Droits d'images

Deletion of my work.

I have permission through the MOL Liga and it's member clubs to use their logos, photos and information on Wikipedia. Could you stop randomly marking everything for deletion. Breakfastclub92 (talk) 19:23, 2 May 2017 (UTC)

About some file deletion

Hi

I'm writing because I'm the administrator of webpage of Journal Ingeniería e Investigación of Universidad Nacional de Colombia. Our journal have licence creative comons 4.0 in all its content. We are trying to create a journal wikipedia page to talk about its history, but when we try to upload the cover of our publications those are deleted. We want to know if is possible upload this files without problem or if you consider that unacceptable.

Thanks

best regards — Preceding unsigned comment added by Revii bog (talk • contribs) 03:43, 3 May 2017 (UTC)

  • Hi, where is the webpage? In cases of work already published, "the cover of your publications", and in order to protect the rights of the copyright owner(s), we requires a link to a web site that has a compatible license and that is legitimate to give this license, or that the copyright holder, even if it is you, send a permission to OTRS. Regards, Christian Ferrer (talk) 04:46, 3 May 2017 (UTC)
Hi, sorry for the delay but my internet connection was down. Firstly you must not recreate content previously deleted. Secondly the links, provided just above by you, lead to pages that are not freely licensed. Christian Ferrer (talk) 15:09, 6 May 2017 (UTC)

Question

Hi Christian, I was wondering how I could imply in the permission section that the depicted photo in this file goes under PD-Iran. Thanks.--Mbazri (talk) 12:42, 8 May 2017 (UTC)

I wanted to create a new page of a professional football player, so I did so using evidence for every single piece of information, until a moderator acted in an inappropiate way, his name is Marawa1943, I wanted to report him because it was unfair, I worked really hard with the page, I would be really pleased if your create the page for me and I continue editing it, it's called: https://es.wikipedia.org/wiki/Dani_Ojeda_Saranova — Preceding unsigned comment added by Lugicr94 (talk • contribs) 09:40, 9 May 2017 (UTC)

But you proposed to delete a file from a language you don't understand. Strange. Look for a translator. That's the correspondence with the owner (German Ultrarunners Association - DUV) of the logo telling from where to upload it. Please draw back the deletion request. Thanks --56frosch (talk) 12:42, 10 May 2017 (UTC)
  • No, it's not strange. I think the logo may be above the threshold of originality, therefore, if so, it is protected by the copyright law. And, if I missed nothing, the source you gave to us has not a free license. The source has to have a free license legitimately granted by the owner, or the owner has to send a permission at OTRS where you can read on how to do so.

Merci d'avance

Dhebert (talk) 07:48, 11 May 2017 (UTC)

Christian Ferrer (talk) 11:20, 11 May 2017 (UTC)

Repeated warnings that i'm violating copyright

Hi I sent you an email earlier regarding your warning that i'm in violation of copyright. I did not know that widely distributed printed materials such as album covers are not "free." Once album covers, magazine covers, videos are globally distributed are they not "free." Who would need to give their permission to reuse these items. Also, my photographers have given their permission, twice. Once via your template emailed to permissions and also thought the portal on the permissions page. No one ever received a acknowledgment of those permissions, neither me or the photographers. What do I have to do to do the right thing. I'm certainly not trying to violate anyone here, but merely trying to support the pages I'm editing. — Preceding unsigned comment added by Cheryl Fullerton (talk • contribs) 05:57, 14 May 2017 (UTC)

  • Hi, I already answered to the mail in your talk page, yes indeed it's not because a thing was globally distributed that it become "free". If valid permissions were already sent to OTRS, the right thing to do is to add {{OTRS pending}} in the image files affected by these permissions. Christian Ferrer (talk) 06:04, 14 May 2017 (UTC)

