Peut-être pas, sauf quand on aime les jeux de mots. En l'occurrence, c'est parce que Finoskov finasse avec les termes, concepts etc. de la protection des MH qu'il donne du fil à retordre à des contributeurs comme moi, obligés d'annuler sans cesse ses modifications. On a affaire à un troll malin qui se donne les apparences d'un contributeur soucieux d'exactitude mais qui n'en fait en réalité qu'à sa tête. Pour clore, en ce qui me concerne, cette question : Même si on aborde le problème selon le point de vue d'Edelseider, comment soutenir q'un objet mobilier (base Palissy) n'est pas protégé dès lors qu'il n'est déclaré comme tel par l'administration des Monuments historiques que comme PARTIE intégrée d'un TOUT protégé en tant qu'édifice bâti (base Mérimée); alors que justement cette administration prend la peine d'éditer une fiche Palissy spécialement dédiée pour préciser que cette PARTIE est effectivement protégée ? C'est tout bonnement contraire au sens commun.

Bonjour Anthere, comme je te l'ai expliqué en réponse à ta remarque sur ma page de discussion, l'avis subjectif de Finoskov ne devrait pas le faire le poids face aux normes et conventions légales qui, d'ailleurs, lui ont été expliquées par d'autres que moi. Le résultat de l'inaction des administrateurs ( le refus de bloquer le troll ), c'est qu'il n'en fait effectivement qu'à sa tête. Bonsoir, voici la liste officielle sur le site du Ministère de la Culture des objets base Palissy classés ou inscrits du département du Bas-Rhin (67). Vous verrez que les "objets" que F s'entête à déclarer classés n'y figurent pas, et pour cause : ils ne sont pas classés ou inscrits à l'inventaire des Monuments historiques. Les objets classés ou inscrits sont affublés d'un code commençant par P et jamais par I. Parcourez la liste, vous verrez vous-même. Avis sur Monuments historiques

Bonjour,

Merci de m'avoir demandé mon avis qui n’est pas un avis expert, puisque j’ai buté sur le même problème il y a quelque temps.

En tout cas, ce que j’ai compris et ce que j’applique depuis quelque temps, c’est qu' un monument ou un objet classé ou inscrit comporte une fiche commençant par PA (architecture) ou PM (mobilier). Ces fiches apparaissent sur une recherche en cliquant sur MH (monument historique) dans l’ascenseur « domaine de recherche ».

Là où cela se complique, c’est que certains objets comme des portails, chapiteaux, fresques, bas-reliefs, vitraux, plaques funéraires… comportent une indication « classé au titre immeuble » et n’ont pas de fiche PM.

(Soit, dit en passant, les orgues classées sont un mauvais exemple puisqu’elles comportent toujours des fiches PM.)

D'après les explications du Ministère, il faut comprendre par « immeuble », non pas « bâtiment » mais objet immobile (qui fait partie intrinsèque d’un bâtiment et qui n’est pas censé être déplacé). Réf : dossier d’introduction (http://www.culture.gouv.fr/culture/infos-pratiques/guides/dapa-protection/index-protection.htm)

Et c’est là que la confusion s’installe : est-ce l’objet ou le bâtiment qui est classé ? En tout cas, je n’ai pas trouvé d’objet « classé au titre immeuble » sans qu’il fasse partie d’un monument classé.

Ce qui me gêne, c’est que les objets « classés au titre immeuble » sont classés, puisque c’est dit dans l’expression, mais qu’ils ne figurent pas dans les listes des objets classés.

Solutions possibles :

-créer dans le Template Palissy un nouveau type=classé-au-titre-immeuble

-ou rajouter :

This object is indexed in the base Palissy, database of the French furniture patrimony of the French ministry of culture, under the references IM000000 and classé-au-titre-immeuble.

mais ces objets n’apparaîtront quand même pas dans les listes des objets classés.

