The photographed plate is almost certainly public domain, but the photograph of it isn't and that is what the problem was. The plate is essentially a "3D work of art" for copyright purposes per which makes the photograph a derivative work eligible for its own copyright separate from the plate. This means that not only the plate itself, but also the photo of the plate need to be either in the public domain or shown to have been released under a free license. If you took the photo yourself, then follow the guidance in COM:VRT#Licensing images: when do I contact VRT? and the photo can most likely be restored. If you didn't take the photo yourself, then follow the guidance given in COM:VRT#If you are NOT the copyright holder. A crop of the plate's artwork was created as File:Actor Anita Stewart on a 10-inch Ceramic Souvenir Plate. Vitagraph Studios publicity item (cropped).png and (so far) this seems to be OK for Commons, but the original file you uploaded will need to be COM:VRT verified for it to be restored. -- Marchjuly (talk) 21:47, 25 November 2021 (UTC)[reply]

When you first dropped in to comment on my edits, your user name appeared in a different form, yellow in color. I have not been able to locate and retrieve this for review. Although I can't be sure, the initial issuance of the bench warrant was in October. Granted.

As you well know, the matter was related to a dispute over an image that had long been posted on Victor Fleming (this format won't let me use double brackets to link you to the article), director of the 1939 film Wizard of Oz, and apply it to the article concerning the producer of the film, Mervyn LeRoy. Obviously, this dichotomy in application was confusing to a contributor not learned in Commons "legal" jargon. File:Wizard of Oz 01.jpg

In an effort make the image serviceable for use on LeRoy, I altered the tag. The Wiki Commons experts, including Marchjuly, rather than assisting me to adapt the image, demanded, prosecutor-like, an accounting for the edit. My request for assistance for ignored. Marchjuly, if forthright, will acknowledge this.

Subsequent to this exchange, there was a massive demand for the accounting of dozens of images I had uploaded during the last 2 years or so, which at the time had met with little or no objection from Wiki Commons. I could not help but conclude that the tag I was using was adequate for use a a number of major overhauls of articles by film directors of the Hollywood Golden Ageː King Vidor, John Cromwell, Tod Browning, Sam Brown and Lewis Milestone.

Rather then examining the images and making adjustments to the tags, which your experts on copyright considerations are surely in a position to advise on, they engaged in a retaliatory rampage.

The message is clearː if you revert a Wiki Commons editor's removal, they will demand a full accounting for your Wizard Uploads. When "proof" is not forthcoming, a wholesale removal of images follows, even they have applied to Wiki articles that clearly improve those articles, and have posted for years..

If your opinion is that the bench warrant has been issued, and that the end of the matter, then further discussion is superfluous. If you are acting as an lawyer representing your "clients", then the same applied.

If you wish to proceed in good faith with a contributor who has demonstrated a sustained commitment to improving Wikipedia, please revert the removals of my uploaded images, and provide me with the methods bring them into compliance. Thousands of images at Commons exist under these simple tags which you can surely supply.

Although I can't be sure, most modern web browsers have the ability to search a webpage for specific text. Before today, I wrote to you exactly three times, and tagged none of your uploads. My first post was 03:56, 24 October 2021 (UTC), a warning for uploading copyright violations, which it appeared you did not heed. My second post was 11:28, 18 December 2021 (UTC), a final warning for the same. My third post was 16:12, 20 December 2021 (UTC), pointing out the timestamp on my first post. I'm sorry I missed this reply in three edits because you didn't ping me, and your reproduction on enwiki, until Tuesday. It then took some time and research for me to digest all your text and formulate a reply during this busy and challenging holiday season within a pandemic. en:File:Wizard of Oz 01.jpg is held on enwiki for Fair Use under en:WP:F. At 346 × 270 pixels, it was reduced to 93,420 pixels, under our 100,000 pixels (0.1 MP) limit. Your removal of {{Non-free historic image|image has rationale=yes}} from its file description page and replacement with nonstandard text and {{PD-US-no-notice}} 18:33, 13 October 2021 (UTC) triggered this whole mess. How did you come to the conclusion that there was no notice? The notice could have been in a margin or on the back. It is likely that uploader Davidacaruso uploaded it to enwiki because he had evidence of a notice, or at least insufficient info to prove that there was no notice. I have issued no bench warrant, as I am not a judge, but I am a Volunteer Response Team Agent trusted to deal with copyright issues on WMF projects, a License Reviewer here (similarly trusted), and a Grandmaster Editor First-Class (or Grand High Togneme Laureate) on English Wikipedia experienced at dealing with Fair Use justifications. Please explain what led you to believe "this format won't let me use double brackets to link you to the article". There are good ways to alter the wikitext on en:File:Wizard of Oz 01.jpg to indicate justification for use on en:Mervyn LeRoy, but what is your justification? Is he pictured? Is he the photographer? "The image is significant in identifying the subject of the article, which is the film itself" is clearly incorrect regarding an article on the producer of the film. In other words, exactly how does use of that photo in that article satisfy the "Contextual significance" criterion at en:WP:NFCC#8, which is based in US copyright law? In my 15 years of experience, I have learned that once a second use justification for any particular non-free file is established, use of a combination template like en:Template:Non-free use rationale 2 becomes inappropriate (because it is limited to a single use), and the pieces need to be separated into one instance of en:Template:Non-free media data and 2+ instances of en:Template:Non-free media rationale; just adding free-form text or an instance of en:Template:Non-free media rationale is insufficient and inappropriate. Where may I find "a massive demand for the accounting of dozens of images [you] had uploaded during the last 2 years or so"? Thank you for your fulsome response. If the Commons Establishment had "been legally protecting the Foundation, copyright holders, reusers, and editors" then they have done a miserable job. Why? For years your "Foundation" has ignored my multiple uploads to Wizard that I have to made and until recently graced the articles in question. Your lawyer-like demands for legal justification were prompted by a couple of reverts on my part and summary removal without offering guidance demonstrates this as fact.
