Imagem eliminada

Olá Gunnex, agradeço a informação. A imagem foi eliminada, se é usável apenas numa página eliminada de um projecto, então também não satisfaz os critérios de inclusão do Commons. Podes usar a página pt:Wikipedia:Páginas para eliminar/Registros para listar imagens nestas condições (de vez em quando um admin lusófono do Commons faz a limpeza dessa página). Cumprimentos! Marina de La Riva

Gunnex,

olá! gostaria de saber uma alternativa para eu colocar as fotos das duas capas para o cd "Marina de La Riva". Não sei a quem me referir quanto aos direitos autorais pela imagem das capas - talvez o autor seria a própria artista?

Bom, sei que em outros artigos há a figuras de capas. Ainda que seja em inglês, veja que aqui há a capa para "Release the stars", cd do cantor Rufus Wainwright: http://en.wikipedia.org/wiki/Release_the_Stars

Será que se eu analogamente alegar os mesmos argumentos dados para a imagem do RufusReleaseStars.jpg [wikipedia em inglês], consigo manter as imagens do cd da Marina?

dúvida 2

Então, tem o autor e tudo mais, eu informei. Ok. Agora, como eu faço pra colocar coisas dele na wiki??? Tenho de enviar pra vcs uma autorização por escrito do autor, com a assinatura dele, e com firma em cartório??? Se vc puder explicar pra mim pessoalmente como a coisa funciona, eu agradeço. Já li esse artigo que vc enviou, e continuo na mesma. Não estou enviando as imagens por mal... tanto é que desta vez achei que tinha acertado. =[ Por favor, agradeço a ajuda.

a imagem "marina1.jpg" está sim no myspace da cantora. No entanto, a foto foi tirada por Roberta Goldfarb e está disponível do site dela: www.robertagoldfarb.com.br.

Outra: se eu arrumar a referência do autor e colocar nel "myspace.com/marinadelariva", posso então recuperar o arquivo?

Ok, a última dúvida e eu paro de te incomodar (hehehe, desculpa por tantas perguntas!). Pelo que entendi, mesmo se houver a autorização da Roberta Goldfarb (autora das fotos, até mesmo das fotos do myspace), a foto só poderá ser carregada no wiki se o copyright da imagem for de domínio público, de uso livre? Então, se a Roberta Goldfarb somente autorizar o uso das imagens especificamente para o artigo da Marina, a imagem não poderá ficar aqui no Commons? É isto?

