who can read Finnish.--Francis Flinch 17:04, 15 May 2008 (UTC)

The Finnish copyright law makes all laws, decrees and "statements and decisions" of an authority public domain. This means that promotional or informational material released by an authority is copyrighted. For example, governmental websites are copyrighted, even if they are without copyright notice. The category "statements and decisions" includes only such documents which are official opinions of the authority. A {{PD-FinlandGov}} image

A good example of a PD-FinlandGov image is on the left. The copyright of the image was most probably owned by Fortum Oyj, the operator of the plant. However, the image is an integral part of the Finnish Radiation Safety Authority (STUK) annual report on Finnish nuclear power safety. Such report is obviously a "statement" by an authority. It might be a good idea to incorporate your above explanation in PD-FinlandGov, so involuntary violations made in good faith by non Finnish speaking Wikipedians occur less frequently. It might also help if you or another Finnish speaking Wikipedian can find and provide a link to an English translation (if it exists in the first place) of the current relevant Finnish legislation. A good idea. One of these days, I'll include the above explanation into the template. BTW, the text of the act in your link is a bit old. The act was last changed in 2005, including the § 9. The points on educational use have also changed. Anyhow, the educational exceptions are such that you can't use them for Wikimedia projects. The most interesting exception is § 18, which allows the compilation of works for use in education. Using that exception, you can compile a printed literature textbook out of book chapters, sheet music or short novellas that were published over five years ago. You can also incorporate pictures of works of art that relate to the text. The authors have the right to be renumerated, but they must demand it. You are not liable to notify the authors of your undertaking. However, this is of no use to Wikiprojects. Never mind. I was sorry to make that deletion request. The FDF copyright notice is ambiguous (and varies somewhat from page to page), but the Commons decided to deprecate the FDF licence tag. I think that maybe 50 photos I had uploaded were deleted in that deprecation. On the other hand, {{PD-FinlandGov}} is a very good licence tag which is very unlikely to be deprecated. However, that might happen if it is used indiscriminately. That's why I've patrolled Category:PD Finland (government works) from time to time. --MPorciusCato 07:36, 19 May 2008 (UTC)

In Finland, those files are clearly free (I think also Germany counts them as PD), but I think, at the moment, that in the US, the files may well be protected by state copyright or something similar. If you file a deletion request, I will be likely to support it. That flag is definitely a fantasy. As FAF nor any other Finnish service branch has a branch colour, there is no FAF colours without a squadron emblem. (FAF HQ does not have a colour, as Finnish above-brigade-level HQs do not have colours.