Christian does OTRS have the same email address as permissions, permissions-commons@wikimedia.org? I cannot find an email address for OTRS? Also, the press released photos are in Craig Chaquico's private collection, they are not taken from the internet, book, or publication. They are actual photos that are in his possession. What do we do in a case like this? — Preceding unsigned comment added by Cheryl Fullerton (talk • contribs) 17:26, 17 May 2017 (UTC)

  • @Cheryl Fullerton: Yes, it's the same address, OTRS is the "Open-source Ticket Request System, and the main purpose of this system is to verify and archive licensing permissions.". And yes, when you upload a photo owned by someone else, if the permission is not available on the web, exemple if this photo has not been published anywhere, then the copyright holder has also to send a permission to permissions-commons@wikimedia.org. But of course Craig Chaquico can send a valid permission only in case he is the copyright holder. Christian Ferrer (talk) 17:35, 17 May 2017 (UTC)

Hi Christian,

I just wanted to find out why you marked the photo as possible copyright violation. I am the photographer of the picture, the building belongs my mother in law, there are no people visible on the picture, and I'm happy to have other people freely using this photo. Maybe you an give me a hint what prevents the photo to qualify for Wikipedia commons, as I'm new to Wikipedia commons.

Thanks a lot & kind regards,

  • Hi, it have been deleted because it have been previously published there with a copyright notice. "© 2017 Ernst-Alt-Kunstforum". In order to protect the rights of the owners of already published photos, we require that the first publication be legitimately licensed with a compatible license, or we require that the copyright holder send a permission to OTRS, where you can read on how to do so. My flower

I doubt it's the software that's the problem. It's far more likely the fact that I'm new to processing digital images. Should we just use the original photo unprocessed? or take the original photo and maybe just turn on "fix CA" and "auto fixes"? Let's chat here for a bit instead of making a super long thread at the QIC page. I truly appreciate all your help and kindness. PumpkinSky talk 13:23, 16 May 2017 (UTC)

I've started over from the original on both flower photos. It was turning on "auto tone" that was making them too bright. I've deleted all intermediate versions. All I've done this time is turn on "remove chromatic aberration" and make the flower's center clearer. Let me know what you think. PumpkinSky talk 21:34, 16 May 2017 (UTC)
  • I think that is better now, "to edit" more or less an image is not really an issue in the extend that the edition is an improvment. I am a bit busy in real life now but we will resume this conversation. Christian Ferrer (talk) 05:00, 17 May 2017 (UTC)

copyright violation

Hi, ther is no copyright violation done from our side i think there had been a mistake on behalf of the other user while uploading the poster. i hv told the other user to remove the copyright tag from the poster he has uploaded.so that it will be free of public use and can be used in wiki too.as its my last warning and its been few days our team is trying to upload the poster.could you help us in uploading it? Vinnybellack (talk) 15:51, 23 May 2017 (UTC)

  • Hi there are maybe a few ways to upload this poster on Wikimedia Commons and maybe one way to upload this poster on Wikipedia:
On Wikipedia you can upload a poster under fair use, like this poster. But I am not competent, ask there;
On Wikimedia Commons you can only upload the contents of which you have the copyright, or which has been freely authorized by the owners of the copyright, or that is in public domain. For a work that has already been published, example a poster, the owner of the copyright, even if it is you, must send a permission to OTRS where you can read on how to do so. This is done in order to protect the rights of the owners. Or an evidence that the poster was made with a compatible license must be available in a web site that has the lawful right to do so, example the web site of the production company.
But if you upload again posters or other potential copyright violations without the necessary evidences (see OTRS), you take the risk that your account is blocked from editing. I hope this helps you. Christian Ferrer (talk) 17:59, 23 May 2017 (UTC)

My pictures uploaded

All pictures are my property and are being given free for use by anyone via Wikipedia. There are no copyright violations involved. If you require the exif information this would be very time consuming in some cases? Begaoz (talk) 22:23, 23 May 2017 (UTC) 24 May 2017

