De hecho, bastantes si no todas las imágenes que has contribuido de 20 Minutos tienen pinta de ser fotos promocionales que en el periódico no se han preocupado de etiquetar correctamente. --Error 02:24, 3 February 2007 (UTC)[reply]

Me preguntas cómo saber qué fotos se pueden sacar de 20 minutos. No sé si hay un criterio claro. Para ir seguro, podrías pedir una confirmación a 20 Minutos de las fotos dudosas, les servirá para que sean más cuidadosos con las atribuciones. Si no, hay que guiarse por el olfato. Si es una foto que parece hecha antes del lanzamiento del periódico (por ejemplo, sale gente mucho más joven de lo que son ahora), habrán tirado de algún archivo ajeno. Si la foto acompaña una entrevista hecha por gente de 20 Minutos, es probable que el periodista se haya llevado un fotógrafo con lo que no hay problema. Si la foto se ve que está hecha en el extranjero o en un entorno muy elaborado, puede que sean fotos de promoción que Commons no puede aceptar normalmente (y además probablemente el promocionado proporcione con más calidad). Si tienes algunas dudas, puedes o comprobar directamente con 20 Minutos o subirla a Commons pasando de paranoias. Eso sí, siempre documenta que la fuente es tal URL de 20 Minutos.

Otro consejo, la licencia de 20 Minutos es {{cc-by-sa-2.1-es}} . No viene en el desplegable así que tendrás que ponerla a mano.

No sé si te he ayudado mucho, pero el problema es más el descuido de 20 Minutos que tú o Commons.

Hi! Please do not upload screenshots from the 20 Minutos website. The articles are published under a CC license, but it does not mean all content from the website falls under the same blanket. A screenshot from Sesame Street is copyrighted by the authors, such as Jim Henson. 20 Minutos has no authority to release it under another license. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Hola Cvbr, disculpa por la tardanza en responder, he estado ausente.
Las imágenes de esa página del ministerio podrían estar hechas por alguna agencia de prensa, no por personal del propio ministerio, por lo que no estarían sujetas a las mismas condiciones que el resto de la información (información textual) que no es modificable ni se va a utilizar comercialmente. Wikimediacommons requiere que el material sea libre para modificar o incluso usar comercialmente, lo que no se puede hacer si el propietario/propietarios de los derechos no es el ministerio. Por todo ello, es imprescindible solicitar una autorización cuyo texto explique claramente las condiciones en las que van a ceder las imágenes. En Commons:Modelos de mensajes puedes ver el tipo de mensaje que se debe enviar. Sobre lo que comentas de la licencia, cualquiera de esos documentos estaría en dominio público, o cualquier otra licencia elegida por la entidad pública, pero tú no puedes relicenciarlos. Un saludo. Hola. Primero de todo quiero agradecerte el trabajo que haces subiendo todas estas fotografías. Creo que son muy útiles. Y disculpa si he sido algo abrupto con las solicitudes de borrado. Como le comentaba a Ecemaml aquí, creo que nos podemos estar excediendo en términos de derechos de autor de acuerdo con la legislación de los Estados Unidos, que no considera de dominio público las imágenes publicadas con posterioridad al 1 de enero de 1923 que no estuvieran en el dominio público en el país de publicación el 1 de enero de 1996. De todos modos, las solicitudes de borrado que he hecho hoy las he hecho con base en la legislación española, no en la de los Estados Unidos. No creo que nos hallemos ante una obra anónima, puesto que son imágenes que se insertan en Mundo Gráfico, que es una obra colectiva en el sentido del artículo 8 del Real Decreto Legislativo 1/1996. Por ello, creo que nos hallamos en el supuesto de aplicación de la disposición transitoria segunda de la Ley de Propiedad Intelectual, que dice que «las personas jurídicas que en virtud de la Ley de 10 de enero de 1879 sobre Propiedad Intelectual hayan adquirido a título originario la propiedad intelectual de una obra, ejercerán los derechos de explotación por el plazo de ochenta años desde su publicación». Hasta donde sé, el Tribunal Supremo no se ha pronunciado sobre esta disposición transitoria. Sí se ha pronunciado sobre esta disposición, cuando era la disposición transitoria tercera de la Ley 22/1987, la Audiencia Provincial de Barcelona:

