ファイル:木村庄助.jpgに関して、

先にノートに出典並びにライセンスを記述したのですが、まだ表示されていますので、再度記述します。
写真の出典は木村庄助著・木村重信編「木村庄助日誌―太宰治『パンドラの匣』の底本」編集工房ノア (2005/12)発行の巻頭に搭載されたもの。
実弟である木村草弥氏が遺品として所持していたものを巻頭口絵として収録。
この度、Wiki/木村庄助に写真を掲載してほしいとの木村草弥氏より依頼を受けて、bittercupが代行した次第。
その証明として木村草弥氏のサイト「木村庄助日誌」をご覧願います。

著作権に関してのQ&Aに、「他の人の製作した画像に、私が修正を加えたものや、原本からスキャンした画像をアップロードしてもよいのですか？
その作品を、どのようなライセンスの元で発表するのかを決定する権利は、著作者、あるいは著作者にライセンスの付与を一任された人物にのみ認められます。」とありました。
上記を満たしていると思われるのですが、未だに削除されることもなく、警告文が記載されたままで、困惑しています。

投稿画像のカテゴリ記載について。

貴方が投稿した日本の大阪府内にある神社の画像についてですが、新規投稿時のカテゴリの記載に問題があった（適切なカテゴリに分類されていなかった）ためお知らせします。

Commonsには日本語で記載したカテゴリは存在しません。またはリダイレクトとなっています。

• [[Category:Shinto shrines]] ：下記参照

ここへは通常はカテゴライズしません。 Category:Shinto shrines カテゴリページ内に「個々の神社の画像はこのカテゴリに含めず、県別/市別のサブカテゴリの方へ入れて下さい。」と記されております。

中間カテゴリとして [[Category:Shinto shrines by prefecture]] があり、さらに下位に47個のカテゴリがあります。例えば大阪府内にある神社の場合、[[Category:Shrines in Osaka prefecture]] にカテゴライズすることになります。

このコメントを記載した以前に貴方が投稿した画像については当方で修正しておきました（所在地の市町村のカテゴリも付加しました。）ので今後投稿する時の参考としてください。最初から適切なカテゴリに分類すれば他者の手を煩わせずに済み、画像の検索性も向上すると考えます。--Kansai explorer (talk) 13:11, 25 January 2011 (UTC)

• （追記 ）寺院や古墳、旧跡なども上記と同じ趣旨で適切なカテゴリーへの修正をお願いします。

• 　Category:Buddhism　→ 「正しいサブカテゴリを付け加えて下さい。」と書かれています。適切な下位カテゴリへ書き換えしてください。
• 　Category:Old tomb　→ 適切な下位カテゴリへ書き換えしてください。 （大阪府の古墳なら Category:Kofun of Osaka prefecture があります。）
• 旧黒田藩長屋門の画像 -- Category:Osaka → もっと適切なカテゴリがあります。（大阪市中央区なら　Category:Chuo-ku, Osaka）
• Category:Simamoto, Osaka → Category:Shimamoto, Osaka
• Category:Takatuki, Osaka → Category:Takatsuki, Osaka

など手抜きと思われても仕方がないような対応や単純な間違いも見受けられます。多くの画像を投稿されるとそれだけ他人が修正の手間を取らされることになります。きちんとリンクされているかどうか確認して投稿をお願いします。厳しい言い方なっているかと思いますが、期待をしておりますので宜しくお願いします。（特に返答は不要ですので修正をもって対処願います。）--Kansai explorer (talk) 13:24, 1 March 2011 (UTC)

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.

Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]

[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

• 富士正晴の顔写真を掲載するにあたり、富士記念館の中尾館長に相談した所、ご長男に許諾をということで、「父のいかにも”らしい”写真はプロの手になるものばかりで、著作権の問題がでてきます。記念館の「富士正晴アルバム」の表紙を撮影して、こういう資料があるという説明で載せていただくと、結果的に顔写真をのせることになりますが・・・」との返答を頂き、中尾館長の了解のもと、掲載ししました。
  しかし、これも手紙と直接の会話であるので、説明文に書き込んでも”作文”と見做されて”承諾が第三者に確認でき”ないだろうと思い、”明らかに富士正晴記念館が作成した資料の表紙をスキャン”した次第です。
  「あとは、押入れの中のプライベートに撮影したものを探してみます」と申し出てくれていますが、これも”承諾が第三者に確認できない”可能性が大です。このような場合、富士記念館やご長男の承諾を第三者に確認できる方法はどのようなものがあるのでしょうか？ご教授頂ければ幸いです。--Bittercup (talk) 22:56, 20 September 2011 (UTC)