-ou créer d'autres catégories « Objets Monuments historiques classés au titre immeuble », « Objets Monuments historiques classés », « Objets Monuments historiques inscrits »

(Il n’y a pas besoin de créer un type=inventorié car tous les objets de la base Palissy sont, soit inscrits, soit classés, soit inventoriés par défaut.)

En conclusion : Il serait quand même bon de trancher afin d’obtenir une cohérence, si on veut que WIKIMEDIA devienne une référence sérieuse. Si tout le monde fait comme il pense, c’est le bazar ! Ne pourrait-on envisager un « Bistro Monuments historiques », avec explications, mode d’emploi et discussions ?

Objets mobiliers immeubles par destination M.H.

Bonjour à tous (Anthere, notre modératrice, VIGNERON, Edelseider et peut-être d'autres). J'espérais en avoir fini avec cette question, mais il me faut encore préciser les choses apparemment.

1- Par goût et par fonction, j'apprends avec plaisir chaque jour et de tout un chacun, mais pas au point d'abandonner tout esprit critique sur ce qui m'est dit.

2- Même un administrateur de Wikimédia Commons a le droit de se tromper de bonne foi.

3- La loi française n'est pas exempte de nombreuses subtilités que l'on ne saurait qualifier de finasseries et en l’occurrence le sujet qui nous préoccupe est soumis d'une façon particulière au code du patrimoine (refonte de la loi du 31 décembre 1913) et d'une façon générale au code civil (les objets mobiliers protégés étant soumis à ses dispositions générales comme les non protégés).

4- Affirmer sans ambages qu'un objet mobilier déclaré protégé par l'administration compétente (dossier de protection à l'appui référencé PM) n'est pas vraiment protégé sous prétexte qu'il l'est au titre immeuble, est pour le moins surprenant. Manifestement c'est la mention au titre immeuble qui vous pose problème et j'essaierai un peu plus loin de vous expliquer pourquoi.

Commençons par le code du patrimoine:

Art. L. 622-1 Les objets mobiliers, soit meubles proprement dits, soit immeubles par destination, dont la conservation présente, au point de vue de l'histoire, de l'art, de la science ou de la technique, un intérêt public peuvent être classés au titre des monuments historiques par décision de l'autorité administrative. Les effets du classement subsistent à l'égard des immeubles par destination classés au titre des monuments historiques qui redeviennent des meubles proprement dit.

Art. L. 622-19 Les dispositions du présent titre sont applicables à tous les objets mobiliers, soit meubles proprement dits, soit immeubles par destination, régulièrement classés au titre des monuments historiques avant le 4 janvier 1914.

Trois choses à retenir dont l'une sera plus précisément abordée dans le code civil: la troisième est que, contrairement à ce que vous avez écrit lors d'une discussion précédente, des objets ont été classés avant 1914; la première est que les objets mobiliers qu'ils soient meubles ou immeubles peuvent être classés (ou inscrits d'ailleurs), la rédaction de l'article étant primordiale car elle explique votre méprise (j'y reviendrai plus loin), la troisième est qu'un objet mobilier immeuble par destination peut redevenir meuble proprement dit et rester protégé, ce qui confirme de facto mon argumentaire.

Examinons maintenant les dispositions du code civil qui s'imposent aux particuliers comme vous et moi mais aussi à l'administration des M.H. Il s'agit de lois générales non destinées spécifiquement aux objets M.H. mais à tous les objets mobiliers en tant que biens. C'est les notaires qui maîtrisent le mieux ces notions puisqu'elles sont leur quotidien.

Le code civil dispose que tous les objets mobiliers (protégés ou non) sont obligatoirement répartis:

- en meubles par nature (les plus fréquents): choses inanimées pouvant changer de place par l'effet d'une force étrangère (art.528 du Code Civil) : tableaux, statues, tables, chaises, fauteuils, orfèvrerie, tissus (vêtements, tapisseries, …), chaires à prêcher, armoires, objets usuels, objets scientifiques;

- en immeubles par destination: biens qui sont meubles de leur nature mais considérés comme immobilisés à titre d’accessoire d’un immeuble par nature (art. 524 et 525 du Code Civil) : peintures murales, retables, vitraux, papiers peints.

