I just stumbled onto a few of your chemical diagrams. Thanks for the very nice diagrams!

Now that MediaWiki can display SVG graphics, I was wondering if you would be able to upload an SVG version of your diagrams. Not only would they look good at any resolution, but the file size would be considerably smaller.

Basically there's no wrong point for your Anilin.svg, but I wanted to improve the quality by replacing characters "NH2" with non-outlined text. This enables editing the texts and would help anyone to correct typos (though in this case, no typo presents at the graphic). Another minor change is omitting of blank at right side. SVG structure formulae

Hello Calvero,

Your way of drawing chemical structures is quite similar to mine. I have just one question: How are you editing the margin of the SVGs in inkscape? Hello NEUROtiker,
My method is somewhat complicated and troublesome, as is follows. First, open SVG with Inkscape, and check the actual size (width & height) of the image. Then, open the SVG with notepad (I am using Windows, but Mac may have similar software). Find width="xxx" height="yyy" entry and modify their values to the actual size plus 100px. If there is viewBox="zzz" entry, delete it. Then save & close. Now, the SVG is opened via Inkscape with a background space with the structure size plus 100px. The X- and Y-positions can be adjusted by entering "50" into each boxes (toolboxes on the top).
Document size can also be adjusted via Inkscape menu: File - Document Propaties, then input Custom Size values. This manipulation deforms original image asymmetrically, so the structure's size should be adopted by setting W and H to the original values. In this way, source (thus flie size) of the SVG would get larger, so I like the above procedure.

Problem with ChemDraw and EPS export

Hello again, since I've been using ChemDraw 10 to create structure formulae I experienced problems exporting arrows in EPS files. When I open the EPS with Illustrator the arrowheads are no longer filled and the equilibrium arrows are missing one arrowhead. Do you have any idea what could be the reason for this and how to solve the problem? I am asking you because you are creating your chemical pictures quite similar to how I do. Hrmm... I have no idea for that issue. I am using ChemDraw 8.0, and have never been met that kind of problem. Possibly, something is wrong in ChemDraw. Flunitrazepam.svg

Hi, I noticed that you uploaded Image:Flunitrazepam.svg. It, like all of your work, is a very nice image. I am concerned however that you tagged it with {{PD-ineligible}}. While the structure of a molecule itself is ineligible for copyright, in many jurisdictions a drawing of the structure is. There are design considerations such as angle, spacing, etc. It is probably not a big deal, but could you re-tag it with {{PD-self}} so that it is explicit that you are releasing it into public domain in those locations where it might not be public domain already? Last year, I have got an advice at local wikipedia (jawp) that basically chemical drawings will not be copyrightable, exept for the ones which have complicated structure, color decoration, or text interpretation. Then I thought PD-ineligible is more appropriate for the simple structures. However, honestly speaking, I can not perfectly elucidate whether a chemical structure is copyrightable or not. 今頃お邪魔します。

まず依頼理由はPiracyということでしたが、これは違法コピーの一種を指す言葉ですので、「撮影者自らの投稿であることに間違いがなく、依頼理由で削除するのは不適当」ということになりました。

次にCalveroさんが肖像権について指摘しましたが、証拠が不十分であるということと、辞書などで調べた範囲ではどうも肖像権に問題はない、ということで存続でよいという意見などが出ています。

いずれにせよ存続で問題なかろうということで終了したようです。また、肖像権は人格権(Personal rights)の一種であるという調査結果から、その点について利用者に注意を促すテンプレートが張られました。

Commonsの方針としてそもそも肖像権に関わる制約がつきまとっている画像を削除しなくてよいことになっているのかというのが一つの考え所かなと思います。削除しなくてもテンプレートを貼っておけばいいのだ、ということなら、今回の対処は、問題がないわけではないにせよ、結論としては方針に沿ったものという印象を持ちました。

僕が調べた範囲(非常に限定された範囲でしかありませんが)では、以下の2点が気になります。

  • 肖像権には財産権と人格権と両方の側面があるという説も存在しており、現在のテンプレートで十分なのかどうかが不明
  • 日本では、人格権に関わる肖像権については、無断で撮影されない権利と、撮影されたものを無断で公表されない権利と少なくとも2種類が判例上は認められているようで、仮に前者の権利については問題がないとしても、後者については許可がないために、コモンズに掲載していること自体に問題がありそう

