今年の3月9日に東京都立中央図書館サービス部情報サービス課長さんからメールが届きました。（メールを全然見ていなかったので本日気づきました。大変申し訳ありません。）その内容は下記のとおりです。

"以前、ご要望いただいた件について、遅くなりましたが、改めて回答いたします。

このたび、TOKYOアーカイブの使用条件を緩和し、法令、条例、公序良俗に反しないものであれば、自由にお使いいただけるようにしました。ただし、画像の使用にあたって行っていただいている申込みそのものをなくすためには、システムの大規模な改修が必要となります。このため、費用対効果の観点から、申込みにつきましては、当面はこれまでどおりとなります。なお、TOKYOアーカイブには、著作権者がおり（著作権者は当館以外の第三者）、著作権保護期間中のものがあることも申し添えます。

回答に非常に時間がかかりましたこと、大変申し訳ございませんでした。

今後とも当館をご利用ください。どうぞよろしくお願いします。"

@Y.haruo: コメントありがとうございます。昨年にサイトを見たときは状況が何も変わっていなかったため、この要望はスルーされたものかと思っていましたが、ちゃんと準備が進められていたようで安心しました。画像使用条件のページを見ました。使用目的や複製・加工を制限する旨の文が削除されており、法律との矛盾は大方解消されたんじゃないでしょうか。時間は掛かりましたが、こうして成果が出たのは良かったと思います。 Darklanlan (talk) 12:18, 25 March 2019 (UTC)[reply]

File:居神神社の歴史案内板.jpg についてですが、こちらに意見を記述いたします。公共機関の掲示物に関して著作権を持ち出すのはどうにも納得ができないのですが。仮に「私がこの内容を書いた」と記したらWikipedia以前に法的に著作権侵害であることは分かりますが、万人に知らしめるために設置してある看板・掲示板にこれを当てはめるのは筋が違うのではないでしょうか？　何の為の掲示板で、何の為のWikipediaなのか？という疑問にブチ当たります。例えばスキー板の画像を投稿する際にROSSIGNOLというロゴがあったら問題でしょうか？いちいち許可が必要でしょうか？　山口百恵のプレイバック　https://ja.wikipedia.org/wiki/%E3%83%97%E3%83%AC%E3%82%A4%E3%83%90%E3%83%83%E3%82%AFPart2 のような気がしてなりません。

@Kaztima109: 初めまして、Darklanlanと申します。色々と納得されていない点があるとお見受けしますので、論点を整理してお答えします。

スキー板の画像を投稿する際にROSSIGNOLというロゴがあったら問題でしょうか？

単純な文字と図形で構成されたロゴであれば、商標法の制限はありますが著作権の保護対象ではないため、削除の対象にはなりません（{{PD-textlogo}}）。また、著作権の保護対象であってもそれが写真に映り込んだ些細なものごと、いわゆるデ・ミニミスなら削除されることはないでしょう。

公共機関の掲示物

あなたの会話ページでもお話ししたとおり、その写真の対象物は著作権法第13条で規定される「著作権の保護対象外」ではありません。ウィキメディア・コモンズにアップロードされた画像はウィキペディアの記事で使用するのみならず、誰かがそれを自由に改変・再利用・販売することを許可します。逆に言えば、改変・再利用・販売に制限がある画像はコモンズで受け入れることができません。

万人に知らしめるために設置してある看板・掲示板

著作権法第46条（公共の場に設置された美術の著作物）に該当する場合は日本語版ウィキペディアのw:ja:Wikipedia:屋外美術を被写体とする写真の利用方針に従ってこちらのページからアップロードできます。しかし、このような画像は商用利用が認められていないため、コモンズでは「自由利用できない画像」として削除の対象になります。なお、あなたがアップロードなさった写真にある作品は美術の著作物ではなく言語の著作物であるため、その著作権が失効していることが明らかでなければ日本語版ウィキペディアであっても削除の対象です。関連する議論はCommons:井戸端/過去ログ5#屋外の看板（説明板）の画像は受け入れられるか？にありますので参考になさって下さい。

何の為のWikipediaなのか？

著作権者が訴訟する・しないに関わらず、著作権法に違反している可能性があるコンテンツは削除されます。これはCommons:プロジェクト基準/予防原則での方針に基づくものです。この方針に反論がございましたらen:Commons:Village pumpにて議論を提議して下さい。

ゲームマーケットの看板の画像につきまして[edit]

