Hello,

I recently added these files to the Nakadomari, Aomori page and received notice that they might be a copyright violation and could be deleted. I posted on the talk section for both photos that I am the creator and owner and the blog they are featured on is a past blog I contributed to. This morning I found them deleted with no further messages or guidance. What steps do I need to take to allow my photos to be used and stored on Wikipedia commons? Thank you.

I am a bit new to Wikipedia, and puzzled about the copyright issues about illustrations. I have uploaded the "File:MiaoGanJie (缪淦杰) dans une position typique du Baji Quan (1936).jpg" that was just deleted. This picture was take and published in 1933 in China, in a booklet published by the "ShangHai Litterary Publishing House - 上海文业书局 ". The publishing company was closed before 1940 and there is no known inheritor of Mr Miao Ganjie who is represented in this picture. Beside, since copyright in China is only valid for 50 years, there is no reason why this picture should not be public domain now. Other articles on chinese martial arts have similar picture of known practitionners dating from the same era (Yang CHenFu, Sun LuTang), what would make this picture different from others ? This had no license at all. If it did, you would've had the 30 days for OTRS to confirm the license. Files can't stay on Commons for more than a week without a license. Copyvio files

All files uploaded by this user are copyvios. e.g. the source of this file clearly states that "Copyright © 2012 ivy-Baron All Rights Reserved.". Still the user wrongly tagged it in the public domain. Same is the case with his other uploaded files. Copyvio files

I noticed that as per the discussion Commons:Deletion requests/Files uploaded by PubuduGk119 that all the images were to be deleted however it would appear that either some were missed or were re-uploaded by User:PubuduGk119. Rather than go through and post deletion notices on each of them can they be done as a batch. Also it would appear that in order to circumvent being identified as a serial poster of copyright material User:PubuduGk119 has created a sockpuppet User:Pubudualmeda, which has re-uploaded a stack of images which have all previously been deleted. Hello, I object to this closure by you. I think the first two images have no problems at all. Commons is not a place to editorilse on other projects (COM:EVID clearly does not apply about them). The files were in use and quality does not matter. With all due respect, I also think that you have a clear conflict of interest to close this request as "Not done" since you were the admin who deleted the files at the first place. Hi INeverCry, If an image has been deleted can you still view the categories it was in or would you have to undelete it to see them ?, I only ask as you've deleted File:Image needs renaming - 0941 (27671863990).jpg however I have no idea what the image was or even what category it was in so I'm not sure if I've uploased the image from a dodgy person or what - I try & keep track of who I upload from as if the copysvio then continue I then know to stop uploaidng their images, Anyway sorry droning on, Thanks, –Davey2010Talk 01:35, 4 October 2016 (UTC)

FoP only applies to 3D - buildings, sculptures, etc. 2D is a flat painting / drawing, and that has copyright which cannot be so easily given away. Ronhjones  (Talk) 23:58, 5 October 2016 (UTC)

About the Review of Some Photos Uploaded by User:Jin-gook

Hi. I found that a lot of photos of Korean people were uploaded to commons recently, and you reviewed some of these photos. But I found that these photo may violates copyright. Take this photo as an example, could you tell me where you can inform from the original link that this photo applies to its license, please? Plus, I can found a copyright notice from the bottom of the original link shows that it is copyrighted. If they are copyrighted, please delete all these photos that may infringe copyright. I reviewed this per User:-revi/Tistory. The file is about half-way down the page. At the bottom right corner of the page is the Creative Commons icon that shows CC-BY-SA-4.0 when you drag your mouse pointer over it. Perhaps @-revi: can help clear this up if needed. Using a friend's camera

I just saw that files by a user is nominated for deletion because the metadata shows that the photos are taken by others. However, the uploader argues that he owns the copy right and he has just used the cameras of friends for those photos. How can the issue be resolved. We require COM:EVID, which usually means OTRS permission. Anyone can come up with the story you mention. I've seen more than one serial copyvio uploader lie about the copyright of images any way they could think of. This is why we use COM:PRP in these situations. lNeverCry 05:41, 6 October 2016 (UTC)
And how if those authors mentioned in the metadata send their disclaimer emails to OTRS and verify that they don't hold the rights of the photo and had lend their camera to the claiming author? --Mhhossein talk 05:47, 6 October 2016 (UTC)
That's a question you would be better off asking an experienced OTRS member. They would know how a situation like this is handled, though they may not want to give away their methods publicly. I can only guess like you since I'm not an OTRS member. lNeverCry 05:51, 6 October 2016 (UTC)

Problematic user

In spite of your final warning, the user yet again uploaded a copyvio image, claiming it as their own work. The higher/equivalent resolution version of that image has appeared at various sites in the last seven years or so, e.g. 2010, 2011, 2013, 2014, etc.

