I just wanted to let you know. You have two options, nominating an image for deletion (used if you are unsure if it should be deleted or not) or speedy delete (if you are sure it is a copyvio). Legally, most toys are art. It is the same thing whether you take a picture of a sculpture or a picture of Darth Vader. Both are copyrighted, in both cases, the copyright of the photograph does not void the original copyright, and in both cases you will need the permission of the original creator. You cannot upload pictures of a sculpture by Picasso, you can't upload photographs of Mickey Mouse or Pokemon figures. Numerous lawsuits have shown that Mickey Mouse or Asterix have to be treated as works of art, which means they are subject to copyright, while a common spoon or a table are not works of art. They can be copyrighted, perhaps, if they were given a very special form by a designer, but the ones you use at home are probably not.

Objects with utilitarian functions that are not toys are not copyrightable though. But, amusement and entertainment in most cases does not count. ViperSnake151 (talk) 11:26, 3 October 2008 (UTC)[reply]

Eloy Erentxun photograph[edit]

Hey! I don't know much about licenses, I only chose the one that thought was appropriate. The fact is that the photograph I uploaded is not under Copyright or any other type of license, as it is a personal photo of my family's: the person that is in it, the basque painter Eloy Erentxun, was my grandfather. So now, I don't really know what to do in order to keep the photograph from being removed... I would really appreciate your advice!

Ces images sont d'après vous datées de mai 1912, ce qui est compatible avec le sujet représenté : Le Gal Lyautey au Maroc. Vous en déclarez la paternité, ce qui signifie que vous avez plus de 96 ans, au minimum 110 pour que vous soyez en age d'utiliser un appareil photographique de l'époque.

Ceci est relativement peu vraisemblable. Pourriez vous indiquer qui en est le véritable auteur, svp ? Et s'il est mort, la date d son décès ? S'il s'agit de photos de famille, et que le décès de l'auteur est inférieur à 70 ans, en êtes vous l'unique héritier ?

Bonsoir,

Ces photos sont des photos numériques prises à partir de quelques unes des 8 boites de photos stéréoscopiques sur verre en ma possession (plus d'une centaine de plaques, s'étalant sur plusieurs années), héritage de mon arrière grand-père, le Général Dalbiez, qui fut sous les ordres de Lyautey et en poste au Maroc au moment où celui ci fut nommé résident général. Mon arrière grand-père était alors général de brigade. Il participa aux campagnes du Maroc du 02/05/1911 au 31/03/1915. La date de mai 1912 est la date des événements et donc des plaques stéréoscopiques. La date des reproductions que j'en ai faites sont dans les Exif des photos. J'ai sélectionné les 9 photos où Lyautey est visible ou bien où mon arrière grand père et son état major l'attendent En résumé, j'ai la paternité et la propriété des reproductions numériques et la propriété des originaux.

Bonsoir, Ces photos me viennent de mon arrière grand-père (qui en était propriétaire, puisqu'en matière de mobilier, "possession vaut titre", ce qui s'applique à moi également), via mon père, et mon grand père. Je suppose que mon arrière grand père devait avoir demandé à un de ses subordonnés de prendre des photos pour lui, mais parmi les plaques en question, on trouve des photos prises alors qu'il n'était plus en activité, sans doute par son frère Auguste ou un ami. Je considère donc que mon arrière grand-père avait également la paternité et la propriété intellectuelle de ces photos. Le Comte Général Denis DALBIEZ est décédé à Nice, à l'hopital Pasteur, le 13 Août 1929.
Pour info, j'ai publié la totalité de ces photos stéréoscopiques sur verre sur mon site personnel de généalogie. Je vais donc indiquer D.Dalbiez (Denis Dalbiez)comme étant auteur de ces photos. Oh!! Bonjour :) En fait, il existe deux types de propriétés : Propriété matérielle : vous achetez un DVD d'un film, ce DVD et le film qu'il contient vous appartiennent, et vous pouvez revendre cet unique DVD. Propriété intellectuelle : vous ne pouvez pas faire des copies de ce film et les vendre/distribuer, parce que vous n'êtes pas propriétaire des droits du film, qui n'appartiennent qu'à l'auteur, puis à sa mort à ses descendants, pendant encore 70 ans. L'auteur est celui qui prend la photo, c'est lui qui possède les droits intellectuels sur ces images et leurs reproductions. Je conclut de notre discussion que vous ne possédez aucun contrat vous conférant des droits de republication/copie/modification. Vous ne pouvez pas, dans l'absolu, redistribuer ces images. Maintenant, dans le cas des publications anonymes, la loi française me semble indiquer qu'au delà de 70 ans à partir du 1er janvier suivant l'année de première publication, l'œuvre passe dans le domaine publique, et tout le monde est libre de l'utiliser/distribuer (pas sous licence GFDL ou creative commons, mais sous domaine publique). Ce cas de figure nécessite une recherche approfondie, il est préférable d'être apte à démontrer qu'une recherche approfondie pour identifier l'auteur c'est montrée infructueuse, avant de prendre le risque de publier une image domaine publique auteur anonyme. Car vous engagez votre responsabilité juridique en le faisant. Simple note accessoire, votre arrière grand père étant décédé depuis plus de 70 ans, toute œuvre intellectuelle qu'il aurait crée (ce qui n'est pas le cas de ces photos) est aujourd'hui dans le domaine publique. Dans le cas où nous nous trouverions avec une image dont l'auteur est anonyme et la publication plus vieille que 70 ans, il reste un dernier point à traiter : la numérisation de cette image. Ici, nous abordons une politique officielle de Wikimedia-Commons, qui est de considéré qu'il n'y a pas création de nouvelle propriété copyright lorsqu'il s'agit d'une reproduction fidèle d'une image dans le domaine publique : il s'agit d'une action mécanique qui ne présente pas suffisamment de créativité artistique pour être éligible à une protection copyright. Le bandeau à utiliser en ce cas est , et la page de Commons hébergeant l'image doit contenir une description de l'image (son contexte historique par exemple), une date de publication, et la mention auteur anonyme, en expliquant ce que nous avons discuté plus haut