Será que me podias dar uma ajuda com estas questões e explicar-me como é que se faz o upload de fotos de capas de livros, filmes, etc.? Gostaria de saber como regularizar a licença para uso restrito nos artigos, procurei uma forma mas não encontrei a maneira por não ser muito amigável com essa plataforma. Boa noite, tentei carregar a imagem pelo recurso informado por você, porém recebi um aviso informando que não obtenho 500 edições válidas na Wikipédia para carregar a imagem (não sei bem o que isso quer dizer, para ser bem sincero... Considerei um número relativamente alto). Enfim, me certifiquei para que todas as imagens se enquadrem nos quesitos (tamanhos máximos em altura, largura e kb), porém ainda não tenho a permissão e considero importante que essas imagens dos brasões sejam carregadas em suas devidas licenças. Se não fosse um incômodo, você poderia carregá-las para mim ou indicar alguém da Wikipédia que o pudesse fazer de maneira correta e dentro das políticas? Posso enviá-las através de um e-mail. Posso conseguir as outras imagens (prédios, reitorias, etc.) através de amigos professores que possuam fotos tiradas por eles mesmos. The only "may be" was from your part, when you misused the copyvio tag to force deletion of a file that was waiting permission, without any proof nor any reasonable suspicion it was a copyvio. But, taking the opportunity to have your full attention here, I have a case for you. BTW: No intention to annoy you. Just a doubt that appeared right now. If you do not want to comment, no problem. The case: I marked this ptwiki-file on July, 14 with "ESR" arguing that two existing commons-files could transmit the same information. The mark was reverted on the same day by the ptwiki-uploader via argument difficult for me to appreciate. Despite this, and while I was preparing the proposoal of elimination (PE) (only today, I noticed the revert) I start questioning the legal integrity of the both commons files, especially after consulting Commons:Image casebook#Product packaging. Well, in fact, I didn`t found any copyright issues in both files (the logo "Avril Lavigne"? Hm, {{Pd-textlogo}}. The rose? Copyrighting a rose? Hm... ) but a second opinion is welcomed: I don't want to stay with two eliminated commons files, that would make my proposal useless, understand ;-) ? Bom, passando para português, já que o assunto deixou de ser oficial - Toda a categoria da Avril Lavigne está infectada de copyvios carregados pelo milhão de socks do Mazuco. Lendo a URC, penso que teoricamente essa imagem de uso restrito não deveria estar ali, devido ao ponto 2: "Qualquer mídia de baixa qualidade poderá ser carregada caso não possua equivalente livre. Isto significa que conteúdo sob direitos autorais será utilizado somente quando nenhum equivalente livre estiver disponível ou puder ser criado.". Não sabia deste contexto) Bom, já que os dois ficheiros relacionados foram apagados no Commons, estou com mão vazia na argumentação (somada em: "estes ficheiros transmitem a mesma informação visual... + deverá ser feito o carregamento mínimo possível de mídias sob uso restrito"). O que era antes compreensível é agora meio complicado de argumentar :-). Até concordaria com você que no âmbito da URC o carregamento pode ser considerado redundante, mas, considerando Commons:Image casebook#Product packaging, estou ainda com dúvidas se um carregamento aqui no Commons sobreviveria: Note that this does not depend on whether a company or product logo is shown; those are themselves often copyright-protected, but often the problem is not a logo but a printed photograph or drawing on the packaging which illustrates the contents. Já constatei acima que, avaliando a embalagem, "Well, in fact, I didn`t found any copyright issues in both files (the logo "Avril Lavigne"? Hm, {{Pd-textlogo}}^{suplementando: File:AvriLavignelogo.png} The rose? Copyrighting a rose? Hm... )", mas em Commons:Forum#Produkt & Verpackung (Parfum), tópico que criei supondo um carregamento de uma foto privada parecida com [5], já há um usuário que opiniou contra. Eu não conhecia essas restrições todas em relação às embalagens, até porque com as garrafas isso já não acontece, tanto quanto sei. A wiki-en também tem o cartaz dessa linha de produtos como fair-use, de modo que pode realmente haver fundamento nesse uso. Ao menos serviu para eliminar os VDAs Mazuquianos que ainda tinham sobrado. Se você perceber que novas imagens da Avril estão sendo carregadas no Commons com o objectivo de serem colocadas na wiki-pt, é bem provável que se trate de mais uma encarnação do Mazuco, nesse caso pode avisar o Martin H., pois foi ele quem tratou desse caso já em 2008.-- Darwin ^Ahoy! 22:35, 21 July 2011 (UTC)

Ich erstelle gerade "am Fließband" Vorlagen diesen Typs. Im Kern geht es mir dabei um die Frage ob das jeweilige Staatswappen hier auf Commons bleiben kann, da gab es schon ärgerliche Löschungen (und manchmal findet man auch schön kurze Schutzfristen für Photographien). Weil die de:WIPO die Quellen übersetzt zur Verfügung stellt ist das nicht allzu schwierig. Für die beiden Kleinstaaten Sao Tome und Principe und Guinea-Bissau fehlt aber eine englische oder französische Version, weshalb ich da keine Vorlage erstellen kann. Im Grunde müsstest du nur die jeweiligen Schutzfristen heraussuchen, schauen ob das was in Deutschland "Amtliche Werke" vom Schutz ausgeschlossen sind (steht zumeist ziemlich am Anfang) und das ganze dann in eine Vorlage schreiben.--Antemister (talk) 20:55, 10 October 2011 (UTC)

Gesetzestexte, Ministerialerlasse und "sonstige Bestimmungen" von Behörden und der Jurisprudenz sind (im Zusammenhang gesehen und interpretiert, da der Text da etwas wage ist) offensichtlich nach Maßgabe des Vorstehenden urheberrechtlich geschützt (Art. 3 c). Das dürfte die staatliche Symbolik mit einschliessen, da mir in der Hinsicht beim Überfliegen der rund 200 Artikel nichts weiter auffiel.

