Re: Images of Cameron Rowland

Hi, I'm just doubling back to make sure you saw the original discussion about the proposed deletion for the images of the artist Cameron Rowland that you uploaded. Per U.S. law, photographs made of people in public do not require consent of the subject for publication in most instances (public being defined as a location that is, in that moment, open to the public, even if it is normally a private space). By agreeing to appear at an event open to the public, as clearly stated on the event's website, Rowland could not reasonably expect privacy, meaning their permission is not required for publication and non-commercial use. Commons rules only stipulate that photographs of identifiable people must respect local laws governing consent, publication, and re-use (see: Commons:Photographs of identifiable people); there is no law requiring consent in this case, unless the image were used in a strictly commercial setting. The Personality Rights warning on both of these images clearly stipulates the bounds of acceptable re-use and the requirement for consent of the subject for commercial uses (see: Commons:Country specific consent requirements). I understand wanting to respect an artist's wishes, but in this case you have formally - and legally - published the images, releasing it under an irrevocable free license; you cannot take that back simply because the subject of the image has invoked a nonexistent right to privacy in a public space. 19h00s (talk) 21:43, 17 October 2023 (UTC)[reply]

Note also that per Wikimedia Commons deletion policy you could request deletion of uploaded images without providing a valid reason up to seven days since upload and only if the images were unused. Also, while courtesy deletion is possible as a community decision, it is highly unlikely that used images are deleted per courtesy. If you think, that you violated some Wikimedia Commons policies (or law) uploading the images, we need an evidence to consider them as a deletion reason.