La lectura de la disposición transitoria tercera de la Ley 22/1987 requiere tener en cuenta, en primer lugar, que en la regulación de la propiedad intelectual efectuada por la Ley de 10 de enero de 1879, no se hablaba de adquisición a título originario de la Propiedad Intelectual y, en segundo lugar, [que] la tradicional contraposición en la doctrina civil sobre modos de adquirir a titulo originario o de carácter derivativo no es plenamente aplicable a la propiedad intelectual. La expresión 'a título originario' viene a indicar que las personas jurídicas titulares excepcionalmente de los derechos de esta clase, lo son en tanto en cuanto no ostentan tal condición por la transmisión realizada por el autor propiamente dicho, o como en este caso, por el intérprete. Sin embargo, conforme a la legislación de 1879, no estando prohibida la cesión por adelantado de la creación artística, cabría también hablar de adquisición a título originario por parte de la persona jurídica cuando, mediante un contrato de arrendamiento de servicios o, en concreto, a través de un contrato de obra, el autor ha cedido su creación a la propia persona jurídica

De modo que solo las imágenes incluidas en obras colectivas publicadas hasta el 31 de diciembre de 1931 habrían pasado a formar parte del dominio público en España. Imágenes de La Moncloa[edit]

Hola Cvbr, ¿qué tal va todo? Hace mucho tiempo que no nos escribíamos. Vengo como socio del capítulo de Wikimedia España y con el propósito final de conseguir que La Moncloa publique su material mediático con una licencia libre, preferiblemente CC-BY-SA. Ecemaml inició hace poco un hilo en el Village Pump pero parece que si algo no se autoriza de forma explícita, entonces no se permite su uso (en este caso uso comercial de las imágenes). En ese hilo hace referencia a una consulta de borrado en la que participaste con conocimiento de causa. Por eso, me gustaría tratar este asunto contigo para que me sugieras cómo enfocarlo e incrementar así las posibilidades de éxito. Si te quieres poner en contacto conmigo creo que la forma más sencilla es utilizando la función de correo de Commons o de Wikipedia. Sí, creo que es más conveniente si lo tratamos vía correo, si no te importa. El único problema es que tú no lo tienes activado, por lo que tendrás que ser tú quien me envíe el primero. En la caja de herramientas hay un enlace llamado "Enviar correo electrónico a este usuario", eso sí, has de estar en mi página de usuario/discusión. En la tuya no verás nada porque no tienes esa función activada (se activa en Preferencias>>Perfil de usuario>>Aceptar correo electrónico de otros usuarios (en la misma página puedes también cambiar el idioma, si te resulta conveniente). En cualquier caso, y dado lo poco que se ha hablado aquí, voy a solicitar la restauración de lo borrado anteriormente. Pero, como dice Poco a poco, en el fondo lo ideal sería que Presidencia publicase su material con una licencia CC-BY-SA y todos contentos. La habilitación de preferencias la puedes hacer tanto en http://es.wikipedia.org/wiki/Especial:Preferencias como en http://commons.wikimedia.org/wiki/Special:Preferences. En el primer sitio, la primera pestaña se llama Perfil de usuario y al final del todo en la página tienes las Opciones de correo electrónico. Ahí puedes introducir tu dirección de correo y, además, marcar la opción Aceptar correo electrónico de otros usuarios. En el segundo, suponiendo que la interfaz está en inglés, lo que tienes que mirar es la pestaña User profile y ahí, de nuevo al fondo, E-mail options. Hola, he tratado de explicarlo, pero supongo que en inglés, y en el formato de una votación de borrado, es difícil hacerlo. Lo primero es que no existe ninguna licencia Creative Commons 2.5. Por la redacción del texto interpreto que se trataría de una CC-BY, pero no lo tengo nada claro. En todo caso, eso no sería un problema definitivo sino fuese porque cuando se enlaza a una licencia concreta en la web del PP de Madrid (en la parte de abajo de todas las páginas, junto al enlace al "Aviso Legal" hay otro enlace a "Licencia Creative Commons"), la que enlazan es CC-NC-ND, y esa definitivamente no es compatible. Con lo fácil que es decir que todo el material es CC-BY-SA y así se dejan de ambigüedades y demás zarandajas. --Ecemaml talk to me/habla conmigo 14:29, 4 February 2013 (UTC) PD: de todas formas, lo que he pedido es que se determine si esa licencia es válida o no. Si no, pues se borran (lo curioso es que la cuenta flickr del PP de Madrid está correctamente licenciada, supongo que porque no les dejan espacio para que introduzcan nada adicional)[reply]
