Fair Use files[edit]

Hi Hl. Your question at File talk:Cinema of Unease-poster.gif will soon be deleted as an orphaned file talk page, but I will answer you here. In short, Wikipedia is an encyclopedia and although it strives to contain only free content, in certain circumstances the potential educational merit of an image can be deemed great enough to warrant the inclusion of non-free files under a Fair use claim. These circumstances are substantially narrower than the legal definition of fair use, and can be found at en:WP:Non-free content criteria. This project is Wikimedia Commons, and while related to the various Wikipedias (we store their free media content amongst other things), we are a distinct project and have a very clear licensing policy, and do not allow non-free media under any circumstances (see COM:Fair use). We only accept media that are free to use by anybody for any purpose. If you have any other questions, you can ask me on my talk page or on the Village pump. You recently filed a DR concerning other Auckland Museum images, where you or the Museum had concerns about copyright or licensing issues, A review of Category:Images from Auckland Museum marked with cultural permissions and Category:Images from Auckland Museum marked as copyright undetermined related categories would also be advised. Hi @ShakespeareFan00; thanks for the note. I'm in the process of reviewing the files in both those categories, but it may take me a bit of time. Primarily I have yet to determine if those images still have that status in our system, or if they have been openly licensed since the upload run.
