Contrary to the unsubstantiated assumption made in the delete request this is my own work; however, without EXIF and deliberately in reduced resolution appropriate for Web viewing. If some particular EXIF data are required by policy, I can create a file with those fields added. (Feel very welcome as a first time contributor). Ablaut490 (talk) 05:29, 28 September 2019 (UTC)

@Ablaut490: This is not required, but lack of EXIF constitutes a reasonable doubt due to COM:PCP and because providing grabbed from somewhere low resolution images without EXIF by new uploaders is very common. Note, that you did not contest deletion and nobody provided any resonable arguments for removing EXIF here during the week of he deletion process. Argument of reducing resolution due to web viewing requirements does not work here as (a) full-screen images are preferred to be used in Wikipedia and (b) reducing resolution is done server-side by Mediawiki software automatically so no need that uploader does it themselves. You can still upload a high resolution image or provide it to COM:OTRS if you have private reasons not to publish EXIF info. Or you need to provide here better arguments for its removal. If you have reduced resolution due to other usage of the image, the COM:OTRS procedure is still required. Ankry (talk) 06:11, 28 September 2019 (UTC)

You know, it's not worth my effort. I was happy to license a picture that well illustrates a wiki post, but I don't get anything out of it and will limit my contributions to where they are welcome (or where the rules are spelled out upfront).   2. Are you the author (photographer) as you claim? If so, why do you upload a photo from facebook instead of the photo from your camera? If you are not, claiming so is violation of photographer's moral rights and illegal.
  3. Do you own copyright to the photos? If so, how did you acquire it?
  4. If the above are not the case, COM:OTRS permission is needed as pointed out in the deletion nomination and the deletion log. It is also needed for any photo that has been published earlier without a free license. It is irrelevant if it is still available there or not. And facebook is not a freely licensed site.

Fort Michilmackinac

This photograph was taken by me with a Pentax Spotmatic film camera (I have the negative). That means it is pre-digital. I scanned the original photograph so that it could be published on this site as a digital image. @Trampota: It depentds on what you really did pay for. Copyright still belongs to the photographer, unless there is a copyright transfer clause in your contract. Please check your contract. Chinchilla x-ray

Hello, I am a bit disoriented about two image deletions.

I uploaded two images and in hindsight I realize that I did so with incorrect licensing. The files should have been deleted.

This should have been from my account on 30 July 2019. I placed the images into Category:X-rays of rodents. I expect that they were deleted for lack of free license rationale. I would like to change the license to apply an appropriate license.

I cannot find the file names in my edit history. When files are deleted, do they disappear from edit history? I could be mistaken about all this but I thought I uploaded the files, and I expected to find a deletion notice somehow.

Can someone identify these deleted files and undelete them for me to fix? Thanks.

Hello, The website Carolina Connection, which was cited as the reason for the copyright strike, does not own the copyright. The timestamps on the photo upload and their story are two days apart. I have reached out to them to properly attribute me.

I posted the photo to Facebook and Instagram long before Carolina Connection picked up the photo and improperly used it.

If you are not the photographer, you are required to provide an evidence that free license has been granted by the image copyright holder together with an evidence that the person granting the license is the actual copyright holder. Your belief is not enough. This must be based either on public records or on communication following COM:OTRS instructions (where forwarded emails are not acceptable). this is my work, by me entirely and the date this image was taken is 11 July 1975 in Basel at the residence of Ernst Herzig (also known as Ernie Hearting) with my Leica camera. I allowed Mr. Christoph Roos several years ago to use my image without any restrictions.

Only yesterday, I uploaded a photo of an association football goalkeeper playing for his. I got a message saying that it should be deleted. I couldn't find somewhere where there are reasons why that image should. Now, it's not been copyrighted from somewhere else. In fact, there is not this image anywhere on the internet apart from Wikipedia. I am correctly following the rules when uploading a photo, especially the kind in different articles. Please do not remove this image.