Je note plusieurs inexactitudes ou approximations dans votre raisonnement, et un certain nombre d'informations dont vous ne tenez pas compte:

Elément supplémentaire: ces plaques de verre sont accompagnées de notes manuscrites de la main de mon arrière grand-père en décrivant le contenu, et accompagnent son journal personnel, également manuscrit.

En cas de chicane juridique, si celle-ci se déroulait en France, il serait impossible pour quiconque de démontrer une quelconque propriété intellectuelle pour ces photos de famille, en dehors de moi-même.


Quel est le bandeau à utiliser pour une oeuvre tombée dans le domaine public en France et publiée aux Pays-Bas? Je suppose que c'est celui que vous m'avez indiqué?

Bonjour, ça commence à devenir un peu trop compliqué :D Donc, nous somme en présence d'image d'un auteur probablement anonyme et français (votre arrière grand père n'est pas ce qu'on appelle l'auteur, il n'a pas appuyé "sur le bouton"), mais publiés pour la première fois aux pays bas probablement 70 après la mort de l'auteur. J'avoue qu'on est au delà des connaissances que j'ai pu accumuler sur le droit d'auteur. Le cas semble se rapprocher des archéologues qui obtiennent il me semble une exclusivité de 25 ans sur leurs découvertes... mais c'est flou pour moi ;) Évidemment la panacée serait de contacter un conseillé juridique spécialisé... mais je me fait pas d'illusions. La publication sur Commons peut s'avérer plus tard problématique, le statut juridique de ces image étant complexe, et je vous informe qu'un débat pour leur suppression peut avoir lieu (et il serait animé). J'espère ne pas vous avoir trop ennuyé avec cette discussion, et je crois que je n'ai pas encore eu l'occasion de vous dire que j'avais apprécie ces images d'époque du Maroc. Je ne peux vous fournir d'avantage d'informations, et espère au moins vous avoir fournit l'occasion de voir quel type d'informations nous recherchons sur Commons lors de la publication d'images. Et oui, c'est compliqué! Et non, ce n'est pas toujours celui qui presse le bouton qui a la propriété intellectuelle (par exemple, le cameraman ,n'a PAS la propriété intellectuelle de l'émission qu'il enregistre pour la télévision). Et non, la première publication n'a pas eu lieu aux Pays Bas (sur les serveurs de Wikimedia), mais en France sur les serveurs français qui abritent mon site de généalogie familiale. Je sens que vous ne suivez pas! Un peu d'attention s'il vous plait! ;-) Le général Dalbiez serait étonné de cette conversation, le sujet principal de ces photos étant lui-même, Lyautey n'étant qu'un épiphénomène pour cet homme parfaitement égocentrique!

Hi Lilyu. Juste pour dire qu'il me semble, si tu places une image dans le domaine public, c'est un peu inutile de la placer également sous GFDL ou licence CC. Un peu comme placer une image sous double licence CC-BY et CC-BY-ND (CC-BY englobe les droit de CC-BY-ND et l'étend). Voilou, c'est tout. Hi. (I am surprised to see that there is a different spelling for Mississippi in French!) The map doesn't show any Confederate movements against Sherman after November 1864 because there weren't many large movements to speak of. Salut, en fait c'est un outil en développement chez Google (Google Lab), pour le moment c'est seulement possible de faire d'abord un recherche d'image puis ensuite chercher les images smilaires via le lien dédié sous chaque image. Your thread of "disrupting contribution" won't end up anywhere. Two contributors (even 3, if I count MGA73) supported my view. Your opinion isn't any more guess work than any others. There is ample evidence that a live feed doesn't create any new original work. And finally, in matter of copyright, you have to remember that the proof is on the prosecutor. I had some more thoughts about this case. Actually there are three reasons why there is no copyright here. For the existence of copyright, there needs (at least) three things: originality, fixation (it needs to be recorded in some permanent form), and author. As I said above, there is no originality in a live feed, it is automatic, there is no fixation, no recording, and last, there is no author. Merci pour ta réponse,je ne suis pas très familier avec commons, et je vais corriger la license. S'agissant de l'auteur, ça n'est pas rare de ne pas le connaître quand il s'agit de lithographies ou gravures illustrant des ouvrages, comme ici. Un grand nombre d'entre elles portent la mention unknown sur commons. De plus il s'agit d'une source universitaire, je pense qu'on peut leur faire confiance s'il dise que l'auteur est inconnu.