はじめまして。2017/2/7にDarklanlanさんがmissing permissionタグを貼りましたFile:Gamemarket_2014_autumn.jpgとFile:Gamemarket-2015-autumn.jpgの2枚の画像ですが、今日user:JuTaさんによって削除されました。しかし、画像の説明に「主催者がコモンズとして使用できると宣言している」と書いてありましたので、私は念のため、2017年2月10日に、このイベントの主催者http://www.gamemarket.jp/へ連絡を取りました。「画像内のキャラクターは自由な使用が可能である」「ウェブサイトへのライセンス表記は今後取り組んでいく」という返答で、permissions-ja@wikimedia.orgへ連絡を取ったということでした。したがって、条件が整えば、削除された画像が復帰できることをお伝えします。よろしくお願いします。--Focus35mm (talk) 12:28, 15 February 2017 (UTC)[reply]

ご連絡ありがとうございます。コモンズにホストする画像は商用利用・再配布・改変を認めることになり、逆にこれらが許可されていることが不明な画像は受け入れることができません。この許可を示す具体的な手順はCommons:OTRS/jaをご覧下さい。既に先方がOTRSと手続きを取っていると言うことであれば、管理者でもOTRSメンバーでもない私にできることは見守ることだけです。 Darklanlan (talk) 12:49, 15 February 2017 (UTC)[reply]

Commons:Copyright rules by territory/Japan[edit]

I have just marked up the English-language of this page for translation to Japanese. The former Japanese version still available here.

What I usually try to do, but have only partly done here, is:

Convert tables to text wherever possible
Replace <ref> links to sections in the laws by simpler {{Sref}} references to the sections.
Replace all instream urls by citations, and move the citation details to the back of the page.
Cut out the citations from the translation units, as </translate><ref name=ThisSite/><translate>

The idea is to get as much mark-up as possible out of the main part of the English-language version, and to reduce mark-up in the translation units to the minimum. Translators tend to dislike all wiki mark-up.

Do you have any views on the best approach to getting the two versions English and Japanese, back into step? It can only be done by someone fluent in both languages. I hope that the former Japanese version will still be useful. Aymatth2 (talk) 00:05, 23 March 2019 (UTC)[reply]

@Aymatth2: Wikimedia Commons shall follow the copyright laws of United States and the source country, but most Japanese users don't understand US laws. Especially, the URAA restoration make it complex. I've localized many documents. I know translate extension is convenience, but markup text disturb translators to localize script with it. General users don't know our trouble. At that time, I made tables even if it disturbed localization. Now, I'm not sure which I give priority and how I handle it. I can't find out any approach yet. By far the most important languages here, I think, are Japanese and English. The simplest approach may be to

Keep the four remaining tables in the English version,
Reduce each table to a single translation unit,
Copy the versions of the tables from the former version into the current Japanese version
Add any missing text in Japanese.

If anyone wants to translate into other languages, they will have to preserve the table mark-up. I can do the first steps, if you agree... Aymatth2 (talk) 12:56, 25 March 2019 (UTC)[reply]

著作権法改正に伴う記載の変更作業、お疲れ様です。しかしながら、現在のテンプレートには過去版に記載されていた「没後50年」や「発行後50年」の表記が有りません。この表記ですといつ日本でパブリックドメインになったのかが不明であり、アメリカでのURAAになぜ合致するのかが不明となってしまいます。例えば、Statue of Saigo Takamori in Kagoshima、Asahi Shimbun, June 2, 1942などをご覧ください。Template:PD-Japan並びにTemplate:PD-Japan-organizationにおいて、「没後50年」や「発行後50年」の改正前の法の記載が日本語表記及び英語表記に必要ではないでしょうか。例えば日本語版ウィキソースではこの様な記載をしています。--Y.haruo (talk) 07:46, 4 June 2019 (UTC)[reply]

このタグ単体ではURAAの著作権の回復には関与しませんので、つまり、今のテキストに以前の著作権法での著作権保護期間の説明を加えれば解決する問題かと思います。私は今英語版ウィキペディアの拡充と私用に手を焼いていて、こちらについては優先度が低く、更新を考えるのは先のことになりそうです。もともとこの文面は緊急で考えたもので、完成したとは思っていません。良い案があればそれで書き換えてもらって問題ありません。 Darklanlan (talk) 12:59, 6 June 2019 (UTC)[reply]