@FastCube: Due to low resolution and lack of camera EXIF data it is considered to be a screenshot and not your photo. If you disagree, you can convert the deletion nomination into a Deletion Request and prove your authorship in the discussion there. The 4 photos I uploaded from Flicker were from Norway's Parliament. They shared the photos with "Attribution-NonCommercial-NoDerivs 2.0 Generic (CC BY-NC-ND 2.0)", so I was not violating copyright by posting them as the person who deleted the uploads said.

@Alemipiruz: While uploading, you claimed to be the photographer and the exclusive author of all the presented works. So how can we believe your words now? In order to undelete the image their copyright holders (Farrokh Shayesteh, the photographers,...) need to send free license permissions following COM:OTRS instructions unless their free license declarations may be verified basing on public records. Or an evidence is needed that the copyright expired already (eg. evidence of a photo publication more than 30 years ago) on image by image basis. We cannot rely just on your declarations. Maybe, but we should know at least about the pre-1949 publication evidence and no such information is provided by the uploader. All we know is thet it was taken in 1949. The only question (IMO) is whether the municipality owns copyright of the works (via contract with authors) or has the right to license derivatives (likely this should also be granted in the contract). We generally assumed that when government officials grant something, they know what they are doing.   • if it is still copyrighted, who the copyright holder is and where is free license from them?
And please note, that except copyright status in Russia we need also its copyright status in US, which generally depends on initial publication date. For photos published after 2002 copyright generally expires 70 years after the author death. There is name of a photo agency, date 1954 so the photographer is identifiable and could not die more than 70 years ago.

      Yes, in 1954 he was fired from the KGB of the USSR. Upon dismissal, they made the last photo for their personal affairs with all the awards. This was required to provide a military pension. official personal file is not an official document. It is likely a set of various documents (and other media) issued by various institutions. A photo itself is also not an official document. If the photo become a part of an official document, eg. some identity card, it may indeed be PD. Othrwise it is not. 1982 publication means, that US copyright exists if and only if the photo was copyrighted in Russia in 1996. The Dutch Wikipedia page about the Mountain Dew soda brand shows a photo taken of an American Mountain Dew soda bottle. As the page is Dutch and mostly is explaining Mountain Dew's history in The Netherlands, I have added two additional photos similar to the already existing photo on the page, but instead showing the bottles and cans produced in The Netherlands that the page talks about. These photos I have taken myself and are free for anyone to (re)use. I am unsure why these are deleted as I think they are more appropiate to use on this page than the photo showing the American soda bottle. Germes (talk) 23:26, 6 October 2019 (UTC)

@Germes: There are legal status differnces between these products:
first, the US product label contains almost nothing but letters; if you make a similar photo of Duch products (where graphic elements of label are not visible) it might be OK; however, I doubt if it is possible and there is another problem:
second, in the US threshold of originality is higher then in EU; so it is possible that if the US photo presented an European product, it would be copyrighted in country of origin. Commons rules require the work to be free in US and in the country of origin, while it may be copyrighted somewhere else.
I think, you need to ask the label copyright holder for a free license permission or focus on products that are 70+ years old. Ankry (talk) 23:44, 6 October 2019 (UTC)

