Wikimedia Commons does not accept fair use content.

We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules.

In addition, fair use is not compatible with our aim as a collection of freely distributable media files.

Therefore, Commons cannot legally rely on fair use provisions.

Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Picture of the Year voting round 1 open[edit]

Dear Wikimedians,

Wikimedia Commons is happy to announce that the 2012 Picture of the Year competition is now open. We're interested in your opinion as to which images qualify to be the Picture of the Year for 2012. Voting is open to established Wikimedia users who meet the following criteria:

  1. Users must have an account, at any Wikimedia project, which was registered before Tue, 01 Jan 2013 00:00:00 +0000 [UTC].
  2. This user account must have more than 75 edits on any single Wikimedia project before Tue, 01 Jan 2013 00:00:00 +0000 [UTC]. Please check your account eligibility at the POTY 2012 Contest Eligibility tool.

Hundreds of images that have been rated Featured Pictures by the international Wikimedia Commons community in the past year are all entered in this competition. That there are no concerns is not the issue. There is only a limited set of criteria for speedy deletion of images, and things that do not meet the criteria must progress via a normal process. I have undone your edits at File:Holland Roden, Comic-con.jpg. There clearly should be an evidence base to a rename, and for making description changes. Please take a look at the source of the picture/Flickr. At Flickr the picture is tagged with "Paley Center" and part of the Flickr-set "OnStage @ Paley: MTV's Teen Wolf". Paley Center/PaleyFest is not the same like Comic-Con. I don't see any reason, why there should stand "Comic-Con" either in the description nor in the file-name. The uploader gave the picture an incorrect description, that's all. So what I should discuss with the uploader!?--CennoxX (talk) 22:53, 15 August 2013 (UTC)[reply]
I am not saying that I will not do a rename, I am just saying that there needs to be an evidence-base to support a rename in cases like this. Otherwise we have a case of "he said vs. he said". So generally I ask for that and part of that can be the courtesy of a discussion with the uploader, as you would probably like if someone request a rename of one of your uploads. In this situation where you have what you see as a strong evidence base, then add that detail to the talk page of the image, and then reference the talk page in the rename request.  — billinghurst sDrewth 15:03, 18 August 2013 (UTC)[reply]

Mate, assume good faith is a practice that I do and very widely, and communicating openly and honestly is another.

You are requesting the rename of an image uploaded by someone else, and it is reasonable that you clearly provide the evidence and the discussion that goes with it. Where an image is used at the Wikipedias, it needs to be supported by a citable source. So if someone is to use and quote the image, the evidence-base needs to be there, not based on someone's opinion. Good practice says document a significant change and provide evidence, and that is all that I am asking of you. Many pictures from this user are from the historical collection of Marie Stravlo, so maybe he has a permission for those pictures. I marked them, that they need permission. I protest, the image is not a violation of law as the photographer himself agreed and therefore permission to publish the photo as long as it is mentioned in the legend, and this is what was done.

Wikimedia Commons is happy to announce that the second round of the 2013 Picture of the Year competition is now open. This year will be the eighth edition of the annual Wikimedia Commons photo competition, which recognizes exceptional contributions by users on Wikimedia Commons. Wikimedia users are invited to vote for their favorite images featured on Commons during the last year (2013) to produce a single Picture of the Year.

Hundreds of images that have been rated Featured Pictures by the international Wikimedia Commons community in the past year were entered in this competition. These images include professional animal and plant shots, breathtaking panoramas and skylines, restorations of historical images, photographs portraying the world's best architecture, impressive human portraits, and so much more.

The 2013 Picture of the Year competition has ended and we are pleased to announce the results: We shattered participation records this year — more people voted in Picture of the Year 2013 than ever before. In both rounds, 4070 different people voted for their favorite images. Additionally, there were more image candidates (featured pictures) in the contest than ever before (962 images total).

  • In the first round, 2852 people voted for all 962 files
  • In the second round, 2919 people voted for the 50 finalists (the top 30 overall and top 2 in each category)

We congratulate the winners of the contest and thank them for creating these beautiful images and sharing them as freely licensed content:

  1. 157 people voted for the winner, an image of a lightbulb with the tungsten filament smoking and burning.
