File:Microsoft Surface Logo 2015.png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

@Herbythyme: This picture was uploaded with a Flickr license, in fact it's nearly exactly the same as [this image] here, and I did literally everything RaviC did underneath his image, in fact I linked to the image page, the uploader's page, and named him, I also put the correct form of copyright next to it (which stated that it was free to distribute), ¿can you please tell me how these 2 cases are different? --Namlong618 (talk) 22:40, 8 February 2015 (UTC) Or this one... --Namlong618 (talk) 23:00, 8 February 2015 (UTC)[reply]

Hum - the first image you pointed too does not contain identifiable Microsoft imagery which would be copyrighted as far as I know. I'm puzzled by the second one and will take a longer look at that and get back to you. --Herby talk thyme 08:48, 9 February 2015 (UTC)[reply]
OK - looking at it I consider the second image you pointed to to be a copyright violation too. In view of the time it has been here and the usage I've nominated it for deletion here - you may wish to watch it. Thanks --Herby talk thyme 10:15, 9 February 2015 (UTC)[reply]
@Herbythyme: But that image didn't violate it (or at-least no-one at Wikipedia thought so), Wikipedia is filled with those images, like what RaviC did here, I uploaded the Microsoft Lumia 535 from the same person (Kārlis Dambrāns) and I did everything exactly the same as RaviC does, but his images don't get nominated for deletion, but mine does. ¿what's the difference? it's all on a Flickr license and I certainly didn't mean for the other image to be nominated for deletion as it serves quite a useful purpose on a Wikipedia page, in fact that's their only usage, that's also the only reason I uploaded it to begin with. --Namlong618 (talk) 12:05, 9 February 2015 (UTC)[reply]
The problem is simply copyright law - Wikipedia allows "fair use" images which Commons does not - that may explain some differences. The Flickr license is completely irrelevant here sadly as Microsoft's legal team would not pay any attention to that. --Herby talk thyme 12:10, 9 February 2015 (UTC)[reply]
@Herbythyme: But that image has been on Wikipedia and Wikimedia Commons since 2013 and has never been A) nominated for deletion, and B) sued by Microsoft's legal team for copyright infringement, and I also find it odd that companies would practically punish anyone who'd give them "gratis advertisement", but that's another story, I just don't understand the double standards as I've seen hundreds of similar images on Wikipedia (from Commons) that have been there for years, plus the only use they have are in Wikipedia articles ¿can you then tell me how I can re-upload the image for exclusive Wikipedia usage? --Namlong618 (talk) 12:14, 9 February 2015 (UTC)[reply]
In fact on the very same article, here is another one, yet these have been on Wikipedia for years, and Microsoft hasn't taken any legal action, ¿how about if I were to get their permission from the Facebook or something? --Namlong618 (talk) 12:16, 9 February 2015 (UTC)[reply]
¿Is there a system where I can move files that were here into Wikipedia's none-free content upload wizard or something? like this with images like these. They're not in Wikimedia Commons, but are in Wikimedia Wikipedia, ¿so how can I do that? --Namlong618 (talk) 12:34, 9 February 2015 (UTC)[reply]
I'm afraid the issue here is to follow policy not argue with it. We cannot wait until Microsoft's lawyers get in touch (& facebook will certainly not release copyright any more that MS will). I'll look at the others is due course - they may be candidates for deletion. You need to ask on Wikipedia about non-free uploads - no bot that I am aware of. Thanks --Herby talk thyme 15:14, 9 February 2015 (UTC)[reply]
@Herbythyme: Before I'll make the same mistake as before (placing an image on Wikipedia that's about to be speedy-deleted), ¿does this image violate any form of copyright? I mean as the logo is trademarked. Microsoft Lumia 535 Back showing Microsoft Logo --Namlong618 (talk) 13:56, 10 February 2015 (UTC)[reply]
To me that looks OK - the MS bit is simple text and nothing else. However bear in mind with copyright stuff opinions may vary. --Herby talk thyme 14:29, 10 February 2015 (UTC)'[reply]
@Herbythyme: Oké, thank you I'll wait a week until I'll place it in Wikipedia in case it might still get speedy-deleted, thank you for your quick response. --Namlong618 (talk) 15:15, 10 February 2015 (UTC)[reply]
No problem - happy to help if I can. Best --Herby talk thyme 15:17, 10 February 2015 (UTC)[reply]