Simple geometric shape is IMO a triangle, circle, square or something like this. If there is more complex formula required to describe a shape, I do not consider it "simple". The fish does not seem to me to be significantly simpler than the snapchat logo (which, as I was recently teached, is copyrighted). But this is just my opinion. The Club Atlético (Athletic) Aldosivi has no copyright restrictions as long as the source and author are cited. You should also remember that the image is in svg format, which makes it easy to avoid copyright issues. Unlike some Wikipedias, Wikimedia Commons does not accept Fair Use images. Images published here must be free for any use, including commercial and derivative work creations. Does the club explixcitely accept such wide reuse by anybody? If so, please link to the club officials' declaration and we will be able to go on.
Moreover, copyright restrictions are not due to clubs decision but due to law. Even if the club do not sue copyright violators now, we need to be sure that they will not change their mind in future (or that changing their mind will be legally irrelevant for reusers). Ok, I understand this. But as your partner Perhelion said, the logo that represents a shark is very simple (keep in mind that it is not a fish, if not a shark). All other clubs of the Argentine Soccer Super League are licensed under "simple geometric shapes", when in repeated cases they have the same or greater degree of complexity than the Aldosivi logo. Club representatives do not have an official statement specifying that it can be shared on the web, as the other 23 teams in the league do not have. But if this declaration were necessary, being Aldosivi a humble Club and close to its members, it could be obtained (by the head of the marketin department or the community manager for example). That link was quickly followed up by Commons:Review of Precautionary principle, which reverted the policy edit made after your link, and resulted in the current text of: Files nominated for deletion due to the URAA should be evaluated carefully, as should be their copyright status under US and local laws. A mere allegation that the URAA applies to a file cannot be the sole reason for deletion. If the end result of copyright evaluation is that there is significant doubt about the freedom of a file under US or local law, the file must be deleted in line with the precautionary principle. That does say that we should really know what the terms were on the URAA date, and show that the work was not PD then. There are lots of ways we may not have information, such as not fully documenting laws at the time (including older laws where non-retroactive increases could make relevant), so we should not delete when there are some significant questions on the URAA status, and the work is PD otherwise. French terms though are pretty well known; in 1996 they were 50pma plus the wartime extensions. It would seem the wartime extensions would put it just over the line, unfortunately. That all said, there are some admins who keep using the earlier link as policy and won't delete such works -- as the URAA is particularly frustrating in cases like this one -- so there will be DRs which go both ways. I'm not sure we have sections which carefully document the law on the URAA date for each country, though. In many cases, aspects of historical laws come into play. For example, the situation described in the now-deprecated template Template:PD-Austria-1932, while not being valid in Austria today, was in fact the situation in January 1996 (Austria did not implement the EU directive until later in 1996), so pre-1932 photos which have since expired via 70pma or anon-70 in Austria should still be fine by the URAA. There are lots of other examples like that, too. There can be other types of gray area even when the laws are known -- in Germany, a court later ruled that the EU directive (implemented in 1995 in Germany) substantially changed their definition of "simple photo" from most any snapshot-like photo to only things like X-rays (despite no change in the text of their actual law), but that would not have been known in 1996. Zgodnie z prawem, takiej zgody może udzielić jedynie właściciel majątkowych praw autorskich do zdjęcia i musi to zrobić w formie pisemnej. Jeżeli włąściciel praw nie udzielił takie zgody na swojej stronie domowej, niezbędne jest przesłanie zgody e-mailem zgodnie z instrukcją na stronie COM:OTRS/pl. Udzielanie licencji podczas zamieszczania zdjęcia na Commons jest akceptowane jedynie w przypadku zdjęć zamieszczanych osobiście przez autora posiadającego pełnię praw autorskich do zdjęcia i pod warunkiem, że zdjęcie nie było nigdy nigdzie wcześniej publikowane. These both seem to have been deleted in error. It's best practice to upload a lossless copy of an edited work, indeed, Commons:File types#PNG directly instructs people to, and Commons:Deletion_policy#Duplicates says that such lossless copies should not be deleted as duplicates.

As for the other, keeping the original, unedited copy of a restored file is also not only best practice, but deleting it is very bad practice. Why would we have {{Original}} if not? And how is an unedited original an exact copy? Adam Cuerden (talk) 03:28, 11 October 2019 (UTC)

Note, that authorship cannot be transferred, so claiming to be the author, as you did, is against Wikimedia Commons rules (as providing false information) and illegal in most legal systems.

@EddieMassey: There are three ways to sort this out. In decreasing order of what I'd recommend:

  • You can indicate on a web site (or section of a web site) that is clearly under your control (e.g. if you have a web site as an artist) that this Commons account is under your control and that what is done here is under your authority. Point to that here, and we can reference that in the permissions field of the {{Information}} template (which you should then do on any further uploads).
  • Similarly, instead of authorizing the account, you can indicate the relevant license for any given image. This would let someone upload, but if you plan on doing the uploading yourself would take more work for the same result.
  • You can go through the process laid out at COM:OTRS/COM:CONSENT. This is a solid process, but it will take more time (there is a backlog), will require more work, and will have no advantage over the other two approaches. - Jmabel ! talk 21:48, 12 October 2019 (UTC)