Il s'agit donc, dans le deuxième cas, d'un statut juridique artificiel sous lequel est placé l'objet qui reste un objet mobilier sans devenir un immeuble au «sens Mérimée» du terme.

Votre méprise vient donc de la rédaction ambiguë des fiches Palissy (les M.H. disent dossiers). En effet il est indiqué protégé au titre objet ou au titre immeuble et c'est l'expression «au titre» qui fait croire que l'élément protégé est l'objet ou l'immeuble, ce qui n'est évidemment pas le cas. Il vaudrait mieux écrire: objet, meuble ou immeuble par destination (statut juridique), classé ou inscrit (statut M.H.).

En une phrase comme en cent, meuble ou immeuble qualifie l'objet mobilier et non sa protection. Et un immeuble au sens où vous l'entendez (édifice bâti contenant ou comprenant l'objet) est protégé dans la base Mérimée alors que l'objet immeuble par destination l'est bien individuellement par la base Palissy.

J'espère vous avoir convaincu même si au premier abord cela a l'air tiré par les cheveux. Autrement il ne vous reste plus qu'à interroger l'administration.

Que les autres contributeurs excusent l'exhaustivité plutôt didactique voire rébarbative de cet article, mais il me semble qu'il fallait essayer d'en finir avec cette trop longue histoire; moi en tous cas je n'y reviendrai plus. Sauf pour transmettre l'éventuelle réponse d'un responsable M.H. à qui j'ai posé la question subsidiaire mais beaucoup plus aléatoire des fiches d'Inventaire Général du Patrimoine Culturel (références IM) signalant une protection sans fiche de protection correspondante et que la majorité d'entre nous considère comme erronées.

P.S.: Même si ce n'est peut-être pas le lieu, je suis entièrement d'accord avec Ralph Hammann pour plaider pour une refonte des "Template Palissy", mais il me semble qu'il conviendrait plutôt de changer carrément le bandeau Palissy non protégé mais répertorié à l'I.G.P.C., dans sa syntaxe comme dans son libellé. En effet actuellement les erreurs d'écriture assez fréquentes de la syntaxe des bandeaux classé & inscrit déclenchent automatiquement l'apposition du bandeau dit répertorié au lieu d'un signal d'erreur; d'autre part cela gonfle artificiellement la catégorie de Maintenance Palissy without type parameter‎ qui contient de ce fait tous les éléments erronés plus certains éléments IM de l'I.G.P.C.

Objets mobiliers de l'Inventaire Général du Patrimoine Culturel signalés par leur fiche IM comme protégés mais sans fiche de protection PM

Voici comme promis la réponse intégrale du responsable M.H. Alsace interrogé.

Monsieur, J’essaie de répondre de manière aussi précise que possible aux questions que vous vous posez et que se posent vos correspondants de Wikimédia.

La base de données Palissy est alimentée à la fois par les services de l’Inventaire du Patrimoine (ancien Inventaire général des monuments et richesses artistes de la France, dépendant depuis 2007 des Conseils régionaux) et par les services chargés des Monuments historiques (relevant de l’Etat).

Je ne peux vous répondre qu’en ce qui concerne l’Inventaire du Patrimoine (je ferai suivre votre mail à ma collègue chargée de la documentation à la DRAC Alsace, qui pourra compléter votre information en ce qui concerne les notices relatives aux objets protégés au titre des MH.

En ce qui concerne les notices de l’Inventaire d’Alsace, l’indication concernant la protection a toujours été consignée dans la fiche Palissy sur la base de listes régionales des objets protégés, fournies par la DRAC Alsace, à jour et faisant foi.