そうすると、やはり方針がどうであれ削除が適当なのではないかということも考えます。

但し、疑問点もあります。

  • 但し、撮影した土地、撮影者がアップロードした土地、サーバーの所在地、主な配信先、などがすべて日本国外である場合に、そもそも日本法の適用がありうると考えるべきなのか、また、仮にありうるとしてそれを理由に削除するべきなのかについては、よくわからない。(僕はこういう国際私法についてはいつまでたっても飲み込めないのですが、コモンズにはつきまといがちな問題ですね。。)

削除が望ましいということであれば、Commons:Deletion_requests/Image:Range-Murata-03.jpgにあるやりとりも参考になるかと思います。ここでは、国際私法にまつわる部分は解決せず、また投稿者は撮影地およびアップロードした土地の法律においては撮影行為やアップロードした行為に違法性がないものの、被写体となった人の事情を斟酌して、法的な理由にはよらずに削除するという結論になりました。。

あとは、日本の肖像権にまつわる情報をコモンズ内なりメタなりに英語で整理しておいて(あるいは日本語ででも)、削除依頼で適宜参照できる体制にしておくというのもよいかなと思いました。まあ、言うは易しですが。。

どうもお疲れさまです。Range Murata の方は本人から削除してほしいという意思が示されたため、というところがやはり大きいように見受けられました(もちろん Tomos さんの詳細にわたる検討・コメントがあってこそ、議論が円滑に進んだものと思います)。これはコンタクトはどちら側からとったのでしょう?
Utada Hikaru の方は、ウィキメディア財団が非営利組織であるから財産権(でよいのでしょうか)の侵害に問われることはないだろう、という結論ですが、ライセンス上営利目的の利用をも許可しているわけですから、画像の利用者と被写体の間に何か問題が生じてもコモンズでは関知しない、つまり自己責任になってしまう、というのはおかしいのではないか、といまさらですが思いました。
このあたりは商標画像と関連するのかもしれない、という気がします。該当する画像には商標であることを注意喚起するテンプレート {{Trademarked}} が用意されており、これを貼付することになっているようです。つまり当該の画像は基本的に自由に利用できるが、商標として使ってしまうと問題が生じるおそれがある、と示しているわけですが、これと同じことを肖像権についても行ってしまって大丈夫なのか、いまひとつわからないです。なんだかフェアユースに近くなっているような。
適用法についてですが、著作権の場合、望ましくは世界中のあらゆる法規についてクリアーされているべきであるが、事実上それを確認するのは困難なので、とりあえずアップロードされた場所の法に従う、とどこかにあったような気がします(たしか…)。ですが、ある法律に照らすと明らかに不適切であることが指摘されたのであれば、それを軽視してよいものかというと、そういうわけにはいかないのではないか、と感じます。世の中には意外と変な法律があるかもしれないので、一概には言えないかもしれないですけれども。
ともあれ、私は肖像権に関しては全然不案内ですので、Tomos さんのご用意くださった文書と参考リンクをまずよく読みこんで、勉強してみたいと思います。

こんにちは。お返事ありがとうございます。Murata Rangeさんの件は、本人に近しい方(公式サイトのウェブマスター)から要請が来たのだと思います。削除依頼のページでのUser:Azunchaさんの説明にそうあるので。あと、法的にはどうあれ、礼節上の配慮からということで撮影・投稿者であったRamaさんが自ら削除を決断されたわけですが、それがなければやっぱり存続になっていたかのではないか、と思います。Utada Hikaruの件は撮影者がコモンズの利用者ではないようですから、投稿者が削除に同意するとしてもそれでほかの人が納得するとは限らないような気もしました。
商標画像にまつわる問題と通じるところがありそう、というのは同感です。日本語版のja:Template‐ノート:Registered Trademarkでちょうど似たような話をしています。
コモンズの削除の方針は、著作権については、Commons:Licensing#Country-specific_laws冒頭にある記載では、全て/ほとんどの国の著作権法上問題のないものに限る、としています。ただ、その少し下では、最低でもアップロードする人に関係する国と、アメリカ法とを考慮する、被写体が著作物(絵画など)であればその作品の公表された国も考慮する、としてあり、閲覧者のいる国については関係があるかどうか明言しない、という形になっているようですね。ja:利用者‐会話:FalcosapiensでFalcosapiensさんがして下さった説明と通じる部分があるように思いました。 Tomos 19:07, 15 September 2007 (UTC)[reply]

It appears that there might be an error in the stereochemistry in the image batrachotoxin2.svg that you created. I added your image to the batrachotoxin page on the English Wikipedia and the editor Devvochem replied on my talk page (link), "the stereochem of the methyl near the ester at the top is reversed (R instead of S)". Hi Calvero. Antony Williams of ChemSpider has started a major fact-checking project over at WP, and is checking every chembox and drugbox for inaccuracies.