Duplicate uploads by User:Uros N

Photographer Uroš Novina (Uros N) was attracted by the Wiki Loves Monuments competition and uploaded his work to participate. Unfortunately, some of his freely licensed photos were already uploaded from FlickR a long time ago, so the new uploads were deleted as duplicates. I wish to have them restored so that they may be included in the competition, and the old versions deleted instead - the speedy deletion criteria allow such an exception (Commons:Criteria for speedy deletion#F8: "The generally accepted rule is to delete the newer duplicate, but that may not always be the case, such as when comparing between a user uploaded file, and a bot uploaded file"). Additionally, the new files are much smaller with the same resolution, which makes them easier to use.

Unfortunately, I can't access the list of his deleted contributions, but here's one example:

 Info I am not sure what the smaller size means here: but if this means higher lossy compression, then the smaller images should not be undeleted. This is a photo in my posession taken by my father of his mother, the artist Lallah Perry. He took this in the early 1970s. I uploaded the picture to the wikipedia page. I would assume that I have copyright to a photo taken by my father of his mother, and given to me by him. There aren't a lot of publicly available photos of my grandmother Lallah Perry, and she is becoming a more widely known artist in her home state. How would I claim the copyright to a photo that is physically in my possession? Thanks. This has become a significant headache and I assure you that my intentions are good. I am just trying to get a photo of her into the public so that it can be added to her wikipedia page. It hasn't been published anywhere else.

  • Unfortunately, your undeletion rationale is going to need to be more specific to the file rather than generic for over 75 images. As you already know, none of these were listed with the correct license. What complicates this is that a portion of these files have no valid source and author, some are watermarked, some are low quality and you can find a higher quality if you get it from the right source, some have other copyright concerns (not works of Brazil Gov.), I see at least two or three that look to have been mixed in with this request that are irrelevant. If I spoke Portuguese or was from Brazil, I would just read the file names, find the highest quality resolution from Brazil Government with a legitimate source, and re-upload because this is a mess and that'd honestly take less time. ~riley (talk) 23:40, 14 October 2019 (UTC)

@Skjoldbro: You have used {{PD-author}} claiming that the PD status was granted by the author, who is Bauer. The attribution for NAC you used here is irrelevant. We have no evidence that Polish National Archive have copyright to the photo and how can they become the copyright holder. We only know that the photo originates from Wydawnictwo Prasowe Kraków-Warszawa (publishing company) which likely inherited it from some earlier entity, which already disappeared. While it is possible that Bauer had some copyright transfer contract with some older publishing company or that his copyright to the photo was nationalized by Polish government after war, we have no evidence for any of that. Note, that we have even no evidence that its country of origin (country of initial publication) was Poland which is the only case to apply Polish copyright law in Wikimedia Commons. Also note, that if the publication by NAC (in 2016?) was the first publication of the photo, US copyright applies to the photo directly, independently of its copyright status in Poland, and unless we can provide a copyright transfer contract evidence, it belongs to the author (Bauer) and lasts 70 years since his death or 120 years since the photo creation (2065) if the death date of the photographer is not known.  Oppose. @Pontycosta: You initially claimed that you are the author and copyright holder of the photo. Now you claim that it was made by an unknown photographer and published before 1.1.1978 (required by {{PD-Italy}}+{{PD-1996}}) without evidence for this. Personally, I think that this is an artistic photo, where PD-Italy cannot apply, byt another opinion here is welcome.
It is not necessary that a Wikipedia article is illustrated. And photos that are neither freely licensed nor PD cannot be hosted in Wikimedia Commons.

The referred person Jyrki Lappi-Seppälä has given the photograph at my disposal for the intended purpose of the Wikipedia article about him and assures that the copyright of the picture belongs to himself. The reason why the same picture (in uncropped format) is found from https://www.kirkkojakaupunki.fi/-/kirjallisuuden-kaantaminen-on-kuin-soittaisi-nuoteista is because a Finnish publishing company "Into" has used it with Jyrki Lappi-Seppälä's permission as an illustration and as advertising material for autobiography of the referred person. @Jumilase: I see no such option ("I have the right to use") in the fiwiki upload tool (at least in its English version). I see only "This is my own work". If there is mistake in translation it should be fixed. As far as I know, only photos made personally by the uploader are allowed to be uploaded using the crosswiki upload tool. In any other case, the upload wizard in Wikimedia Commons should be used as this requires providing much more information (who is the photo author - photographer, what license was granted by the photographer and how it can be verified - license evidence). Only the photographer is authorized to grant a license in most cases. And permission "to use" is not enough to upload an image to Wikimedia Commons as well as to most Wikipedia language versions. Hi!