Cette indication de protection est donc toujours fiable, pour le moment où la fiche a été rédigée ; ainsi, dans le cas de la fiche IM67008559, vitraux du chœur de l’église de Walbourg, la ligne « Date enquête » est 1992), je confirme bien volontiers que les vitraux médiévaux du chœur de Walbourg, qui dans la fiche Inventaire de 1992 sont notés comme classés MH, bénéficient bien de cette protection.

Je laisse à ma collègue de la DRAC Alsace le soin de vous répondre à propos de l’absence dans la base Palissy d’une notice MH concernant ces mêmes vitraux de Walbourg.

Pour les fiches Inventaire (« © Inventaire général ») : il faut souligner aussi, de manière plus générale et pour être complet, que les fiches Inventaire de la base Palissy ne sont pas mises à jour par les services de l’Inventaire du Patrimoine, en cas de modifications (il ne serait pas possible de poursuivre les opérations d’inventaire sur le terrain, à l’échelle d’une région, en tenant à jour les fiches déjà existantes ; ces fiches reflètent l’état des connaissances sur le patrimoine au moment de leur rédaction).

Dans le cas où une œuvre a fait l’objet d’une protection MH (inscription, classement) postérieurement à la rédaction de la fiche, cette protection n’a pas été ajoutée à la fiche Inventaire existante. Il convient donc de se reporter aux listes régionales des protections MH, tenues à jour, qui font foi (en pratique, pour l’Alsace, contacter la DRAC Alsace, Service des Patrimoines). Ma collègue de la DRAC pourra vous en dire plus à ce sujet.

J’espère vous avoir répondu en ce qui concerne les fiches Inventaire de la base de données Palissy, et reste à votre disposition pour vous fournir les compléments d’information qui vous seraient nécessaires.

Merci pour cette lettre très intéressante. Il en ressort que M. Meyer ne sait pas pour quelle raison les vitraux de Walbourg ne figurent pas dans la liste des objets protégés PM mais que, selon lui, cette liste fait foi. Conclusion : les vitraux, puisqu'ils ne figurent pas dans cette liste ( qui fait foi ) ne sont pas classés. Ce qui contredit d'ailleurs les propos que M. Meyer tient plus haut à propos du classement IM ( pas PM ). D'où la deuxième conclusion : tout ceci n'est pas concluant et il faut effectivement attendre les explications de sa collègue de la DRAC. J'ai envoyé les photos sans toutefois les visualiser. En fait, ce sont les photos d'un styliste (Jean Yves Tchinda) qui avait décidé lors de mon intervention au Forum IAM de participer au concours mais ne pouvant pas prendre part à la formation, il m'a demandé d'envoyer simplement les photos à partir de mon compte. Je m'excuse vraiment. Lors de la formation ce samedi, Ce sont ses photos que j'ai utilisé comme exemples pour expliquer aux participants la procédure.

Tu peux supprimer les photos avec copyright.

I will be honest with you... I consider that since I organize this contest, I also need to avoid giving too much work to commons admins. I see it as a personal duty. Accordingly, the past 3 years, I have been doing routine clean ups of most obvious "not appropriate" pictures. Mostly awfully blurry ones of no interest, low quality selfies and easy to track copyvios. I do not delete all the pictures that could typically be the object of discussion. I am bold... but within reason.

Well... as far as I can tell, you are the first one to object to this. So... since you ask... no, I do not feel so happy to undelete blurry uninteresting selfies, but do not hesitate to list them all on the "request for undeletion", I or another admin will consider having a look at them and restoring them if you feel they should be discussed.

As for my routine clean-ups... if you can find a couple of other editors to object to it, I'll stop and let you guys do the job. It will save me time. But if you are the only one to see a problem with it... I'll keep doing it. Okay ? Anthere (talk)

I have not in anyway objected to your cleanup. I have never stated here or anywhere that you should stop your cleanup. In fact, I said I noticed that you are trying to do some cleanup on the images uploaded for the contest, which is a good thing. How does this translate into objecting cleanup? If you feel that your deletion of "Out of scope" files which should normally be listed at Commons:Deletion requests is within Commons:Deletion policy, I won't say anything more than what I already said above but please note that "out of scope" is not a speedy deletion reason. So I went to read the policy... and I have a different interpretation than you about it
"Out of scope" files/pages should normally be listed at Commons:Deletion requests"

I understand normally as generally. This leaves space for a bolder interpretation that would be "delete in sight". Which is actually outlined in the policy next point...