Je t'embête encore un peu, juste pour être sûr de bien comprendre. J'ai uploadé une image File:L'Art et la Littérature.jpg, quelqu'un est passé pour mettre la license PD-Art, puis un bot à ajouté cc-by-2.0. Je dois donc supprimer la license du bot ? As to not being an admin you have quite a few more edits than many have (and more than I had when I started with the tools...:)).
Anyway - I've deleted the Russian contribs thanks , I see he is blocked there so it seems possible he will not get the message but we will see.
On the French user it is a pity they are not responding (I see they have the same page on fr wp - I think it was deleted once but maybe not). Given their apparent record shooting they might justify a wikipedia page I guess but it does seem that they are using the project for their own benefit not ours which is the issue for me. Thanks for your reply, I guess I think this should be a little more User Friendly to be of help to anyone! I try to follow the long drawn out process, but it just leads to more long drawn out processes and I don't have a lot of time to even get frustrated with that. I first thought about the filenames, but since there was no requirement stated, I just used the meaningless ones cause it's quicker. When I get a chance, I'll go back and redo it all and try again to get my photos from Flicker to my account here. But there's also the fact that the Gallery doesn't work, so other services don't have that problem and people can automatically go to your Gallery and see your Pictures. I guess that's really not the main focus here, but it doesn't hurt to have the things functioning that work for other sites doing the same Media! Thanks again for your help!

there are two accounts : Rainbow0413 (talk · contribs) and Vanille0413 (talk · contribs)... Probably the same person, it's a real mess. I highly disagree with speedy tagging those images and get them deleted without any talk, like it was done on File:Chapelle Notre Dame de la Roque - Villeneuve (04).JPG. There is nothing obvious here.
Removed the watermark ? i'm sorry, but can't you just revert the upload of the watermarked version... why reuploading ?
I think those images should not be speedydelete but rather put into a mass DR, as it is not an obvious case.
What i understand from copyright laws is that the "all rights reserved" sentence has no longer any legal meaning, and i doubt it ever had one in France. "Copyright @blablabla All right reserved" is a claim of copyright holding, but it DO NOT means the work was not published with licenses etc, it's just a claim that someones hold copyright rights over a work of art. When publishing a a work with a free license, the author/copyright holder keep his rights... he just ALSO share some of his rights to other peoples, while still keeping his rights and the right to use them... unless an exclusivity clause was part of the contract.
This user also asked his photos to be deleted and his account closed. My opinion is that both of this actions cannot be done by a commons' admin. GFDL and CC BY SA licenses used by this user are irrevocable, although the french law allows a french author to retract from publishing,
Art. L. 121-4 : Nonobstant la cession de son droit d'exploitation, l'auteur, même postérieurement à la publication de son oeuvre, jouit d'un droit de repentir ou de retrait vis-à-vis du cessionnaire. Il ne peut toutefois exercer ce droit qu'à charge d'indemniser préalablement le cessionnaire du préjudice que ce repentir ou ce retrait peut lui causer. Lorsque, postérieurement à l'exercice de son droit de repentir ou de retrait, l'auteur décide de faire publier son oeuvre, il est tenu d'offrir par priorité ses droits d'exploitation au cessionnaire qu'il avait originairement choisi et aux conditions originairement déterminées.
"Notwithstanding the transfer of his right of exploitation, the author, even after the publication of his work, has a right to repent (reconsider) or retract regarding the assignee. I would probably inform this user that he can only get his account renamed, but not deleted, due to technical problems, and that if he wants to retract from publishing, he has to directly get in contact with the WMF and offer them proper indemnification, the WMF would than chose to remove the content from its website OR chose to fight his decision (with FSF and Creative Commons) to get a law case concerning the free licensing... probably on US copyright ground.

About "File:Ramanujacharya.jpg" source information.[edit]

This file [7] was uploaded by me, a few weeks back. The individual portrayed in the picture is a saintly figure, who is an icon of worship, for my group of people. While placing orders to print my marriage invitation, I had requested the "marriage card printers" to include an image of "Ramanuja(a godly figure) seen with vadakalai tilak markings", in the back page of the invitation(it is a custom amongst us). Also, i had requested them for a copy of the same, burnt in a CD. I had personally given the description for the image, as to how it is supposed to be, and they designed it exclusively for "printing it in my marriage invitation". Henceforth i got it, and uploaded it here. The work is not found anywhere in the internet, and i had claimed it to be "my own work". It is indeed "own work". Also, it just a sketch/painting/animation image. What is wrong with it?? Please enlighten. Also the page was vandalised by some new user/ips who made some dubious claims and made, egregious edits to the file information. I had nothing to do with it. I saw your turtle on commons and find it beautiful. Now I would like to use this turtle a little bit modified as a logo and on a homepage for a disaster folding house after catastrophies. I think she is probably referring to the french law: paternity is due to art works, in theory, the author cannot renounce to it.
