この日本を法管轄とする写真画像は、1956年12月31日までに公表されたか、1946年以前に撮影され、起算日から10年以内に公表されなかったものであるため、日本の旧著作権法第23条及び著作権法附則第2条の規定により著作権の保護期間が満了しています。これは全世界に適用されます。

写真については、新法で「平成9年1月1日時点で公表後50年を経過したものは消滅」という規定もある。（改正法の施行日平成9年3月25日において、著作権が現に存在する写真の著作物の著作権は、著作者の死後50年となっており、1/1起算であるため。）-平成8年法律第117号附則第2項及び第3項

第55条（写真の著作物の保護期間）　写真の著作物の著作権は、その著作物の公表後50年（その著作物がその創作後50年以内に公表されなかつたときは、その創作後50年）を経過するまでの間、存続する。
2 第52条及び第53条の規定は、写真の著作物の著作権については、適用しない。

旧法は発行後13年（この間に発行しなければ創作後13年）。ただし、この条項も改正されており、改正前は10年。実質は、13年適用前に新法に移行しており、改正後の年数が適用される事例はない。

テンプレートで書いてある「This photographic image was photographed before December 31st 1956, or photographed before 1946 and not published for 10 years thereafter」というのは、「この写真画像は、1956年（昭和31年）12月31日までに撮影されたか、1946年（昭和21年）以前に撮影され、起算日から10年以内に公表されなかったものである」になります。そんな意味をすればちょっとおかしいですね。最初のphotographedの代わりにpreparedかproducedを使えばもっと適当だと思います。 - Sekicho 03:24, 27 February 2007 (UTC)[reply]

旧法の原文は、

Neither this license (Template:PD-Japan-oldphoto) nor the other "Public Domain Japan" license (Template:PD-Japan) covers public domain Japaneses movies uploads. But does this one, at least, allows to upload pictures from pre-1953 Japaneses movies ?

On a related note, I just asked on the Help Desk if pre-1953 Japaneses movies are public domain at all, and if so, if they are ok for commons and if we need a special PD license template for them. カバーしている範囲が狭いのでは？[edit]

日本の（旧）著作権法では、1950年に製作され1965年にはじめて発行された場合、1960年いっぱいで保護期間が満了しているはずではないでしょうか？　そして、この場合が現在の規定ではカバーされていないようですが、なぜなのでしょうか？

現在、著作権が消滅している場合として、次の二つの場合があげられています：

(A) published before December 31st - 1956（1956年（昭和31年）12月31日までに公表（発行）された
(B) photographed before 1946 and not published for 10 years thereafter - 1946年（昭和21年）以前に撮影（製作）され且つ起算日から10年以内に公表されなかった

おそらく、「1946年（昭和21年）以前に撮影（製作）され且つ起算日から10年以内に公表されなかった」というのが、さらに細分される二つの場合を混同しているのではないかと思います。一つは、10年以内に発行されなかったのであれば、旧法23条1項と2項後段により、1956年製作の写真まで1966年以前に保護期間満了となっているはずです。もう一つは、1946年以前に製作されたのであれば、発行の有無や時期に関わらず保護期間満了となっているのではないでしょうか（10年以内に発行したのであれば1956年以前が起算点となり、10年以内に発行したのでなければ1946年以前が起算点となるため）。

したがって、次の三つの場合に著作権が消滅しているはずだと、私は考えます：

(A') published before December 31st 1956 - 1956（1956年（昭和31年）12月31日以前に公表（発行）された
(B') photographed before December 31st 1956 and not published for 10 years thereafter - 1956年（昭和31年）12月31日以前に撮影（製作）され且つ起算日から10年以内に公表されなかった

ほんとうは(C)は不要ですが（1946年以前に撮影されていれば(A')か(B')に必ず該当するというのが根拠なので）、独立して入れておいたほうが分かりやすいと思います。

一つの例外を発見してしまいました。まれなケースだと思いますが、日本で発表後30日以内かつ1923年から1963年までの間に米国でも発表され、さらに著作権の表示があり、その更新手続きも行われている場合、米国では早くとも2019年にならないとパブリックドメインにはなりません。その著作物の本国は日本と米国の両方にあると見なされるためです。著作権の継続理由はURAAによるものではないため、これが明らかになった場合は確実に削除の対象になります。この例外について注意文を加えました。 Darklanlan (talk) 03:58, 15 December 2016 (UTC)[reply]

2点だけ指摘させてください。

これはどんなテンプレートについてもいえますが「日本を法域とする」という表現は日本関係のテンプレートでしか見ません。日本語版WP記事では、法域とはざっくり言ってどこの国の法律を適用するか？ということのようですが、ある著作物にどこの法律を適用するかというのは使う国でしかありません。作成された国がイギリスだろうとアメリカだろうと日本で使えば法域は日本ですし、その逆も同じ通りです。ここは「日本を本国とする」と変更してはいかがでしょうか？
全体的に文章のみで構成されており、可読性に欠けるかと存じます。ここは箇条書きでわかりやすくしましょう。つまり、

日本を本国とするこの写真画像は、美術上の著作物の複製物でなく、かつ、以下の条件のどちらかに合致するため、日本の旧著作権法第23条及び著作権法附則第2条の規定により、日本での著作権の保護期間が満了しています。

@Kkairri: 貴重なご意見ありがとうございます。既存のテンプレを書き換える考えはありませんでしたが、確かに冗長で読みにくい文章だと思っていました。「法域」という言葉はCommons:Copyright rules by territoryのterritoryから来ているのかもしれませんが、ご指摘の通り country of origin （原産国）の意図を組み込んだ方がいいでしょう。ご提案を盛り込みました。また、既にアップロードされている画像で撮影日の記載はあっても公表日の記載がないものがあり、ライセンスの判定に困ることがあったため、公表日の記載を求める注意文を追加しました。 Darklanlan (talk) 16:33, 19 December 2016 (UTC)[reply]

