Goodies, tips, and tricks

To link to an image page without embedding the image, type: [[:File:Foo.jpg]], which produces: File:Foo.jpg.
You may enable gadgets (custom features) for your account.

Wikimedia Commons does not accept fair use content.

We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules.

In addition, fair use is not compatible with our aim as a collection of freely distributable media files.

Therefore, Commons cannot legally rely on fair use provisions.

Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

Hola Gorigori, metí la pata y, como habrás podido ver, revertí mis ediciones (quizá debí haberte dejado un mensaje). El problema es que la web de esta gente utiliza una imagen de CC-NC (no comercial, el dólar tachado), pero en el enlace a la licencia es, realmente, CC-BY, por lo que no hay problema. Escudo borrado[edit]

Hola Gorigori, perdona por no haberte avisado. Suelo hacerlo cuando el caso me parece dudoso pero no cuando es evidente (como me pareció y me sigue pareciendo), utilizando los procedimientos de borrado rápido.

El caso que nos ocupa me pareció evidente (y me lo sigue pareciendo) por las siguientes razones. La imagen que he borrado es una obra derivada, esto es, una fotografía de una imagen, en la que la fotografía (que podría incorporar derechos adicionales) tiene que mantener el copyright de la imagen original (esto es, si tomo el logotipo de una organización y le hago una foto no puedo afirmar que la obra derivada carece del copyright de la obra original). En el caso de los escudos de armas, en general el diseño (o blasón) es público. Esto es, lo que está en el dominio público son las "instrucciones" para elaborarlo (elementos del escudo, disposición, colores...), por lo que si tú dibujas un escudo de armas de tu pueblo siguiendo las instrucciones de la disposición legal correspondiente y el resultado tendrá la licencia que tú quieras. Eso, obviamente, vale para cualquier realización concreta de tal escudo (o sea, que cualquiera que dibuje un escudo, indendientemente de que las "instrucciones" sean públicas, tiene el copyright de ese dibujo concreto del escudo). En el caso de la imagen que has borrado, el copyright lo tiene quien hiciera el original que tú (u otro) ha fotografiado. Por tanto, este tipo de casos es equivalente a cuando alguien toma una imagen de una web. A menos que haya evidencia de que se ha liberado con una licencia libre, es un copyvio como una catedral y, por tanto, de borrado directo.

Por supuesto que puede ocurrir (casi nunca es así) que el original también sea libre, por lo que si se puede sustentar tal afirmación, no hay problema en restaurarlo. Pero como casos de estos ocurren con frecuencia y siempre son copyvios, pues borro sin avisar (lo cual, por supuesto, puede ser un error). En todo caso, para resolver esto, si tienes el permiso de la imagen original, restauraré y esperaré a que incluyas la información. Si es el caso habitual (fotografía de buena fe de algo que se pensaba que estaba en el dominio público), lo dejamos como estaba. En todo caso, te pido disculpas si te ha parecido que no ha sido el procedimiento concreto. Pero si te pasas por las secciones de nominaciones de borrado comprenderás que tratamos de ahorrar burocracia, arriesgándonos a meter la pata en algún caso.
