Copyright discussion[edit]

Hi,
Do you not see the source?
Why did you leave it deleted?
Why is everyone trying to hurt? AzeWEB (talk) 09:30, 18 January 2022 (UTC)[reply]
a) Yes, I do. But what I do not see is any evidence for the free license which you claim for this image. --Túrelio (talk) 09:33, 18 January 2022 (UTC)[reply]
This is open access on the Internet and I provided a link to the author, what else do you need? Stop deleting already! AzeWEB (talk) 09:35, 18 January 2022 (UTC)[reply]
Where is the evidence for "open access"? --Túrelio (talk) 09:36, 18 January 2022 (UTC)[reply]
I specified direct access to the photo. I am also an authorized representative, webmaster of these news bureaus, do you think I do not give permission to myself?
Just explain how to do it right? AzeWEB (talk) 09:38, 18 January 2022 (UTC)[reply]
This is not what is meant by "open access". Anyway, what is required for all uploads on Commons, is that they were released by their author/creator/photographer under a free license, as outlined in COM:L. --Túrelio (talk) 09:42, 18 January 2022 (UTC)[reply]
The fact is that I am not breaking anything here, give me your email and I will write to you and you will understand who we are and where we are writing from. AzeWEB (talk) 09:42, 18 January 2022 (UTC)[reply]
In Azerbaijan, the laws do not work like you do. With us, the author is the photographed person himself or the photographer directly receives permission from the person. If he does not agree, then he is not the author. AzeWEB (talk) 09:46, 18 January 2022 (UTC)[reply]
And in Azerbaijan, in the open access of the Internet, photos are in the public domain, especially if the photo is posted on a news site, they are protected by copyright only when a person in absentia applies to a copyright agency and registers this item. Otherwise, everything is not as you think. AzeWEB (talk) 09:50, 18 January 2022 (UTC)[reply]
That is hardly plausible to me, as Azerbaijan signed[1] the en:Berne Convention in 1999 and has the same copyright-duration (70 years pma) as most other countries, per en:List of countries' copyright lengths. Also, your statements do not fit to what's written in Commons:Copyright rules by territory/Azerbaijan.
Anyway, it's no my role here to discuss such fundamentals and I don't have the time for such discussion. Any statements of permission/verification/clarifications need to be made not to me, but to the support-team (VRTS), see Commons:Volunteer Response Team#If you are NOT the copyright holder. So, if you believe that your statements about copyright in Azerb. are real, you may declare that towards the support-team (linked above). --Túrelio (talk) 10:15, 18 January 2022 (UTC)[reply]
Please give me a direct email to these guys. And they'll be contacted by email, straight from the copyright agency. AzeWEB (talk) 10:19, 18 January 2022 (UTC)[reply]
Did you ever go to the pages I linked to you? You have all the information on them. --Túrelio (talk) 10:22, 18 January 2022 (UTC)[reply]
Oh sure. But we have slightly different laws. For example, we are also participants in the Jenva Convention on SDA, but we have our own laws and amendments. Likewise in this. AzeWEB (talk) 10:39, 18 January 2022 (UTC)[reply]

Do you even see who it is?
If you need, he will personally write to you directly from the state (gov) mail. AzeWEB (talk) 09:43, 18 January 2022 (UTC)[reply]
You understand that these people themselves gave me and gave their consent to their photos for me to post here AzeWEB (talk) 10:06, 18 January 2022 (UTC)[reply]
AzeWEB I have just deleted a number of your files that were marked for deletion by other users, and clearly copyrighted by other people. I left some of your uploads that were more dubious, but you will need to email permissions-commons@wikimedia.org, as Túrelio already told your. And no, uploading a photo on the internet doesn't mean it is your work (as you claimed) or that it is under a free license (quite otherwise, the default is that all rights are reserved). If Azerbaijan laws do support your view or the copyright owner licenses them under a free license, we will be happy to keep them. But I am afraid, based on some of your mistakes, that you do not seem very knowledgeable about Intellectual Copyright laws (that's ok, they are quite complex and annoying, plus one could always learn about it) so you are probably wrong on that. This media was probably deleted.
Thanks for uploading File:NurettinCaferov.jpg. This media is missing permission information. A source is given, but there is no proof that the author or copyright holder agreed to license the file under the given license. Please provide a link to an appropriate webpage with license information, or ask the author or copyright holder to send an email with copy of a written permission to VRT (permissions-commons@wikimedia.org). You may still be required to go through this procedure even if you are the author yourself; please see Commons:But it's my own work! for more details. After you emailed permission, you may replace the {{No permission since}} tag with {{subst:PP}} on file description page. Alternatively, you may click on "Challenge speedy deletion" below the tag if you wish to provide an argument why evidence of permission is not necessary in this case.

