Hochladen fremder Fotos[edit]

Hallo Kibonaut, bei allen Bildern, die Du bislang hochgeladen hast, handelt es sich offenbar nicht um Deine eigenen Werke. So ist beispielsweise File:Fabian-Heilemann Portrait.jpg das Werk der Hoffotografen GmbH in Berlin oder File:Juergen Abromeit CEO INDUS-Holding.jpg von der Fotografin Catrin Moritz aufgenommen worden (sie wird in Deiner Dateibeschreibung nicht einmal genannt). Bei File:Hinter dem Ohr Hoergeraete bunt.jpg wird “Biha - Bundesinnung der Hörgeräteakustiker KdöR” als Autor genannt. Hier ist darauf zu achten, dass das Urheberrecht ein persönliches ist (siehe § 7 UrhG). Auf Wikimedia Commons legen wir großen Wert darauf, die Urheberrechte abzuklären. Deswegen müssen alle nochgeladenen Werke, die nicht gemeinfrei, nicht anderswo durch den Urheber unter einer freien Lizenz veröffentlicht worden sind und nicht vom Urheber hochgeladen werden, durch einen Prozess gehen, bei dem die schriftliche Genehmigung des Urhebers zur Veröffentlichung unter einer freien Lizenz durch das Support-Team überprüft wird. Hierzu ist bitte für jede Gruppe von Fotos, die jeweils von einem Urheber stammen, eine E-Mail an permissions-commons@wikimedia.org zu schicken mit einer Genehmigung durch den Urheber (gerne in deutscher Sprache). Es gibt eine anpassbare Vorlage für eine entsprechende Erklärung. Zu klären ist in jedem Fall, wer der Urheber (also der Fotograf) ist. Selbst wenn weitgehende Nutzungsrechte einer Firma übertragen worden sind (was im einzelnen dann mit dem Support-Team zu klären ist), ist § 74 UrhG zu beachten, d.h. der Urheber (und niemand anders) legt fest, wie er oder sie zu nennen ist. All dies sollte umgehend erfolgen, sonst müssen wir diese Bilder vorerst löschen. Sie könnten wiederhergestellt werden, sobald alles mit dem Support-Team geklärt ist.

Ein spezieller Fall sind Logos wie File:DocMorrisNoClaim.jpg oder File:INDUS Holding 2016.jpg. Diese haben keine Schöpfungshöhe, werden somit nicht vom Urheberrecht erfasst. Entsprechend sind sie mit der Lizenzvorlage {{PD-textlogo}} auszustatten. Unabhängig vom Urheberrecht können solche Logos dem Markenrecht unterliegen. Hallo AFBorchert, vielen dank für den Hinweis und den Link zur E-Mail-Vorlage. Ich werde mich entsprechend darum kümmern und die Einverständniserklärungen nachliefern. Grundsätzlich sind diese Bilder freigegeben für jegliche redaktionelle Verwendung, unter die auch Wikipedia fällt.

Hallo Kibonaut, vielen Dank für die Antwort und die Bemühungen um Einverständniserklärungen. Zu beachten ist, dass nicht nur eine „redaktionelle Verwendung“ zulässig ist, sondern explizit eine Freigabe unter den angegebenen Lizenzen erlaubt wird. Damit ist dann durchaus aus urheberrechtlicher Sicht eine Verwendung für beliebige kommerzielle Zwecke erlaubt. Beschränkungen gibt es dann im wesentlichen nur aus persönlichkeitsrechtlicher Sicht (bei den Porträts), weswegen es sinnvoll ist, noch {{Personality rights}} bei diesen Bildern hinzuzufügen.