However for files/pages which very clearly fall outside of Commons' project scope, the tag {{Speedydelete}} can be used. Don't forget to add a reason like this: {{speedydelete|Reason}}. If there is any doubt, list at Commons:Deletion requests.

meaning ... the suggestion that, when it is very clearly out of scope, it can be tagged speedy delete means it can be deleted on sight. Being an admin... it makes no sense for me to tag speedy delete images, as I can delete them myself. If I were actually putting a speedy delete tag... it would mean I am actually asking an admin to review my own decision, which would be the equivalent of listing them on Deletion Request page. Logically, I would only do that in case of doubts.

in short... contrariwise to what you wrote above... speedy deletion is also appropriate for clearly out of scope images, not only for copyvios and my own pictures. According to policy, there is nothing wrong doing it. Best Anthere (talk)

I did understand your argument but you will agree with me that due processes such as issuing standard deletion notices, explaining to users why their images were deleted or template the images to be deleted were not followed. This sounds good. I feel that local organizers should assist with cleanup. I don't think this has happened in the past, thou. I think the WLA team should do something different this year. I don't know if local organizers have been briefed on the importance of cleanup during or after a contest, I think this is necessary. Local organizers should assist with cleaning up images uploaded from their own country. It's also a good way to engage local organizers. I also feel that WLA needs something like this, or this one for the contest. I found this as well. I don't know if you have that in mind, but I am sure you could get it in less than a week. We have explicitely decided to not have a separate mailing list actually. The African ML is a rather low traffic ML and we hope to get more africans to join it. So we decided to use this one to communicate. That's was not a random decision but a thought decision.

Clean-up... I am actually not really able to say whether some local organizers participated in clean-up or not. Maybe they did... maybe they did not... I do not follow their tracks so I can not really say. I know that some countries make the effort to submit their country images for Good Image and I think that is really great. In some other countries... I still have to explain them how to upload an image or how to categorize it... so I think the cleanup task is beyond their current skills. I think the teams are quite small and I'd rather they focus in local outreach during the event than in wiki clean up which everyone else can do. But I asked them previous years to think of properly describing the images as well as categorizing them in details. This is a knowledge they have that other wikipedians do not. I have also asked them to help "reuse" the pictures in the articles (again, this is a knowledge they have that other participants do not). So... generally, I think you are right. Le projet se veut une célébration de la diversité visuelle de l'Afrique sur Wikipédia et ses projets frères. Vous pouvez augmenter l'impact de Wiki Loves Africa des façons suivantes:

• Fournir d'avantage de photos !
• Ajouter des catégories à vos images afin que les utilisateurs les trouvent plus facilement. Voici comment faire: Commons:Catégories.
• Vous pouvez également améliorer les descriptions de vos images pour faciliter leur compréhension et leur réutilisation.
• Ajouter vos images dans un article existant sur Wikipédia.
• S'il n'existe aucun article correspondant à ce qu'illustre votre photo, pourquoi ne pas envisager de créer un nouvel article sur Wikipedia ?
• Vous pouvez même rejoindre un groupe d'utilisateurs locaux. Vous pouvez trouver les groupes déjà existant ici: groupes Wikimedia en Afrique

hi. Samuel, our friend u:BevinKacon (obviously an account from an oldbie editor hiding under a new account - just saying) is raising questions regarding this screenshot I uploaded a few years ago when we were on the Kumusha project together. You will certainly remember those two visuals you made when advertising this project. How do you think we can best acknowledge and answer to the request of Bevin ?