Please see this page for more information on how to confirm permission, or if you would like to understand why we ask for permission when uploading work that is not your own, or work which has been previously published (regardless of whether it is your own).

The file probably has been deleted. If you sent a permission, try to send it again after 14 days. Do not re-upload. When the VRT-member processes your mail, the file can be undeleted. Additionally you can request undeletion here, providing a link to the File-page on Commons where it was uploaded ([[:File:NurettinCaferov.jpg]]) and the above demanded information in your request.

File:COPAT.png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Re: Photos[edit]

Hello AzeWEB

I will try to address the different points of your message:

  • why you deleted all photos and pictures ?
I tried to explain it above. Plus, I didn't delete all of them (albeit not all of them are too clear). It seems that EugeneZelenko deleted other photos that I had left.
  • We have already solved the problem.
No, you didn't solve the problem. That's why these were deleted.
  • We have a slightly different law. I have already indicated this in other places.
I saw your claim above. This doesn't mean that your claims are right, though. Which law contains the provision you mention? Could you link to a copy of it?
  • There were talks about this, and from the copyright agency they explained to your (official) admins how it should be.
So... where did the copyright agency "explain it to the admins"?
  • The main source is indicated and no one changes the photo. especially since it's open source.
I don't know what you mean by this.
  • Please return the photos. Otherwise, I'll have to complain.
They can be restored after its status is clarified.
  • In Azerbaijan, the laws do not work like you do. With us, the author is the photographed person himself or the photographer directly receives permission from the person. If he does not agree, then he is not the author.
If the author is the photographed person, given that you claimed to be the author of photos of Vaqif Şıxəliyev and Kübra Hüseynova photos… does that mean that you are both Vaqif and Kübra?
  • In the open access of the Internet, photos are in the public domain, especially if the photo is posted on a news site,
You are probably not using these terms in their usual meaning.
  • they are protected by copyright only when a person in absentia applies to a copyright agency and registers this item.
In absentia? That's probably not the latin term you wanted. Anyway, if works are only protected by copyright if registered for it, you would need to show evidence that no copyright was registered for the images you uploaded (not that it can be registered in the future, retroactively making the uploaded images unfree). For example, that https://www.magazinsortie.com (from which you fetched File:NicatShakirli.jpg) didn't register for copyright. (Despite their footer apparently stating otherwise: «Copyright © 2022 - Tüm hakları saklıdır. MagazinSortie»)
    And if the images were Public Domain and could be modified, sold, etc. by anyone, its license statement should be a custom one for this Azerbaijan-specific status, not {{Cc-by-4.0}}
  • Otherwise, everything is not as you think.
Then you will need to clarify how things really are.

Platonides (talk) 01:31, 23 January 2022 (UTC)[reply]

Thank you for the clarification. But the fact is that I am directly connected with these people, I personally photographed someone. Someone had to be taken from the site, because they are already there, some sites. But pointing out the link to the source, I thought everything would be all right. Am I doing something wrong and most likely this is due to poor knowledge of English. I can present you the passports of the people I have uploaded, and thus I can confirm a direct connection with them. There are even people of whom I directly represent legally. I am their authorized representative. In any case help me here. I will be very grateful. AzeWEB (talk) 02:21, 23 January 2022 (UTC)[reply]