  • The images deleted have been deleted because there are prior publications on the web, now every body can come and say "All pictures are my property". In order to protect the rights of the copyright owner(s), the copyright owners must send permissions to OTRS, where you can read on how to do so. Or a source, exemple a web site, with a compatible license that has a legitimate right to give this license, must be provided. Christian Ferrer (talk) 04:39, 24 May 2017 (UTC)

Euro Coin

Hi,do you know if is possible upload pics of euro coins? Thanks --LivioAndronico (talk) 15:10, 28 May 2017 (UTC)

  • Hi, our policies stipulates that the common sides of euro coins are not allowed here. But the copyright of the national side of the coin depend on the corresponding national legislation, you should be able find more precisions for each countries there but as far I see there are almost infos for the former currencies... so I don't know... . Photoshop request

See File:Anas platyrhynchos (Mallard) female swimming 2.jpg both the current Lightroom version and the original. There is plenty of room to crop on the right but she was barely in the frame when I took the photo and no room to extend the left. I think extending the left is possible in Photoshop though, but I only have Lightroom. Could you do this for me in PS? I understand if you are not able. You may need to grab the original and/or extend the right. FYI: it is also currently at QIC under May 29. Thank for your consideration. PumpkinSky talk 23:40, 29 May 2017 (UTC)

  • Ok, it's done. I added space at left and I left space to the right because there is no need to make a crop too tight. However, in my point of view it can not be a quality image because the head is out of focus. For animal photography it is very important to put the head (specially the eyes) in focus. Christian Ferrer (talk) 05:05, 30 May 2017 (UTC)
@PumpkinSky: Hope my version is not too dark, if so, you can ask me for further corrections. Christian Ferrer (talk) 10:49, 30 May 2017 (UTC)
W.carter agreed with you about the head. See her comment. It starts with "Ah, so close". PumpkinSky talk 13:35, 30 May 2017 (UTC)
I see, I uploaded a version with a bit more light/expo. It does not change the fact that the head is out of focus, but it is better now I think. Christian Ferrer (talk) 17:19, 30 May 2017 (UTC)
Can't do much with poor focus. Just a little more DOF would have done it. Yes, I like the lighter version better. Thank you. PumpkinSky talk 17:26, 30 May 2017 (UTC)

„Уики обича Земята“ 2017 започва!

Здравей, Christian Ferrer/Archive25

MediaWiki message delivery (talk) 12:17, 1 June 2017 (UTC)

  • Though I don't know who you are, I think I remember the image. If you are the copyright owner of a work already published, and if this publication does not have an adequate license, see com:Licensing, then you must follow the instructions written at com:OTRS and to send a permission. Otherwise, as the image is available in the web, the image will be very likely deleted again. Christian Ferrer (talk) 18:33, 1 June 2017 (UTC)

Uploaded Images of our company

Dear Mr. Ferrer,

Good day!

I would like to request a permit to upload some images that represent our company such as logo and etc., I have noticed that every time I upload an image that are coming from our website It will disregarded, However I am that one who in charge of the online marketing of our company (Manila Shipmanagement & Manning, Inc.) www.manship.com.

I hope that you consider my request. Thank you very much!

Best Regards,

Felix — Preceding unsigned comment added by Felixonpedia (talk • contribs) 05:32, 14 June 2017 (UTC)

  • @Felixonpedia: Hello, there are several issues with your uploads:
First, the media(s) you want to upload here must fall within the Commons scope, one of your uploads was deleted for being out of our project scope, see the relevant discussion
Secondly, you must read com:Licensing and only upload content following our rules. For example, regarding the content already published we often need a permission from the copyright holder even if it is you, this permission must be sent to OTRS, where you can read on how to do so.
Firdly, if you disagree with a deletion rationale, you must not reupload/recreate the content, this is prohibited and may result in the block of your account. Because 1/if a valid permission is received then the file will be restored by us 2/if you have solved the problems that led to the deletion of a file, or if you think that the deletion was unwarranted, then the proper way is to make a request at Commons:Undeletion requests