• siehe São Tomé und Príncipe. Beide Länder haben die Gesetze Anfang (Februar & März) 1972 verabschiedet - mit identischem Inhalt. Auch die Paragraphen 3c (Gesetzestexte, Ministerialerlasse und "sonstige Bestimmungen") und 152 in Sachen COM:FOP sind gleich. Grummel, das hätte ich mir mal früher anschauen sollen: dann wäre das schneller klarer gewesen :-)

Gostaria de saber como eu farei passo a passo para que eles autorizes o uso livre dessas fotos..pode ser uma autorização enviada por email? Olá Dej espindola! O direito de autor pertence ao fotógrafo (e a eventual agência de notícia vinculada) e não a aquele que foi fotografado :-). Portanto, é necessário uma autorização via COM:OTRS das agências relacionadas (no exemplo de File:Rubens-Donizete.jpg, de MediaBike e/ou PPPress, ver nota no fundo em merida.com.br). Bom, talvez você mesmo tirou as capturas de tela, mas os direitos autoriais pertencem aos criadores/desenvolvedores/"donos" do flash game pt:Transformice = (pelo que vi) os franceses Mélanie Christin e Jean-Baptiste Lemarchand. Você simplesmente copiou a arte criada por eles. Tentei localizar uma licença livre adequada para justificar os seus carregamentos mas... sem êxito. Eliminação de Meus arquivos

Eu quero satisfações do porquê de você ter colocado todas as minhas imagens, que eu fiz o upload, para eliminação.

As imagens são minhas ou de pessoas que eu pedi para por na wiki. Isso é trabalho de vários anos de pesquisa e vem um FDP como tu e quer eliminar tudo em um só clique. Desculpa o vocabulo, mas é como eu to me sentindo.

As imagens que você achou na internet são realmente dos sites onde você achou cópia, ou NEM SEQUER EXISTE A POSSIBILIDADE DE TEREM COPIADO AQUI DA WIKIPÈDIA??????????????????????????????????????????????

Alguém por acaso reclamou de alguma imagem????? Então.... porquê apagar?????

Afinal sem mais delongas gostaria que revisse as propotas de eliminação, e me retornasse.

Eu dediquei e dedico muito tempo da minha vida para incrementar artigos relacionados a Santa Maria. Desse jeito o que tu quer é afugentar os wikpedistas.

Como tu faz para saber quem é realmente o dono? Existem imagens que são tão comuns pela internet que ao que parece não possui dono.

Me diga como eu faço para validar de vez os arquivos que eu fiz o upload. Como eu faço para comprovar que houve autorização de quem postou no panorâmio, por exemplo????

Agora só o que falta é propor para eliminação os mapas que EU fiz, inclusive aquele sobre os cursos de água de Santa Maria que está no artigo "geografia de Santa Maria" e q já está proposto para eliminação. Fiz em cad e transformei em png.

Quem sabe me passa links de alguns arquivos que foram "bem registrado" no commons para que eu possa me basear por eles para validar os direitos autorais.

Ao invés de ter um comportamento destrutivo porque você não tentou me ajudar antes, pois pelo o que eu posso percebe eu não soube colocar e registrar as imagens no commons corretamente.

Eu sei que você está fazendo a tua parte para ajudar na wikipédia, mas o tempo que eu estou aqui tentando salvar os meus arquivos, poderia estar pesquisando e upgrading os artigos que eu vigio e gosto.

Alguns, segundo você gunnex estão constando como de uso não livre, como eu posso para registrar como de uso livre????????