I am not an expert. And I am quite new to this wikipedia thing. I wanted to make an article about polish politican Anita Sowińska. I got approved by her and she let me use some photos. All of them were banned. What should and/or can do to unban them? Maybe I should talk to the author of those images and ask them do write me an approval?

I don't know so I would appreciate your answer.

@Invinoveritas123: First, you need free license permission from the photographer, not from the subject. A free license is required here and the photographer is the only person authorized to grant a license. Second, permission from the subject is needed only if the photo is made in private circumstances or if the subject is not a public person. So the question is: where is a free license permission from the photographer and how we can verify it basing on public records? If not public, the actual copyright holder needs to follow COM:OTRS instructions. Otherwise the photo is not suitable for Wikimedia projects. Ankry (talk) 11:05, 17 October 2019 (UTC)

  • Nate vi Britannia, the person who owns the intellectual property for a creative work is normally the person who created it, in this case, the person who took the photo, and not the person who is depicted in it. The normal exception to this, would be cases where the subject of the photo had a contractual agreement with the photographer transferring ownership of the copyright. In order for the image to be suitable for Wikimedia Commons, the owner will need to release the photo under a suitable free license.     To be more pragmatic open: The "Dico De Laurentis Corporation" can't have the copyright on all gorilla pictures on the world.

    • Nobody says that "Dico De Laurentis Corporation" owns copyright "on all gorilla pictures on the world". The clause is on this particular image. And to consider it invalid, we should have (IMO) clear information from the author why it was placed there. Maybe, it is an artistic effect, maybe it is work for hire, or maybe, the artist considered this work just a derivative of some copyrighted work so the clause was preserved. Hello, This image has been deleted, because it can be foung on a website : https://isere.planetekiosque.com/57-848806-5-rencontre-avec-joanne-richoux.html Nevertheless, I'm the owner of the picture, and the one who took it. The person on the image is a french author, and my partner. We took this picture and gave it to an organisation for promotional purpose (book fair) and they used it fot that matter. My team and I are working to create a Wikipedia article about him, when we complete gathering information about him. The Youth Creativity was held in the state where did his one year National Youth Service to his country, to encourage and advise the youths on how to use their skills effectively to effect changes in their localities. He was an active youth during his service year, conducted a lot of community development projects where he created awareness on youth and gender, and he is still an active youth till date, doing things at his capacity. One of the projects he conducted was sponsored by the Vice Chairman, Eket Local Government Area, Akwa Ibom State. To retain fateful event, his picture was uploaded to Wikimedia for further documentations about him. I believe that he is working on things that will make him notable in the future, if he is not yet notable. I see this as a means of encouraging him to aspire for more heights in social change and development.

Furthermore, he is the founder of Initiative for African Citizens (IAC), a nongovernmental organization that advocates for youth participation in governance and decision making process in Africa. This organization is undergoing some documentations in Nigeria where it was founded and registered, but has chapters across Africa, although growing from stage to stage.

@Rkuijk: We cannot accept on-wiki license declaration if the image has ever been published elsewhere. There are two ways to grant a free license in such cases:
  1. the faster one: the copyright holder might declare a free license for this image on their official site, where the image was published, or
  2. the slower one: the authorized representative of the copyright holder may send a written free license declaration following COM:OTRS instructions and using their official email address.
Note: it is not possible to grant a Wikipedia use only license. Wikipedia content is intended for reuse and should be free for any use including commercial reuse and derivative work creation with very few exceptions. Ankry (talk) 10:07, 25 October 2019 (UTC)

