Datenhaltung im Lichte der Datenschutzgrundverordnung

Der Beitrag analysiert die Nutzerdatenhaltung von OpenStreetMap mit Blick auf die Vorgaben der Datenschutzgrundverordnung (DSGVO) und den sich daraus für das OpenStreetMap-Projekt ergebenden Anpassungsbedarf.

Am 25. Mai 2018 wird die Datenschutzgrundverordnung (DSGVO, Verordnung des Europäischen Parlaments und des Rates zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten, zum freien Datenverkehr und zur Aufhebung der Richtlinie 95/46/EG) die bisherigen Regelungen im Bundesdatenschutzgesetz (BDSG) ablösen. Damit gilt ab diesem Zeitpunkt in allen Mitgliedsstaaten der Europäischen Union das gleiche unmittelbar anzuwendende Datenschutzrecht. Die DSGVO lehnt sich in ihren Regelungen stark an das bisherige BDSG an. Damit sind die datenschutzrechtlich hohen Anforderungen künftig kein spezifisch deutscher Aspekt mehr, sondern ein unionseuropäischer. Entsprechend mehr Beitragende (Contributors) und Nutzer von OpenStreetMap unterfallen dem Anwendungsbereich. Der Beitrag analysiert die Nutzerdatenhaltung von OpenStreetMap mit Blick auf die DSGVO und den sich daraus ergebenden Anpassungsbedarf für das OpenStreetMap-Projekt.