Você violou - de maneira sistemática - direitos de autor de vários pessoas e instituições, sem antes ligar o cérebro, tendo em mente somente a preocupação egoísta de ilustrar artigos do "seu" município com imagens - de qualquer fonte. Em outras palavras: Roubou. Já que me chamou de FDP = filho da puta e apresentou acima uma visão obscura sobre direitos em geral (tipo "Alguém por acaso reclamou de alguma imagem????? Então.... porquê apagar?????"), não espere suporte de mim. Resolve o seu assunto com a ajuda da Commons:Esplanada e/ou leia a documentação relacionada (como Commons:Licenciatura, COM:OTRS, etc.). É isso mesmo, ô sherlock holmes, inclusive "Imagens SM" veio da minha inexperiência como wikipedista. Na ocasião só criei o usuário para poder fazer o upload de imagens, depois gostei e só edito as wiki com ele. E egoista não me considero senão teria feito um site ao invés de por na wiki, para que outras pessoas possam ajudar nos artigos também.

É como eu disse, estou indignadíssimo com a situação, mas se é assim que tem que ser feito assim será. Vou me ocupar nos próximos dias então de aprender sobre os copyrights nos links que você me passou e regularizar a situação dos arquivos de midia de imagem.

Hoje já baixou a poeira e não to assim com tanta raiva pra te chamar de fdp. De qualquer forma acho que você sabe muito bem que o serviço que você desempenha como wikipedista deixa muita gente p-da-vida contigo, pois você desconstrói artigos da wikipédia.

Por outro lado eu sei que é necessário que a wikipédia mantenha em dia os direitos autorais dos arquivos nela postado, e a mim só resta a adequação.

Última dica: Procure por imagens com licença livre no flickr (o link mostra resultados da busca "Santa Maria Rio Grande do Sul" usando a pesquisa avançada) e use esta ferramenta para o carregamento. Sempre carrega o original (= máximo tamanho do ficheiro). Do original carregado nos Commons pode elaborar depois obras derivadas para concretizar um detalhe (ver um exemplo aqui e aqui). Tenha um pouquinho de cuidado ("ligue o cérebro") já que às vezes o pessoal do flickr não configura a licença de maneira correta --> exemplo: CC BY 2.0 --> Copyright: Google Maps. Hi Hystrix, danke für die freundliche Worte. In der ptwiki hat es sich nach diversen Admin-Anfragen mittlerweile herumgesprochen, dass ich aus verschiedenen Gründen kein admin sein möchte :-). Ich besitze dort im Prinzip bereits alle notwendigen Rechte, um dort frei und unbekümmert agieren zu können. Hier in Commons bin ich aktuell nur deswegen relativ aktiv, weil ich seit Mai 2012 in der ptwiki bei Hunderten von Artikeln über brasilianische Gemeinden die Geschichte der Gemeinde als z.T. historische copyvio entlarvte und zeitgleich die nachweisbar geklauten Bilder hier ins Nirwana beförderte. Von insgesamt 27 Bundeststaaten habe ich dabei erst 5 durchgearbeitet, von rund 5.600 Gemeinden habe ich erst ca. 1/3 zumindest mal angeschaut. Das kann ja was werden... Wohlmöglich aus Frust und angesichts der massiven Urheberrechtsverletzungen leicht angepi... nervt, bin ich hier neben der Kategorisierung auch mal in das Geschäft der zeitverzögerten Eingangskontrolle über Category:Media needing category review in use at pt.wikipedia und Category:Media needing categories as of XX July 2012 eingestiegen und irgendwie erstmal hängen geblieben :-), weil... weil es offenbar ähnlich wie in der ptwiki auch hier genug zu tun gibt, nur lässt sich die Situation meist schneller und unkomplizierter lösen. Insoweit bin ich auch hier nicht bestrebt, nach den Admin-Knöpfen zu greifen, sondern verbleibe lieber als derjenige, der im Hintergrund rumwuselt. Gunnex (talk) 23:36, 25 July 2012 (UTC)