Yes, of course. It's mainly a matter of privacy. When I upload a picture on COmmons with its EXIF data I show exactly where and when I took the picture. i.e.: my girlfriend could be suspicious to discover that the picture of the fish represented in this photo was taken at midnight, in the precise location of her best friend's house, right when she was out for her night shift at the hospital.--Prof.lumacorno (talk) 06:52, 23 October 2019 (UTC)
If there are privacy issues, they can be resolved while contacting OTRS. Lack of camera info in EXIF raises some doubts that needs to be addressed. @Miguel Ruy Barbosa: The {{Own}} declaration works only if the image was never published elsewhere. Otherwise, the license must originate from the initial publication site or follow COM:OTRS instructions. Uploading a Facebook published image to Wikimedia Commons as {{Own}} is considered copyright violation unless there is a clear evidence based on public records that both fb & Wikimedia accounts are operated by the same physical person (which is unlikely as all Wikimedia accounts are considered anonymous and attempts to identify their operators are generally forbidden by ToU). This, despite being my image, was deleted as a copyright violation. The image was shot by myself, at the News Impact Summit event in Birmingham, where the subject was a speaker. It was first published on my own site, on the day it was taken. It was subsequently published on the subject’s own site, with my permission - this was cited as evidence of copyright violation in the speedy deletion. I have the original RAW and can provide it as evidence if needed. I have also uploaded other images from the same set, published nowhere else on the web. I would be grateful if this was undeleted. Second, only the author, their heirs, or a person whom the copyright has been transferred in a contract are authorized to grant a license; work ownership is irrelevant here.

@Ankry: Please re-read my original post. I specified that I own the original (including all IP rights related thereto, copyright or otherwise). My point was that, given I own the original, uploading a copy of that original is completely appropriate. The image has not been previously published by anyone other than me and, to my knowledge, no one has disputed my ownership. @Bioupdates: If you own copyright, then we may need evidence for this. COM:OTRS is the right way.
The image was deleted mainly as we cannot accept on-wiki license declarations for already published images due to legal reasons. We need a license that is trackable to the actual copyright holder in such cases, not to an anonymous Wikimedia user (accounts are considered anonymous here). And there is no evidence of free license at Pinterest. Also, if you are not the photographer who made the original photo, claiming {{Own}} authorship is against our rules and illegal. In the case of a copy of original work, there is no copyright and no authorship associated to the copying process. Only the original copyright applies. Have you read what is declared when using Template:Own? A company cannot grant a license itself. A representative has to act on behalf of the company. And we have to verify their authorisation to confirm that the license is valid. License is a legal contract that binds both sides even if its subjest is a single photo. I am in the process of contacting the photographer / copyright holder to talk them through making a permission statement as per https://commons.wikimedia.org/wiki/Commons:Email_templates#Email_message_template_for_release_of_rights_to_a_file after which the picture should be legitimate for use on Wikipedia etc. (I have explained that just saying "yeah it's OK to use it" doesn't satisfy wikimedia/wikipedia's copyright requirements :-))

I am the copyright holder in this case. I uploaded the image myself, as that seemed to be the simplest way to grant permission (I have also CC licensed it on Flickr). Greetings. I am writing to request undeletion of this file, Rolf P. Knierim headshot.jpg as soon as possible. A representative of the copyright holder has now submitted the license using the Wikimedia OTRS release generator, which I hope you can see in the system so that the image can be undeleted. Please see that has been transmitted and then undelete. I'm hoping the file can be returned to the Commons as soon as possible so that it can be used for the relevant Wikipedia page. I was at the copyright holder location with the representative when I uploaded the scan and was given prior agreement that they provide the necessary Creative Commons license.   •  Oppose If a free license has been sent to OTRS, then the file will be restored automatically when and if the email is received, processed, and approved. Note that OTRS, like Commons, is entirely staffed by volunteers, and, also like Commons, is shorthanded, so it may be close to 7 days before the email is processed and the file is restored.
If the message was sent to the English language version of OTRS and the email has been properly received there the sender will receive an automatic reply with the ticket number. If the sender has not had a reply, please check that it was sent correctly and try again. Other language versions may or may not provide the automatic reply.