• ja:Wikipedia:自著作物の持ち込み#著作権を侵害していないことの証明方法 や ja:Category:ウィキペディアと著作権にリンクされている項目などをよくお読みになり、しかるべき対処をなさってください。jawpで似たような事例でja:Wikipedia:削除依頼/ファイル:ヅカむすめのアメリカ日記・表紙画像.jpgが審議されました。なお、無料配布物かどうかは著作権には関係ありません。著作権・ライセンス関係についてまだよくわからない時点においては、自身が権利を持っていないメディアをスキャンしてアップロードなさることは問題を起こさないためにも控えるべきと考えます。--Kansai explorer (talk) 13:41, 21 September 2011 (UTC)
• 富士正晴の館長にこの顛末を申し上げると、「他の資料館・文学館への貸出でも口頭での承諾で済ませている。いちいち承諾したことを官報にでも公示しろと云うのか？」と大層ご立腹。館長職は名誉職で、市職員ではないので、ベテランの市広報担当者に相談すると、「市のホームページにWikipediaに掲載している旨載せることはできない。この「文学アルバム」に関しては写真の撮影者の承諾を得ており、著作権法（権利の目的とならない著作物）第13条　次の各号のいずれかに該当する著作物は、この章の規定による権利の目的となることができない。4．前２号に掲げるものの翻訳物及び編集物で、国若しくは地方公共団体の機関、独立行政法人又は地方独立行政法人が作成するもの」に該当し、問題にしていることがおかしいとのこと。それでもダメとなれば、後はご遺族の家族写真をお借りすることになりますが、ご遺族から承諾したことを第三者に知らしめる術が分かりません。--Bittercup (talk) 12:40, 29 September 2011 (UTC)

  • 私が申したいのは、このファイルがCommons:プロジェクト基準#自由な転用条件にあるか、公有であること をクリアしているのか甚だ疑問だということです。

まず「公有であること」についてですが、同様の事例がCommons:井戸端#行政の著作物の転載についての質問にて言及されていると申しましたが、今回の事例は日本国著作権法第13条2号において保護対象外とされる 「周知徹底させることを目的とする」 対象に当たらないと考えます。電子ネットワークの知的所有権法 FAQにも、 「必ずしも一般に周知させることのみを意図しないものは、学術に関する著作物として著作権法の保護を受けることになる」 と記載されています。そこでは文章について書かれていますが、写真・イラスト等意匠についても同等と考えます。従いましてこのファイルは日本国著作権法第13条2号における保護対象となり、 {{PD-Japan-exempt}} のライセンスは虚偽である可能性があると考えます。

また、「自由な転用条件」 ですが、権利を保有する茨木市がこのリーフレット表紙を 「（商用利用を含め）どんな目的での無断転用も甘受する」　「翻案（元著作物の趣旨を生かしたまま改変する）を甘受する」 ことを承諾するか不透明ですし、上記にて、ホームページ上で掲載している旨載せることはできないとのことですので正式な許可の第三者による確認は不可能です。

上記「電子ネットワークの知的所有権法 FAQ」の冒頭に「雑誌の表紙の著作権」についても記載されておりますが、当然著作権は発生（日本の著作権法では無名または変名の著作物は権利が発生してから50年保護されます）し、こういったものの転載は改変を意図しないものでしょうから、Commons:プロジェクト基準 をクリアしないと考えます。

以上のことから、残念ですが私はこのファイルが直ちにウィキメディアに受け入れられるものではないと考えます。当方にてCommons:Deletion requests/File:Fuji-album.jpg にて削除依頼しましたので今後（依頼理由が妥当かも含めて）コミュニティーの審議を仰ぐことになります。

最後に、自身が著作権を有さず、問題がないかどうか権利の状態をきちんと確認しないままアップロードして、今回のような問題となった場合に他の方に余分な手間をかけさせ、（既に問題とされていることに当惑されているようですが）著作権所有関係者の方々に迷惑をかけることになってしまいます。 今後はぜひ注意していただきたいと思います。--Kansai explorer (talk) 15:50, 6 October 2011 (UTC)