In fact, the higher resolution version of that image is already uploaded here – File:Hannibal traverse le Rhône Henri Motte 1878.jpg. And the image is of the Second Punic War (of Europe), i.e. it's totally unrelated to the history of Khandayat (an Indian Caste). So, the user not only uploaded a copyvio image but also fabricated the history.

On a different note, the original pic might also be a copyvio, as it seems to be copyrighted to the Getty Images. - NitinMlk (talk) 22:27, 7 October 2016 (UTC)

He didn't properly attribute the image, but it's not a copyvio. Motte died in 1922, so the image is PD-ART/PD-old-70. Getty images can't claim copyright of a PD image, though they try to do so all the time. I've deleted the duplicate. If the above user uploads a straight-up copyvio, a block may be needed, but this particular image isn't enough. lNeverCry 22:39, 7 October 2016 (UTC)

Bollywood Hungama files

Hello, I noticed that you deleted two files File:Ajaz Khan at Karim Morani's birthday bash.jpg and File:Ajaz Khan at Baba Siddique's Iftaar party.jpg marking them as copyright violations. But may I know how theses images are copyright violations. Mr. Smart ℒION☎️I👨‍👩‍05:35, 4 October 2016 (UTC)

For File:Ajaz Khan at Karim Morani's birthday bash.jpg, the source link http://www.bollywoodhungama.com/celebritymicro/images/id/87642/category/parties/type/view/imageid/17983214/ is a 404 error, so it can't be reviewed. For File:Ajaz Khan at Baba Siddique's Iftaar party.jpg, the source http://www.bollywoodhungama.com/bh-301-redirects.php?type=photos&celebid=87642&cat=parties&imageid=20169212 is also a 404 error, so it can't be reviewed either. I knew it that I will get this reply! Actually the problematic Bollywood Hungama administrators had changed the layout of their website on 21 September 2016, which led to the deletion/automatic removal of some images from their own website uploaded before 21 September 2016. Take this example File:Neha Dhupia at the launch of Costa's 100 store 08.jpg. This file was been reviewed. This means that this image was available on their website before 21 September 2016 and got deleted/autotically removed after 21 September 2016, when BH changed their website. Just search "File:Ajaz Khan at Karim Morani's birthday bash.jpg" on Google. You will find an image with this title containing Bollywood Hungama watermark, which you will get to know that the image WAS available on their website before 21 September 2016. Do the same searching for "File:Ajaz Khan at Baba Siddique's Iftaar party.jpg", PLEASE!!! Mr. Smart ℒION☎️I👨‍👩‍17:29, 4 October 2016 (UTC)
You could search the above links at https://archive.org/web/, and see if they were archived, or you could find watermarked versions of the same size as the deleted files above. I have seen the images at Way Back Machine but they were not archived at the time when uploaded on Commons. And I've explained you earlier also that I have already searched on watermarked version of the same size as the deleted files above. Just search "Ajaz Khan at Karim Morani's birthday bash bollywood hungama" on Google and you will find a link titled "Shah Rukh Khan, Yo Yo Honey Singh, Sushant Singh Rajput & Kriti Sanon at Karim Morani's birthday bash", which is proofed by this fact that the image was 100% available when I uploaded them on Commons. Now because Bollywood Hungama has changed their website, so the link and images in it have been removed/automatically removed from the website showing "No page found". Another example, just see User talk:NIKE 01. This user's talk page is full of files that have been deleted by you yesterday, which means that the images were available on their website before 21 September 2016. Take another example of User talk:Moheen Reeyad. Many files have been marked as "No permission". Why would he make such a mistake when he is an image reviewer. And it's common sense why would three different people give broken links to files. And my two deleted files are even Bollywood Hungama watermarked which is proofed that I'd uploaded them from only Bollywood Hungama website and from no where else. Please try to understand. Why should we suffer when it's the problem of Bollywood Hungama? See Commons:Deletion requests/File:Bipasha Basu and Karan Singh Grover grace IIFA 2016 at Madrid.jpg, in which I've voted "Delete" to my uploaded file as I know that events outside India are not allowed to upload on Commons and I understand my mistake. But I'm not satisfied with the deletion of my two files because it's not my problem but it's Bollywood Humgama problem. Our hard work shouldn't be destroyed because of Bollywood Hungama. I'm not associated with Bollywood Hungama, so I don't why they would make you suffer. In any event it's not my fault, and I can't review a guess: I need a source that works. I won't put my name to anything less. You might have more luck with COM:UDEL. I'm one of the busiest admins on any project, so I don't have much time to spare on searching for sources.

