Frank Fox[edit]

Hi D-Kuru,

I'm the uploader of the series Italy by Frank Fox and I would like to ask you some information about that series of pictures because I'm really puzzled about their copyright status.

- The author of the pictures is not Frank Fox that is just the author of the text of the book "Italy". The pictures were commissioned by the editor to many artist (some of them signed the picture as you can see even in the deleted files) in order to illustrate the book. Because in the book is not specified the authors of the pictures and the pictures are not reproduction of paintings but just book illustrations, who is, in this case, the owner of the copyright? The painter, the publisher, the editor?

- The book Italy by Frank Fox from were I have extracted the pictures was tagged in archive.org as Not-in-Copyright and, according to the answer to my post in Commons talk:Licensing, thy are PD in USA but may be not in other country as UK. On the other hand, as far as I understood working on Commons, the policy of copyright Commons is following is the american one so, at least in USA, they are in PD (because published before 1923) so why to delete them instead tagging them as PD in USA but not in other countries as discussed in this post ( http://commons.wikimedia.org/wiki/Commons_talk:Licensing#PD-Egypt )?

I'm asking you all of that not because I want to criticize your decision (I'm just a white belt in Commons and you are a black one) but because I would like to improve the quality of my work on Commons and to understand properly all those copyright and public domain issues in order to contribute effectively to the project without disturbing users and administrators in discussing and deleting my misappropriate uploading. For example, the discussion about costumes as derivative works or not, really puzzled me about what is a copyviol and what is not (http://commons.wikimedia.org/wiki/Commons:Deletion_requests/Images_of_costumes_tagged_as_copyvios_by_AnimeFan ).

There is not really a black or white belt here on Commons. I have to ask other admins as well as you have to aks me if I don't understand some of teir actions (even they should be clear if they follow the guidelines). The truth is that a guideline can permit two possibilities which are not compatible (Such as to keep or to delete cosplay images).
However, the lastes guideline section about that topic I know is that files have to be PD in the country of their origin and in the USA. I would say that the copyright owner is still the painter. But, if the author dies, the time until they are PD sometimes start when they get published the first time. I don't know that book so I don't know if the authors were mentioned or not (I already noticed that there is the possibility to have a look at the whole book). If there is a signature there is the possibility that the author is not unknown and should may be added. If you don't know the author it's not a good idea to upload an image with {{PD-old}}, because the template says "[...] with a copyright term of life of the author plus 70 years" and if you don't know when the author lived or died you can't start to count 70 years (It's fine if the image was created round about 150 years ago and fewer, because it would be unlikely that the ciopyright is not expired. I hate the What If sentences, but: The book was published in 1918 so some authors may died later than 1939 so that their images are not in the Public Domain for know). I would reccomend {{Anonymous-EU}} in such cases.
Another reason why your file got deleted is because that there was too less information so that the copyright status is clear. So "Italy by Frank Fox http://www.archive.org/details/italyfrankfox00foxf" is not the best source information you can give. A better one would be "own work by an unknown author who's work was published in Frank Fox's book "[http://www.archive.org/details/italyfrankfox00foxf Italy]" which was published in 1918 ([http://www.archive.org/download/italyfrankfox00foxf/italyfrankfox00foxf.pdf See book in pdf format])" (I used <nowiki> so that you can coppy the text if you want). A principle on Commons is usually that you should give as much information as you can, but there is no need to write whole stories (for example "|Source= This mediafile/image is entirely my own work. It was created/taken and published by myself, whatevername, born in whatevertown on whateverdate and freely licenced under whateverlicence and published on whateverdate.")).
The book was published more than 70 years ago so that shouldn't be a problem and even there is a signature it's not very good to see and another question is if the author would become unanonymous/known. Another part of the information is the filename: "Italy by Frank Fox (61)" is maybe not the best one if you want to point out that this image is not made by Frank Fox. A better filename would be a SHORT description what you see. For example: Italy by Frank Fox (61).jpeg could be reuploaded as "Palatine chapel in Palermo-inside" or "Inside the Palatine chapel in Palermo, Italy" (Possible but I wouldn't recommend it: "Palatine chapel in Palermo by unknown author published in the book Italy by Frank Fox"; I wouldn't recommend it, because a)you have to (or rather should) rename the file if the author gets added because someone knows him/her b) It would be already mentioned in the images' source c) it's not really a short description)
Tell me if you want to have the files undeleted (because you don't have the files any longer; because you want to have them so that you can copy the categories etc.; because of another reason) or if you want to reupload them under a different filename. Hopefully the length of my contribution was not frightening to you and hopefully all your questions were answered. Contact me if you need some more help.

