Hi, Jacklee, thanks for the heads up. I'm afraid dealing with image licensing is not my strong suit (I'm more a Wikipedia editor than an image-use expert), so I'm a little confused. The Flickr description page linked to states that the license is Attribution ShareAlike; what more needs to be done to prevent the file being deleted from Commons? There are two copyrights involved here: the copyright in the painting (which is a "derivative work" in the photograph), and the copyright of the photograph itself. There is no problem with the copyright in the photograph which you obtained from Flickr as that is licensed under an acceptable Attribution ShareAlike licence. However, it is a photograph of a copyrighted painting, so the permission of the copyright owner of the painting (presumably the artist) must also be obtained before the photograph can be uploaded to the Commons. If this were not the case, then copyrights could be easily defeated simply by people going around photographing copyrighted works, and licensing the photographs freely. — Cheers, JackLee talk 13:12, 5 October 2015 (UTC)[reply]
Oh, I see. I had thought that so long as the photo was taken in such a way that it couldn't replace the artwork (for example, as here, where the painting is only visible from an oblique angle) that was enough to make it considered not to infringe. Apparently I was misinformed on that score.
I've actually been working with another user, Arttalk1984, who created the Nahem Shoa article as a draft but needed help getting it to conform to Wikipedia standards. They have now taken some other photographs of Shoa's work for use in that article, including File:Nahem Shoa next to his Giant Portrait of Ben, Hartlepool Art Gallery.jpg which as you can see includes the artist himself posing beside one of his paintings. So I think there's a good chance it will be possible to obtain Shoa's permission for Arttalk1984's photos to be used at Commons and on Wikipedia. Could you walk us through exactly what Shoa would have to do, Jacklee? I don't want to steer Arttalk1984 wrong again. Thanks, GrammarFascist (talk) 13:31, 5 October 2015 (UTC)[reply]
The detailed steps are at "Commons:OTRS". Essentially, you need to have the copyright owner (the artist, in this case) send an e-mail from an official e-mail address identifying the photographs uploaded by their filenames and stating that he consents to licensing the depictions of his artworks in the photographs under one of the free licences accepted by the Commons, such as {{Cc-zero}}, {{Cc-by-4.0}} or {{Cc-by-sa-4.0}}. (There is a template of such an e-mail on the page mentioned above.) This e-mail should be sent personally by the artist, or forwarded by you or Arttalk1984, to permissions-commons@wikimedia.org for verification. Each uploaded file should also be tagged with {{OTRS pending}} in the |permission= field of its {{Information}} table. — Cheers, JackLee talk 14:22, 5 October 2015 (UTC)[reply]
Thanks so much for explaining things so clearly. I have added the {{OTRS pending}} to the images currently on Commons, and Arttalk1984 is contacting the artist. Note that when you are inserting the template, you should leave out the "tl|" part. That is only used for referring to the template name in discussions (try removing it from one of the occurrences here and clicking "Show preview" to see what happens!). The file probably has been deleted. If you sent a permission, try to send it again after 14 days. Do not re-upload. When the VRT-member processes your mail, the file can be undeleted. Additionally you can request undeletion here, providing a link to the File-page on Commons where it was uploaded ([[:File:Main EHT pic.jpg]]) and the above demanded information in your request.
