General disclaimer[edit]

The Wikimedia Foundation is a foundation under the law of the US federal state of Florida. As such, its must comply with the laws of Florida, US. Additionally, Wikimedia's servers are physically located in Florida and Amsterdam.

Illegal Content[edit]

Since we are committed to complying with all laws and regulations, there are many classes of content which not permitted on Wikimedia servers.

For example, Commons does not host:

  • Photographs that would be illegal to host because they constitute 'child pornography' as defined by relevant law.
  • Photographs that would be illegal to host because they contain individuals under the age of majority.
  • Photographs that would be illegal to host because the individual did not (or could not) give the necessary consent as required by law.
  • Images that would be illegal to host because of the work's copyright status.

Project scope[edit]

Wikimedia Commons is a media file repository making available public domain and freely-licensed educational media content (images, sound and video clips) to all. It acts as a common repository for the various projects of the Wikimedia Foundation, but you do not need to belong to one of those projects to use media hosted here.

What commons is not[edit]

Although Commons is not your personal free web host and Commons is not an amateur porn site also keep in mind that Commons is not censored.

The policy of "Commons is not censored" means that a lawfully-hosted file, which falls within Commons' definitions of scope, will not be deleted solely on the grounds that it may not be "child-friendly" or that it may cause offense to you or others, for moral, personal, religious, social, or other reasons.

Photographs of identifiable people[edit]

The consensus on Commons (subject to any local law to the contrary) is that the subject's consent is not usually needed for a straightforward photograph of an identifiable individual taken in a public place, but is often needed for such a photograph taken in a private place.

If you find a private photograph of yourself posted here without your consent, you do not need to go through the usual process to propose deletion of the file: you may contact the Wikimedia Foundation directly and request an "office action" to remove the image quickly and completely without public discussion.
