This file depicts the coat of arms of a German Körperschaft des öffentlichen Rechts (corporation governed by public law). According to § 5 Abs. 1 of the German Copyright law, official works like coats of arms or flags are gemeinfrei (in the public domain). Since the Federal Republic of Germany is the legal successor of the Weimar Republic as well as of the "Third Reich" this law is also applicable to flags and coat of arms promulgated before 1945.
Note: The usage of coats of arms and flags (especially those of the "Third Reich") is governed by legal restrictions, independent of the copyright status of the depiction shown here.

The object shown falls under the Exhaustion doctrine under U.S. law. Under the doctrine, once an authorized sale of a patented article occurs, the patent holder's exclusive rights to control the use and sale of that article are said to be "exhausted," and the purchaser is free to use or resell that article without further restraint from patent law. (17 U.S.C. § 109). See also First-sale doctrine. The first-sale doctrine creates a basic exception to the copyright holder's distribution right. Once the work is lawfully sold or even transferred gratuitously, the copyright owner's interest in the material object in which the copyrighted work is embodied is exhausted. The owner of the material object can then dispose or make use of it as he sees fit.

(BGH, Urteil vom 19. Januar 2017, I ZR 242/15)
According to a decision of the German Supreme Court the copyright status of the photographer is not restricted. The fact that a photographer is referring to his right of "Panoramafreiheit" does not restrict his own copyright status concerning the photography taken. (BGH ; January 19, 2017, I ZR 242/15)
