Happy to discuss any aspect of the deletion request as it does not have merit under the copy-write provisions of Wikipedia unless I have misunderstood the rules. These particular photos are free for use by anyone who would like to use them, they have been supplied for use by Brindabella and they were subsequently used in several promotions in the past two years. Firstly in general College material, then in MBA Awards material, then in LEA Awards material, then in Brindabella Architectural contractor marketing material and also Bus advertising material through Go Transit. So the deletions should not occur. This also goes for File:BCC Junior School Wing-2.jpg & File:BCC Junior School Wing-3.jpg

That may all be true, none of that is close to sufficient for a free license. Commons:Licensing is the policy. The actual owner of the original has to asssert that they permanently release the image for essentially any use by anyone. A free license that includes redistribution, modification, and commerercial use, without any ability to control who uses it how, is very different from hosting an image and using it themselves in a way that others can see it. Wikimedia Commons does not accept fair use content.

We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules.

In addition, fair use is not compatible with our aim as a collection of freely distributable media files.

Therefore, Commons cannot legally rely on fair use provisions.

Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

The undelete process allows for "You may want to discuss with the administrator who deleted the file. You can ask the administrator for a detailed explanation or show evidence to support undeletion". I now ask you provide detailed explanation of why you are deleting File:BCC Gravity-40 years given I own the raw content and created the image and freely allow its use in Wikipedia?

Hi Patrick,

We are "we"? The copyright is most often hold by a single person, the photographer. Since your declarations about ownership have been contradictory so far (you claimed "having created and owning the original" AND that images "have been supplied for use by Brindabella") I beg you to have the photographer(s) sending quickly a permission via COM:OTRS and, in the meantime, stop uploading until the case is solved. To explain we, I am the Board Chair and shareholder of the organisation that owns the images and they were done for me, that is the we, I will happily have the "actual" photographer deal with the release on COM:OTRS but it will be tomorrow as we are at 9.00pm here. All good as there is no intentional contradictions.

PS The "create" refers to any edits to the images of which there are some and in the case of the disputed Photoshop image it is "me" in photoshop which is why the "I", and the component images are then the we, but we as the company own the component images as well. Hope that makes sense.