Atentamente, Christian Ferrer (talk) 17:59, 14 June 2017 (UTC)

Pictures

I am the person in the picture and own all rights to it. I'm the one who uploaded it. Chopperrose (talk) 13:47, 14 June 2017 (UTC)

  • One image was deleted because it can be found in the web, [3], in such cases and in order to protect the rights of the copyright holder we require that the first publication of the image be explicitly free licensed, or the copyright holder have to send a permission to OTRS, where you can read on how to do so. The other image is not yet deleted but is indeed nominated for deletion, see Commons:Deletion requests/Files uploaded by Chopperrose where you can submit arguments for or against suppressing, this image has "FBMD" in the metadata and this mean that the image come from Facebook, and the same rule as above applies, the first publication must be free, or we must have evidence that you are indeed the copyright holder. Another point is that the image must fall within the Commons scope. Christian Ferrer (talk) 18:14, 14 June 2017 (UTC)

--Steinschreiber (talk) 16:10, 16 June 2017 (UTC) Hello Christian, it seems I missed a deadline for entering my reasons why there is *no* need to delete this photos. Here is my reasoning for keeping this photos: (Could you undo the deletions? If not, what is missing in the following reasoning? (Sorry for the inconvenience: I had no internet access during the voting period.)

keep:

This discussion is *not* about if all photos of cigarette packs are allowed on wikimedia commons, but if *these* carefully chosen photos are allowed on wikimedia commons. It is important to mention that all these photos show on purpose the rear side of cigarette packs. *These* rear sides don't have any parts designed by the tobacco company which have a threshold of originality given.

Reasoning:

Regarding Product Packaging https://commons.wikimedia.org/wiki/Commons:Copyright_rules_by_subject_matter#Product_packaging there are only some very limited exception which allows the uploading: OK There are a some very limited exceptions: 1. Packaging which carries a printed design which is so insignificant as to be incidental. Such packaging can be treated in the same way as a Utility objects. See Commons:De minimis. 2. Packaging which carries only a printed design which is so simple as to be ineligible for copyright protection.

These exceptions listed above apply to these photos due to the following reasons:

Each photo consists of three parts:

1) tax stamp (in the right upper corner): The tax stamp design is *not* owned by the tobacco company, but is owned by the Federal Republic of Germany. see https://de.wikipedia.org/wiki/Tabaksteuer_(Deutschland) Therefor the tobacco company cannot have any rights on the tax stamp design.

2) health warning (picture and the text below the picture, covering 65% of the rear side): The health warnings / health warnings design is *not* owned by the tobacco company, but is owned by the European Union / Federal Republic of Germany. The tobacco company *cannot* chooses which health warning it wants to print, but this is regulated by law (see: https://www.gesetze-im-internet.de/tabakerzg/__6.html Gesetz über Tabakerzeugnisse und verwandte Erzeugnisse (Tabakerzeugnisgesetz - TabakerzG) § 6 Warnhinweise und Verpackung)

3) Area above the health warning not covered by tax stamp (i.e. upper right corner): According to German law (Verordnung über Tabakerzeugnisse und verwandte Erzeugnisse (Tabakerzeugnisverordnung - TabakerzV) § 14 Kombinierte Text-Bild-Warnhinweise bei Zigaretten, Tabak zum Selbstdrehen und Wasserpfeifentabak) https://www.gesetze-im-internet.de/tabakerzv/__14.html ) it is *not* allowed to place any brand names or logos above the health warning. The area contains only text and is below the threshold of originality and therefor is allowed to be shown on wikimedia commons according to the exceptions listed above (insignificant or simple design only)(erreicht keine Schöpfungshöhe).