I checked the permission link but the permission refers only to the related gallery (click on the "Limeira"-buttom below on this site that will load the gallery): "OBS: Todas as Fotos contidas nesta galeria possuem direitos autorais. As fotos podem ser reproduzidas desde que se coloque o crédito: Wagner Morente". And the related image doesn´t appear in that gallery. Even though, the gallery contains some nice images about brazilian municipality Limeira and I´ll upload some of them with {{Attribution}}.^{well, reproducing doesn´t include alteration and for any purpose is not specified. Hi SyntaxTerror. Did you read this? encontrarte.aporrea.org license policy is what we call in Commons License laundering. I discussed and explained it in Commons:Forum#Copyleft (in german) showing some examples like this one (from Fascículo 152" of 07.06.2012): All images in this case here are copyrighted by others than encontrarte.aporrea.org. This example (also from "Fascículo 152" of 07.06.2012) is a copyvio (text & images) from http://prensaincudef.blogspot.de/2012/05/jose-caridad-gonzalez-rescatado-de-las.html of 11.05.2012. Additionally encontrarte.aporrea.org added here an unknown, unsourced, not specified 2D art painting. The problem is: encontrarte.aporrea.org is a free publication plattform for everybody. Achei que na wikipedia em inglês não teria gente como vc atazanando, não... Mas estava errado! Quando vi as mensagens tive a certeza que era um brasileiro. Claro que eu estava certo. Como que as fotos dos estádios da copa (tiradas pelo governo brasileiro) podem estar ilegais? Foto do Joey Ramone em 1980 no Rio tirada por um fã e amplamente distribuída e compartilhada por ele próprio... Tenha certeza que se as fotos forem deletadas eu as colocarei todas de volta. Em relação aos estádios: copa2014.gov.br = Atribuição 3.0 Brasil (CC BY 3.0) = livre. Tudo bem: Mas de onde copiou estas imagens como este? --> File:Corinthians Arena.jpg. Aqui, http://www.copa2014.gov.br/pt-br/arena/sao-paulo, não encontrei nada. Você podia fornecer um link exato desta imagem no portal copa2014.gov.br para verificar o licenciamento? Já que você só indicou "copa2014.gov.br" como fonte --> eu não vou abrir milhares de páginas para procurar esta imagem, entendeu o meu ponto? Pode ter certeza que controlo as metadatas (inclusive usando ferramentas com Fxif etc.). Neste exemplo, aparentemente estamos falando de File:Rich Franklin in Brazil (UFC147).JPG, só vejo na metadata "Fotograf Marc" (Firefox, Google Chrome, IE) . Independentemente disso: "Any commercial (...) requires UFC/ZUFFA, LLC prior written consent" --> = permissão escrita por alguém. Você tém? Entenda que imagens aqui só podem ser carregadas com licença livre - quer dizer: livre de reproduzir, livre de adaptar, livre de usar em qualquer contexto --> inclusive o uso comercial. Olá Soulflytribe! Aparentemente está confundindo diversas coisas. "Wikipedia não é uso comercial". Cada texto/imagem/áudio/vídeo/etc. gravado num projeto da Wikimedia Foundation (exemplo pt.wikipedia.org ou aqui no Commons) deve cumprir e seguir um licenciamento que permite (entre outras coisas) o uso comercial. Releia Commons:Licenciamento (especialmente a seção Licenças aceitáveis na Wikimedia Commons) para Commons. Abre qualquer página na pt.wikipedia.org e clique no link do aviso ("O texto está disponível sob a licença ...") em baixo... Tente se familiarizar com os aspectos básicos desta temática. Técnicamente sim, contextualmente não :-). Eva Perón morreu 1952. O licenciamento {{PD-AR-Photo}} (Argentina) + {{PD-1996}} (Estados Unidos) parece adequado. Alias, o licenciamento de fotografias históricas é meio complicado, especialmente nos casos (como este) quando a fotografia foi feita e publicada fora dos Estados Unidos e carregado aqui no Commons por alguém que não é o detentor dos direitos de autor da fotografia. Neste casos são necessárias 2 licenças: 1x licença da legislação nacional (aqui: Argentina) e 1x licença dos Estados Unidos (os servidores do Commons estão localizados nos Estados Unidos), permitindo assim em conjunto o uso livre no âmbito do domínio público.Gunnex (talk) 07:40, 4 August 2012 (UTC)

