A file that you have uploaded to Wikimedia Commons, File:Henriette gschwind 002.jpg, is a derivative work, containing an "image within an image". Examples of such works would include a photograph of a sculpture, a scan of a magazine cover, or a map that has been altered from the original. In each of these cases, the rights of the creator of the original must be considered, as well as those of the creator of the derivative work.

While the description page states who made this derivative work, it currently doesn't specify who created the original work, so the overall copyright status is unclear. If you did not create the original work depicted in this image, you will need to specify the owner of the copyright.

Please edit the file description and add the missing information, or the file may be deleted. If you created the original content yourself, enter this information as the source. If someone else created the content, the source should be the address to the web page where you found it, the name and ISBN of the book you scanned it from, or similar. You should also name the author, provide verifiable information to show that the content is in the public domain or has been published under a free license by its author, and add an appropriate template identifying the public domain or licensing status, if you have not already done so. Please add the required information for this and other files you have uploaded before adding more files. If you need assistance, please ask at the help desk. Thank you!

Hi, the image cannot be from 2022. Who is the original photographer? What is your source? --Túrelio (talk) 11:43, 23 December 2022 (UTC)[reply]

Hi, it's a picture from my family album made by myself. So, I am the original photographer and the source is my family album. Cordially, Tontonflingueur (talk) 11:49, 23 December 2022 (UTC)[reply]
Well, not really. A true reproduction of a 2-dimensional work does not create an own copyright. The copyright is with the original photographer. --Túrelio (talk) 11:51, 23 December 2022 (UTC)[reply]
Hi, I do not understand what you mean or want. I have several family albums and I scan the pictures, somtimes with a HP scanner or with my iPhone, etc. This woman from my family died in 1966 in Paris, France. I use several softs : Paintshop, Photoshop, etc... The purpose is for genealogy and I use entitree.com, Cordially, Tontonflingueur (talk) 12:00, 23 December 2022 (UTC)[reply]
Hi, the underlying work IS NOT copyright protected. What do you need ? My original family album ? A letter from the photographer (from my family) who died a long, long time ago ? The picture is for genealogy purpose. You may check my family tree (you'll find some professional photographers) at : entitree.com and check my ancestor Lorentz Ehrer (1663-1751) a draper, then click on the arrows and you may see a big part of my family tree. entitree is free and based on Wikidata. Cordially, Tontonflingueur (talk) 12:39, 23 December 2022 (UTC)[reply]
Please see my first comment: the image needs to be dated properly. The true author (and potential copyright-holder) needs to be mentioned. The source-entry needs to be corrected from "own work" to "family album". All that is required for encyclopedic reasons as well as for the evaluation of the copyright-state.
While you may upload the image only for your own "genealogy purpose", the free license which you claim for the image makes it freely usable for everybody and for any purpose. And we want to be sure that re-users aren't exposed to copyright-litigation if the copyright-state isn't clear.--Túrelio (talk) 13:10, 23 December 2022 (UTC)[reply]
Hi, I modified the source code as you asked it for the 3 pictures. Is it okay now ? This work is for general "genealogy purpose (my family and other folk)" and I see what you mean. Cordially, Tontonflingueur (talk) 13:46, 23 December 2022 (UTC)[reply]
Hi, yes, that was in the right direction. However, "Family archive" might be better than just "Family" for the source-entry. With regard to the author-entry, you should really try to identify the true photographer, especially for images whose appearance suggests that they were taken by a professional photographer/photo studio. You need to have in mind that today copyright nearly everywhere lasts for 70 years after the death of the photographer.
Technically, if you really couldn't identify the photographer, you should put "unknown photographer" into the author-entry. --Túrelio (talk) 13:57, 23 December 2022 (UTC)[reply]
Hi, I made the modification "family" --> "family archive". I really can't identify exactly the photographer, nobody, still alive, remember who he was and one point is for sure. The photographer is dead since a long time. Where can I add the field "unknown photographer" ? Cordially, Tontonflingueur (talk) 14:29, 23 December 2022 (UTC)[reply]

Well, not really. A true reproduction of a 2-dimensional work does not create an own copyright. The copyright is with the original photographer. In addition, this does not look like a usual "family/private photo", but like a photographer's work. --Túrelio (talk) 13:13, 23 December 2022 (UTC)[reply]