Regards, --Steinschreiber (talk) 16:10, 16 June 2017 (UTC)

  • @Steinschreiber: Hello, first I reverted your edits in Commons:Deletion requests/Files uploaded by Steinschreiber because the discussion is closed and it is now an archive, we can discuss, of course, but not in this archive. Secondly regarding the deletion rationale, this is about the photos in the middle of each cigarette packs. These photos are about 1/3 of each packs, are in the middle of the images and are fully in focus, therefore I think they can not in any way be considered as De minimis, nor they are in Public Domain. Thus I disagree with an undeletion. Christian Ferrer (talk) 18:25, 16 June 2017 (UTC)

Thanks for your quick response. I've understood that your concern is about the copyright of the photos of the health warning, which are about 1/3 of each pack. The following links are all from the official web site of the European Union (http://europa.eu):

The COMMISSION DELEGATED DIRECTIVE 2014/109/EU of 10 October 2014 amending Annex II to Directive 2014/40/EU of the European Parliament and of the Council by establishing the library of picture warnings to be used on tobacco products defines and lists the actual health warnings (including the photos) http://data.europa.eu/eli/dir_del/2014/109/oj (or http://eur-lex.europa.eu/legal-content/EN/ALL/?uri=celex:32014L0109 ) , i.e. the copyright for the photos is with the EU. You can see the photos of the health warning at the bottom of this web page.

(background info only: The web page is the annex for Article 10 Combined health warnings for tobacco products for smoking of DIRECTIVE 2014/40/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 3 April 2014 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products and repealing Directive 2001/37/EC http://data.europa.eu/eli/dir/2014/40/oj (or http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex:32014L0040 ) )

The laws including the photos are the content of the official EU web site EUR-lex http://eur-lex.europa.eu . This website allows the reuse of its content, i.e. the photos could be shown for commercial or non-commercial purposes:

http://eur-lex.europa.eu/content/legal-notice/legal-notice.html Copyright notice © European Union, 1998-2017 Except where otherwise stated, reuse of the EUR-Lex data for commercial or non-commercial purposes is authorised provided the source is acknowledged ('© European Union, http://eur-lex.europa.eu/, 1998-2017'). The reuse policy of the European Commission is implemented by the Commission Decision of 12 December 2011.

Therefore I think the cigarette packs containing these photos could be shown on wikimedia commons.

Coast Guard Lifesaving Station photos

Hi- I was wondering if you could give me your feedback on these photos:

The first one was taken on a completely overcast day just before rain started, so the lighting on the front wall is more consistent, but the roof is much darker. The second one was taken on a partly cloudy day (the very next day) so the front wall lighting varies, but the roof is brighter and closer to what it really looks like. I've thought of going in the evening for another round of photos. This place is just over the sand dune from the ocean, so it gets very bright here unless there's lots of clouds. These were taken with my polarizing filter to cut the bright sun some. Thank you. PumpkinSky talk 02:37, 19 June 2017 (UTC)

File deletion

Dear My. Ferrer,

I am authorized by the S E A Holdings Limited to create a draft page for them and upload their company logo (Seagroup_logo.gif). I have sent an email to permissions-commons@wikimedia.org using the Wikimedia OTRS release generator. What else can I do to prove I am authorized to use the image? How do I complete the process of donating copyrighted materials? Thank you!

(05:30, 21 June 2017) — Preceding unsigned comment added by Katiecpy (talk • contribs) 05:58, 21 June 2017 (UTC)

If valid permission(s) have been sent to OTRS, then the image(s) will be restored. There is nothing more to do. Note that OTRS volunters have a lot of work and this may take some time before your mail will be checked. Regards, Christian Ferrer (talk) 11:08, 21 June 2017 (UTC)

Thank you for your answer. So even if the images are deleted right now, they can be restored after OTRS release, is that right?