As regards user rights, I've seen a Long Term Abuse sockpuppet MyCanon trick Commons into giving them image reviewer, file mover, patroller and rollbacker. I've seen Image Reviewers commit copyfraud on purpose using the Image Reviewer right to do it and hide it. You never know what people will and won't do. INeverCry (talk) 06:44, 5 October 2016 (UTC)

My personal opinion in cases like this is that people should stop hunting for obscure and at best questionable copyright violations, and focus on the tens of thousands of obvious copyright violations we have on Commons, especially in Category:Media needing categories. With the above, the 50 years bit works for me. Proving that you've researched looking for an author is asking too much IMO. We have so many files that have unknown authors (hundreds of thousands, if not a million or more), a ridiculous amount of time would be required to research their authorship to any reasonable level of consistency. My recommendation of VP/C is meant to slow down DRs of this material and also come out with a decision on how to handle them that carries the weight of consensus. Single opinions on copyright issues aren't worth much generally.

INeverCry, this image was uploaded as a part of the Commons:Photo challenge, and the deletion is complicating the voting process. Sorry I missed it while it was still open, but I can not find in Commons:Deletion policy any valid reason for granting this DR. I guess it would have to be the out of scope argument, but the image is actually quite good and in use as a part of a challenge. Can we undelete it? --Jarekt (talk) 01:30, 6 October 2016 (UTC)

It hurts my eyes to look at the middle of that flower. I don't know what happened, but whoa! The image is terribly blurry and noisy, and there are some strange colors on the leaves. My deletion was based on COM:EDUSE/Commons:Project scope#Examples (the last example: Files that add nothing educationally distinct to the collection of images we already hold covering the same subject, especially if they are of poor or mediocre quality). We have better shots of the flower in Category:Dasiphora fruticosa; the spider is unidentified, but it's also very blurred/noisy. I object to restoring it on these grounds. You'll have to take it to COM:UDEL. We need reasonable-quality images here, and this isn't one IMHO. lNeverCry 03:16, 6 October 2016 (UTC)

Sochi 2014 logos

Hi. Perhaps I should have been a little more explicit with these files. Yes I know it is text, and yes, I'm 100% opposed to the deletion of mere text. But the reason for deletion was taken by the WMF legal department. As referred in the deletion comment of File:Sochi logo for the 2014 Winter Olympics.svg, the legal department decided to not host this file. @Tbhotch: If there's an OTRS ticket affecting multiple files that need to be deleted, DRs filed by a non-OTRS member aren't the way to go. We have plenty of admins here on Commons who are OTRS members. The reason I use this file photo is to serve as the primary means of visual identification at the top of the article dedicated to the work in question.

Music infobox. The image is used for identification in the context of critical commentary of the work for which it serves as cover art. It makes a significant contribution to the user's understanding of the article, which is greatly enhanced than by words alone. The image is placed in the infobox adjacent to the article discussing the work, to show the primary visual image associated with the work, and to help the user quickly identify the work and know they have found what they are looking for. Use for this purpose does not compete with the purposes of the original artwork, namely the artist's providing graphic design services to music concerns and in turn marketing music to the public.

Please undelete the image.

The older upload was significantly smaller than this one by , (2,100 × 1,415 pixels, file size: 112 KB for Fæ's version and 697 × 470 (38,978 bytes) for the version that I processed and deleted as a dupe. The source for the deleted version was a dead link, but I've found the current link, http://digitalmedia.fws.gov/cdm/singleitem/collection/natdiglib/id/4581/rec/3, and added it to the current version to be thorough. lNeverCry 20:51, 12 October 2016 (UTC)

I'm still trying to learn what we do and don't accept here. The source is given as a Pinterest site, which I visited. That site refers to another, altesse.eu, which returns an error when I try to load it. So the only attribution is the assertion made by the Pinterest user that the image is Jeanne d'Albret. My question: Does it satisfy our criteria that the uploader simply provides the Pinterest url, without stating anything else in the file description? Questionable photographs of (relatively) famous personalities

I wondered what your opinion was on this image by the same uploader/photographer, as it appears to fall into a similar- but not identical- category, both legally and in terms of whether we should be keeping this sort of thing on Commons.

It was obviously taken at a red carpet (i.e. very public) event, but it doesn't look like it was consensually posed, and even if it's legal, is this what we're looking for here?

@Ubcule: In the first case, you have a problem user who's been blocked previously and now stripped of his user rights for behavioral issues. I've been deleting his blurry car images for half a decade now. The one I deleted above was problematic from a privacy standpoint and unusable for anything educational anyways. The second is in more of a public place and it's the only image we have of a notable person. It sucks, but I think we can wait to try and find a better alt before deleting it. I honestly suspect that this guy uploads horrid quality photos on purpose, why, I don't know.