Há sim, via Commons:History merging and splitting/Requests --> entretanto, mais uma parte da montagem foi removida por VDA... Mandarei isto para ER agora. Por favor, leia também Commons:Avoid overwriting existing files (mesmo sendo uma proposta) e evite cortar ficheiros originais. Para cortar ficheiros grave o original localmente e faça um novo upload com as correções desejadas sob [título original (cropped)] repetindo as informações do ficheiro original (autor etc.) - de preferência usando {{Image extracted}} e {{Extracted from}}. This pin's was worked by the Comité olympique français (COF, as writen on the pin's) in order of the winter olympics games of Grenoble (France, 1968). Since, COF is dead (1972) into an other comitee with an other logo and this pins become a true public thing (public domain) I pictured. Is it wrong to use it on Wikipedia (as reproduction fidèle d'une oeuvre qui est dans le domaine public, option which exist on Commons) in order to illustrate the own page of the COF ? Hello! Did you made the picture of that pin? As I recall you licensed the file with {{PD-Art}} (wrong: a pin is 3d and has other related copyright issues) and source "Comité Olympique Français". Okay, I think you are confusing some concepts. First of all, read Commons:Quand utiliser le bandeau PD-Art to get orientation. {{PD-Art}} is only usable if the image itself is in public domain. To understand the concept of "public domain", read Commons:À propos des licences#Travaux dans le domaine public and remember "Une œuvre est généralement considérée dans le domaine public 70 ans après la mort du créateur de l'œuvre." (as a general rule). But, if you photographed the pin, the question is: Did you photographed something, that is still copyrighted... In this case: Eventually... :-) The only thing which might be copyrighted, is the flower symbol with the 3 red dots around^{Google Cache} above the olympic rings. Personally, I would say that this symbol is simple geometry and ineligible for copyright. So, I suggest, that you reupload the file using the licenses {{Cc-by-sa-3.0}}, {{PD-textlogo}},{{PD-shape}} and {{Trademarked}} (but only if you have taken the picture by yourself...). Hi! For me, it looked like COM:DW from unknown source with unknown copyright issues. I checked the interwiki but couldn´t find any further information. --> See above. That's certainly not your own work. For historical maps we have a chance to keep the file under a public domain license. But this depends of the original source and publication date which was not provided. With no further action, the file will be deleted in the next days.

• File:Холмск (космический снимок).png

--> That's a derivate work of copyrighted material from Google Maps. You may have taken the screenshot, but the image itself is copyrighted (unless you have an own satellite flighing around the earth, which took this picture :-) ). No chance to keep the file. For satellite images you may try nasa.gov.. See this example and this related image of Kholmsk area. There is a search mask on the left side where you can enter places. Try Kholmsk and you will get some more material. Nasa.gov-images are in public domain. Use {{PD-USGov-NASA}} for the respective license.

--> 1. First of all, it is not your own work (you have not designed the logo), so we have already a license problem here. 2. But: Your source "Государственный архив Сахалинской области" (State Archive of the Sakhalin Region) is little imprecise. Do you have a more specific source (a book, for example) and more publication details (photographer, exact publication date)? Adding these information would be nice...

File:Центр города (Маока, 1940-е годы).JPG is critical, because "Maoka, 1940s years" --> 1940s years = 1940-1949, so it might be, that {{PD-Japan-oldphoto}} may not be usable: Maoka = Japan: 1905 - 1945, after then: Cholmsk = Russia: 1946 - today. If the photo was taken between 1940-1945 --> no problem = {{PD-Japan-oldphoto}}. But after 1945: Russian copyright law. Hello! The author and exact date of the photo isn't known, it is connected, first of all, with operations in August, 1945 (during the Second World War). I took these photos from an album, and there they got from the state Archive of the Sakhalin region (all is so specified in sources of photos of this album, till 1945). File:Центр города (Маока, 1940-е годы).JPG was made in 1940-1944s, so {{PD-Japan-oldphoto}} gets under, already corrected. Thanks!--Max Shestera (talk) 05:27, 28 September 2012 (UTC)
