Copyright[edit]

Hi, I like the paintings you've been uploading. Unfortunately, I think they're all still under copyright. In Indonesia copyright lasts 50 years after the painter dies, it will belong to the artist's estate (whoever they left it to in their will, or their relatives if they didn't make one). The person or museum that owns the painting doesn't have the copyright, it's completely separate. You have been putting your own permission on the images, but you need to get permission from the artist (if alive) or their estateand post it to the OTRS system. --Simonxag 02:03, 28 October 2007 (UTC)[reply]

Please do not make any further uploads until you have read and understood Commons:Licensing. The deleted images all had permission statements such as "I hereby grant permission for all pictures in the website of www.museumrudana.com to be used publicly for any purposes related to any wiki projects including Wikimedia Commons." (Emphasis mine.)
This permission does not make any mention of the GNU Free Documentation License, as you had claimed. Instead, the permission only explicitly grants permission for the images to be used in a limited context, which is contradictory to the GFDL. According to Commons:Licensing, all images uploaded to Commons must be free for anyone to use in any context. Images with more restrictive permissions than this may be speedily deleted per {{Permission}}, as you have seen.
Another problem with several of your uploads is that they depict or contain copyrighted paintings as a primary subject. Owning a museum which owns a copy of a work (even if it is the original and only copy) is not equivalent to owning the copyright to a work. Only the artist or the legal heirs may issue a licence for such works, so for most of your uploads, any permission issued by the museum or their owner is null and void. The following images did contain a permission to publish the works under the GNU Free Documentation License, but were deleted because the licence was void. Since Nyoman Rudana, who issued the permission statement, appeared in Image:Praying.jpg, Image:KSA2-Syiwa.jpg, Image:Earthquake-Yogya.JPG, Image:IPU2007.jpg, Image:Rudana& Sons1.jpg, Image:Indian Exhib.jpg, Image:Ubud Festival.jpg, Image:China Delegates.jpg, Image:Carter at RAM.jpg, Image:Rudana&Daughters.jpg, Image:Jiang Zemin at RAM.jpg, Image:Upakarti Award.jpg, Image:Blanco.jpg, Image:Soeharto signed.jpg, Image:Cornerstone-1.jpg, Image:Rudana&Wife.jpg, Image:RUDANA-1.jpg, and Image:Book Launching.jpg he clearly did not create those photographs, and he can therefore not issue a licence for them. Only the photographers or the photographers' legal heirs could do that. Additionally, he appeared in Image:Srihadii&Borobudur.jpg and Image:Rudana&Srihadi.jpg, which also prominently featured paintings which he did not create and for which he therefore cannot issue a licence. Other than paintings, all other pictures are from Nyoman Rudana collections and they are allowed to be posted in any wiki projects. Please give example of the letter we should address to wikimedia commons, because we would like to post them again. We accept your reasons for the paintings' copyright, but the rests are Nyoman Rudana's and he has the right to allow it posted in any wiki projects and they should not be deleted. We don't wanna break the lwa but we want to upload the pictures as follows :

Again, permission to "post in any wiki project" is not sufficient. Please read Commons:Licensing. Sample permission letters can be found at Commons:Email templates, but do note that only the legitimate copyright holder of a work may issue a licence for it and that appearing in an image or having collected an image does not mean one holds the copyright to it, as explained above. Please do not upload the images again. If you feel that any images were incorrectly deleted or you obtain a permission which you believe changes the situation, please request undeletion at Commons:Undeletion requests and the situation will be reviewed by an administrator. OK, thank you and we will send the undeletion request right away. Can we use GFDL self for the file owns by Rudana's, as most of the old files ( the 19990s pics )scanned from photo albums and the rest I got from him in a CD. We only tried to provide as many informations as possible but we just don't p[articularly aware of what we should or should not write regarding licensing. Some pictures with Rudana on them were taken using his own camera, taken by his son, family members or other persons or staffs, so basically he's the one who can issue the license because he owns the pics and he's the subject in the pics. No, one cannot licence the works of one's family members if they are still alive. One does not become the copyright holder of an image by appearing in it. One does not become the copyright holder of an image by owning the camera with which it was taken. One does not become the copyright holder of an image by forgetting who actually created it.