In the second case, you've got some plain COM:ADVERT. I won't comment at the DR, because I'd prefer to keep my ability to close it (if I can beat Jcb to it)... lNeverCry 20:46, 19 October 2016 (UTC)

Thanks for the feedback. I understand why the aforementioned car (and celeb) uploader was banned from en.wikipedia; as for Commons, though, while there are some problems (and I understand your frustration), I still think he's operating within good faith... for what that's worth. I don't believe anyone would put that much effort into being so consistently mediocre for malicious reasons...! :-O
At any rate, the Quebecois celeb images seem to be worse (quality-wise) than the recent car ones. Unfortunately, while the car images seem to have had some of their worst tendencies knocked away over many years, it's quite clear that he's very resistant to improvement (and quality control), so I'm not holding my breath!

My name is Andras Malatinszky; I'm one of the sysops on huwiki. We have a user who is complaining about your deletion yesterday of the picture at File:Peregrine falcon in Bükk National Park, Bélapátfalva, 2016 Hungary.jpg. I think he tried to make his point to the nominator but his English is not very good, and the nominator just reverted his comment instead of responding.

Anyway, Globetrotter19's point is that the subject of the picture (an open-air sign showing the image of a peregrine falcon) is PD under Hungary's freedom of panorama (FOP) rules. Under Hungarian law objects permanently installed in the open are not subject to copyright, so if Globetrotter19's description of his picture is correct, there would be no copyvio involved.

I haven't seen the image you deleted, but if the user's description is correct, restoring the image may be the right way to go. (By the way, he says he has uploaded "about a hundred" similar pics, so this is not a trivial question.)

Please take a look and let me know (you can respond right here, I'll watch this page) what you find.

I usually deal with Russian and Ukrainian FoP, so Hungary FoP is a bit new for me. Commons:Freedom of panorama#Hungary mentions "fine art, architectural or applied art" as being OK in a public space, but it doesn't directly mention 2D works like this falcon photograph. It looks like our entry could be more clear and comprehensive, since the English translation of the Hungarian FoP laws mentions photographs directly. The term "applied art" isn't something you run into very often in English. I had to look it up to be sure of the definition. Look, I am unsure what is going on in full. I see bits and pieces. What I do see for sure is you need to calm down along with everyone else. Please do not interpret this as an accusation. I just get a sense that some people want to derail the discussion into an emotional mess that in the end is harmful to commons and really everyone involved.

To this end I would suggest taking a break from admin tools for the time being. If also possible, try not to reply to every remark immediately. I have unblocked PetarM but I want you to know that I didn’t do this to punish you but I did it because I don’t want you to be dragged into a situation that can harm you. Now it is added again under the same file name. I added a new request for deletion, but I am worried that it may not be seen, as the new nomination landed on the old "closed" page. With photos that have been published elsewhere before being uploaded to Commons, we require permission from the copyright holder via the OTRS process. This particular photo is a studio photograph taken by a professional photographer, so that photographer would have to provide permission for a free license under OTRS. The same would be true of pretty much any photo of Sherrie Palm not taken directly by her through a timer or as a hand-held selfie. I would suggest a better quality version of this particular portrait be asked for if this is what you're going with. The above image is barely 1mp (534 × 804 - 284,731 bytes), and is visibly very unsharp. If you've got to go through OTRS, you might as well come up with something a bit higher quality if at all possible. lNeverCry 19:59, 20 October 2016 (UTC)

All files will eventually be removed, mostly by bots. @Blackcat: I think this was a case of 'someone else' making a change (adding {{Non-free album cover}}) that flagged the image for speedy deletion... the work itself seems pretty obviously {{PD-ineligible}} to me... the 'curve' is just a thumbhole (a utilitarian design feature of a CD sleeve) and the short phrases are not copyrightable. I watched file's history being an admin, and noticed it wasn't flagged as such but suddenly deleted. For sure INeverCry had a good reason, but I am curious to know it. Yes I know that the curve is a thumbhole :-) I have the original record, a 33 RPM with red sleeve, and in some countries like Italy that sleeve it was shorter than the record's inner cover; in other countries it is like that, where the blue inner cover is "replicated" on the sleeve to make it appear like it protrudes out of. -- SERGIO (aka the Blackcat) 12:38, 28 October 2016 (UTC)

Sorry INeverCry. I made a mistake. Germany has many states, including Saxony, Saxony-Anhalt and Lower Saxony.
