Copyright of Design vs Copyright of Image

There's an inherent problem with this template in that it assumes that all images of traffic control devices included in the MUTCD are automatically in the public domain.

This is incorrect, since a rendition or image of a traffic control device can indeed be copyrighted by its creator. This copyright does not extend to all images of that particular sign or device, or to the design of the device itself, but does cover that particular created image.

The use of this template could lead to unintentional or intentional copyright violations, as a user could discover an traffic control device image not created by them, add it to the Commons, and apply this template; however, the particular image in question could be covered by copyright and thereby be in violation.—the preceding unsigned comment was added by RCMoeur (talk • contribs)
