Hi. Thank you. It certainly appears that the painting is in the public domain, but I don't know the reason. The painter passed away in 2009, so I think the copyright is not expired yet. A list of PD licenses on Wikimedia Commons is available here, but I can't find any license for this specific painting, so I suggest replacing {{Remove this line and insert a license instead|year=2020|month=10|day=19}} with {{PD-because|[https://www.europeana.eu/et/item/270/resource_document_jhm_museum_M011491 the source] suggests that the painting has been released under a [https://creativecommons.org/publicdomain/mark/1.0/ Public Domain Mark 1.0] license.}}, or a better template/explanation, in case I've missed something. This is not accurate. Stadsarchief Breda (City archives of Breda) informs the following: er zijn geen auteursrechten op de BN De Stem foto’s van Johan van Gurp. Voor openbaar/commercieel gebruik dient u bij het downloadprocedure getoonde formulier in te vullen en digitaal door te sturen aan het Stadsarchief. My translation: Author´s rights on images of photographer Johan van Gurp for newspaper BN De Stem in Stadsarchief Breda have been waived. For public and commercial use please fill in the form that appears in the download request and submit it to Stadsarchief. I have obtained a declaration in writing stating that author´s rights have been waived and that public and commercial use is allowed. I have requested clarification from Stadsarchief Breda whether they allow re-use without citation of source. I will report here as soon as I have a reply. The images and videos of Stadsarchief Breda can be found here: https://stadsarchief.breda.nl/collectie/beeld/films-en-foto-s/. The 270,000 images in the Johan van Gurp/BN de Stem collection were donated to Stadsarchief Breda by the photographer, see: https://stadsarchief.breda.nl/bn-de-stem-johan-van-gurp. Stadsarchief Breda digitalized the images. When a user selects an image and clicks on "download", a screen appears with conditions of use. For use in the public domain, including commercial, the user is requested to fill out a form and submit it to Stadsarchief. This is the form: https://www.breda.nl/foto-bestellingen-uit-de-beeldbank-aanvragen/formulier. The user has to state the purpose of use, and I put as purpose: Upload on Wikimedia Commons with CC0 license. Basically the form is a disclaimer (Stadsarchief cannot be held responsible etc etc ) plus a requirement to mention name of photographer and source. Which I did. All this was perfectly acceptable, as confirmed to me in writing by Stadsarchief. I hope this clarifies--Ruud Buitelaar (talk) 21:54, 9 March 2021 (UTC)[reply]
Ik geef even antwoord in het Nederlands, wel zo makkelijk. Als in dit artikel staat dat Van Gurp zijn foto's heeft gedoneerd, blijkt daar voor mij niet uit dat hij ook het auteursrecht heeft overgedragen. Dat staat er niet namelijk. Als we via OTRS gaan corresponderen zou ik het Stadsarchief vragen of ze de pagina uit de donatieovereenkomst kunnen scannen waar in staat dat van Gurp het auteursrecht overdraagt. Meestal gaat het namelijk alleen om de fysieke foto's of negatieven samen met een gebruiksrecht. Als Stadsarchief wél het auteursrecht heeft, dan kunnen ze de foto vrijgeven onder CC-0/Publiek domein, dan wel onder CC-BY-SA4.0 (of eerdere versie desnoods). Dit zijn de twee standaard opties op Commons. Ingewikkelde voorwaarden als formulieren invullen etc accepteren we hier niet op Commons. De foto is inmiddels verwijderd, mocht de toestemming toch in orde komen, dan kan die eenvoudig teruggezet (met de juiste licentie). Hier staat een tekst die het stadsarchief kan gebruiken om naar OTRS te mailen voor vrijgave van deze of andere foto's. Groet, Elly (talk) 22:24, 9 March 2021 (UTC)[reply]
P.S. dat jij het formulier hebt ingevuld met vermelding CC-0 wil ik uiteraard wel geloven. Maar op Commons geloven we niet iedereen, want daar is geen beginnen aan. Er moeten harde bewijzen zijn, die leggen we vast in het OTRS systeem. Dat geldt vooral voor professionele foto's zoals deze, want daar kunnen echt problemen mee komen, mocht iemand anders ze bijvoorbeeld in een boekje gaan gebruiken. Dan moet dat boekje uit de handel genomen.... moet er niet aan denken. Vandaar dit gedoe voor het goede doel dus. Elly (talk) 22:27, 9 March 2021 (UTC)[reply]