Yes, if the OTRS team receives valid permissions then the deleted images are automatically restored. Christian Ferrer (talk) 11:09, 23 June 2017 (UTC)

May I re upload the deleted images now? Can I just add {{OTRS pending}} before the image posting code while the images are waiting for the OTRS release? — Preceding unsigned comment added by Katiecpy (talk • contribs) 01:55, 26 June 2017 (UTC)

No, the OTRS team will restore the images if necessary. Christian Ferrer (talk) 04:19, 26 June 2017 (UTC)

Hi, Even after repeated requests to not delete my logo, wikimedia hasn't paid heed to my tickets. The BSB Logo is my very own creation and I have proof for it. Should I send the PSD file where I created it? We are trying to get the supporters club running and repeatedly the logo is being taken down. This is very disappointing that a creator has to go through copyright violation accusations for his own work. — Preceding unsigned comment added by Balaji 3003 (talk • contribs) 17:56, 21 June 2017 (UTC)

  • Hi, you may read com:Licensing and Commons:Copyright rules by subject matter#Trademarks, the deleted logo is above the threshold of originality therefore we require an evidence the copyright holder agree with such a publication here, this is done in order to protect the rights of the copyright holder, see OTRS. If you already send a permission, the OTRS volunteers have a lot of work and this may take some time before the permission be checked. But if a valid permission is received then the image will be automatically restored. You may also read Commons:Project scope "To be eligible for hosting on Wikimedia Commons, all files and other content must fall within the Commons scope. Anything uploaded here which falls outside this scope will be deleted." Christian Ferrer (talk) 18:26, 21 June 2017 (UTC)

Hi Christian, thanks for your help about the 4 photos of the rear-side of the cigarette packs at https://commons.wikimedia.org/wiki/Commons:Undeletion_requests/Current_requests#Commons:Deletion_requests.2FFiles_uploaded_by_Steinschreiber Did I get it right, that your statement And in this decision we can read at the article 6 (2)b "the obligation not to distort the original meaning or message of the documents", and it looks great to no derivative restriction. Christian Ferrer (talk) 15:46, 17 June 2017 (UTC) is a vote for undelete? a) If yes, would this be the final decision (i.e. undelete) unless someone else opposes it? b) Or do I have to deliver more reasons to undelete this photos? (if yes, is there a deadline?) Regards, --Steinschreiber (talk) 19:23, 21 June 2017 (UTC)

  • @Steinschreiber: Hi, no I'm afraid you misunderstood my comment, here on Wikimedia Commons "Publication of derivative work must be allowed", I don't think it is compatible with "the obligation not to distort the original meaning or message of the documents". My comment was just a comment, not a vote, but not really in favor of an undeletion. As long as the request has not been closed by an administrator, not me because I opened it, you can deliver more reasons to undelete this photos if you want. The deadline will be when the request will be closed. So if you have something to say I suggest you do it there as soon as possible, because the discussion is open since several days and it can be closed at any time. Christian Ferrer (talk) 20:41, 21 June 2017 (UTC)
  • @Christian Ferrer: Thanks for this info. I've added some new information. If you cannot give a positive vote based on these new infos, I would like to involve a german (native) speaking admin (because some laws are in german only.)

--Steinschreiber (talk) 23:27, 21 June 2017 (UTC)

Yes, I tend to agree and voted, but nothing prevent you to involve a german (native) speaking admin if you want. But be aware that the votes are not sacred, and if the situation looks unclear for the closing administrator then he/she will have to apply the Commons:Project scope/Precautionary principle. Images of Blade of Honor casts

You say that those images were possibly copyrighted. According to their Kickstarter and Indiegogo pages, it says we canuse any contents onany social sites. Also, I was told I could use it. So how do I provide proof or can I provide their individual links to those photos? Asialuang71 6/23/2017Asialuang71 (talk) 16:22, 23 June 2017 (UTC)

  • I doubt the deleted images have been licensed with compatible licenses by their copyright owners, example the kickstarter page have no such licenses nor I think the builder(s) of this webpage own the copyrights for each photos, in order to see what kind of content is allowed here see com:Licensing, but yes if you upload an image that have been licensed with such licenses you must provides the links to the web page that contains the former (source) images with the compatible licenses, or you must identify the copyright holder of each images and they must send permissions by mail to com:OTRS.