I'm truly grateful to you for your impeccable, complete and precise explanation. I have followed your suggestion and I have changed the license as you suggested. And, watching carefully at the pictures, I have found 2 copyviol (I suppose) because the author died on 1943 so his works are not in public domain. I have tagged them as copyviol [1] [2] but better if you give a glance at them (even the others I have corrected). Hironically the 3 already deleted are anonymous. Can you restore them please? I will correct the description as I did with the others.

I'm really sorry to have bothered you with my silly doubts but in order to learn I really need to understand otherwise I cannot spread the message of this, our, project to others. Believe me, it wasn't my intention to infringe the copyright and to violate the rights of the authors even if, as you I guess, I hope that this strict global policy on copyright, one day, will be changed for a more free one. It's pretty hard to bother me even with long discussions if it seems to me that you want to learn and do your best for new uploads. So you didn't manage it at all to bother me ;-)
I have undeleted the three images you listed images. You don't need to copy the whole URL if you want to give a link to an image. You can do it with [[:File:Italy by Frank Fox (1).jpeg]] for files, [[Pagename]] for ordinary pages, [[Template:GFDL]] for a template and [[:Category:GFDL]] for categories. I use {{fl|imagename without the "file" at the beginning}} because I hate to correct the ":" if I have forgotten to include it. I deleted the images you tagged with {{Copyvio}}. If I remember in 2013 I will undelete them (or ask for undeletion if I'm no admin at this time any more). Even I'm fine with the current filenames I would suggest to rename them. Kved reason for deletion was "copyright violation author Frank Fox 1874-1960" so he thought that Mr. Fox was the author of this image. If you don't rename them it's OK as well, because now the source includes the information that not Frank Fox is the original author.

Gamer theatrical poster[edit]

Greetings from Spain

I don't understand why you have deleted the movie poster pic. I'm writing the film article in spanish, and I found the picture in the english version of wikipedia. If it's valid there, why not here? Because I tried to find an appropiate license when I uploaded it (I realize that it's a copyrighted image), and I did not find any similar.

So, what can I do? The "files licenses help" of commons doesn't help too much... or I'm very clumsy to find anything.

1) Signatures: Please sign all your contributions on talk pages with "--~~~~"
2) Movie poster: en:File:Gamermovie.jpg is a fair use image which is not allowed on Commons (see Commons:Fair use for more information). Only freely licenced images and images which are in the Public Domain are allowed on Commons. I don't know if fair use use images are allowed on the spanish Wikipedia but if it is allowed you can upload it to the spanish Wikipedia.

Meta request[edit]

Hello D-Kuru. Regarding your request at m:Talk:Spam blacklist. The only way to circunvent the global blacklist is by adding the domain on MediaWiki:Spam-whitelist. Once added on it, the link will be avalaible for adding on commons even for non-sysops. At this moment I do not think that those link should be removed, however I have asked Mike to comment too. I thought about adding the link to the whitelist until I saved both pages because I don't think that anybody would really write something on that page anyway (so saving that the page is not really an issue). If there would be more usages it could be added to the whitelist. I don't know enough about how the blacklist works but maybe it wouldn't work anyway because if the webpage is on the blacklist it may get removed by a bot