Found an error in the text. Publication date requirement[edit]

This edit should not have added a requirement for a publishing location unless the image is from after 1947. If the image was verifiably taken before 1947, it could have either 1) been published within ten years, in which case it was published before 1958 and now in the public domain or 2) have not been published, in which case it was taken before 1957 and is now in the public domain. See also Commons:Copyright tags#Japan. Moreover, I'm not seeing any discussion about adding anything new about publishing in the discussions that led up to this change. It is strange that the template does not include photos created before 1957, and not published within 10 years. I would like to point out that {{PD-China}} has a similar situation: copyright for photos expires 50 years after creation if unpublished, or 50 years after publication if published. We seem to apply PD-China to any photos created 50+ years ago, even those without any information about its publication. Theoretically, {{PD-China}} implies that photos can have a copyright up to almost 100 years, if they were published 49 years after creation. We seem to ignore this theoretical risk because it is in most cases improbable for photos to have copyright for that long. I wonder if we can apply that same logic to {{PD-Japan-oldphoto}}, and have the template include photos created before 1957 and not published within 10 years.

For example, let's say we have a photo created exactly on January 1, 1947. Theoretically, the photo could still be copyrighted if it was published exactly on January 1, 1957. Keep in mind that this photo would have almost a 10-year window in which publication would result in its copyright being expired (January 1, 1947 - December 31, 1956). Even publication after January 1, 1957 would result in its copyright being expired, so publication would have to be exactly on January 1, 1957 for it to have a longer copyright term. It's implausible that this theoretical risk can occur in reality. Thus we can most likely apply PD-Japan-oldphoto.

I want to upload a photo that was most likely created before 1957, and likely unpublished within 10 years, so I would like to hear more thoughts on this. FunnyMath (talk) 17:27, 22 May 2023 (UTC)[reply]

User:FunnyMath, as I understand it, the copyright term was 10 years from publication if published within 10 years from creation. If not published during this period, the copyright expired 10 years after creation. As an additional requirement, the copyright must have expired before 1968. This would give three rules:

Published before 1957: In the public domain.
Taken before 1957, not published within 10 years from creation: in the public domain. This rule is not mentioned in the template
Taken before 1947: in the public domain. This comes from looking at the worst case scenario: published nine years after creation.

If the photos were not published for several years, keep in mind that they also must be in the public domain in the United States to be hosted on Commons. Anything not published promptly is more likely to have a subsisting (pre-URAA) copyright due to reduced copyright formalities over time. In particular, anything not published before 1 March 1989 is not in the public domain in the United States unless it is very old, see {{PD-US-unpublished}}. See COM:SC for details. @Stefan2: Thank you for the explanation. So in order to upload a photo that satisfies the second condition (taken before 1957, unpublished within 10 years from creation), we would have to find a Japanese work which a) contains the photo, b) was published 11 years or more after the photo was taken, and c) was published before March 1, 1989 without complying with the copyright formalities.

So for example, if I find a 1970 Japanese magazine that has a photo taken in 1956, I can most likely upload the photo.

よって、以下の修正を提案します。

Published before 1958 instead of 1957[edit]

Shouldn't this tag be for photos published before 1958, instead of 1957 ? It looks like it was changed to 1958, but then changed back to 1957 since there had been no discussion on the change to 1958. However... it sounds like in the old law, photos had protection for 13 years from publication. That changed in the 1970 law, but the 1970 law did not become effective until January 1, 1971. Because of that, photos published during 1957 itself would have expired on January 1, 1971, i.e. they would have expired before the new law came into effect, and therefore would not have been extended by the new law. Thus, "before 1958" seems like the correct line to me, unless I'm missing something (and I'm only going off of the English translations, which could be missing a subtlety). So, that appears to be the reason that the template was changed to 1958 previously, and I'm not sure there was a good reason to change it back to 1957. It's natual you think that "before 1958" seems like the correct line to me." But the official views of the Japanese government and Japan Photographic Copyright Association is "before 1957." ref. http://www.mext.go.jp/b_menu/shingi/bunka/gijiroku/021/07051627/011/001.htm (in Japanese) So, Interpretation and Operation of the law in Japan has been "before 1957" for a long time. And it in "PD-Japan-oldphoto/ja" has been "before 1957" for a long time. Of course Japanese government's view is strange. We can chose "before 1957" which is different from the official views of the Japanese government. Hmmm. The Google Translate of that link is not the best, but it looks like the Japanese government was making deliberations on a new copyright law, and essentially froze copyright expirations with some temporary measures (the U.S. did some similar things leading up to their 1976 law). Japan extended photos by two years in 1967, creating the 1957 line currently in the tag, then (as they still were not done) they extended by another year in 1969, keeping the 1957 line. They drafted a new law in 1970, but it did not take effect until 1971. If there were no additional extensions -- and the link to the old law in the tag only mentions the two extensions which went from 10 to 13 years -- it would seem there was an extra year which should have expired, since works which were set to expire at the end of 1970 would have expired before the new law went into effect. There were 14 years difference between 1971 and 1957, and the extensions were only to 13. However, it's entirely possible there was a subtlety where the government intended to keep those works which had been frozen at the 1957 line still frozen so they were extended to the longer terms in 1971, and maybe the transitional wording preserved works which expired at the instant the new law came into effect, in a way which does not come across in translation. So if 1957 is the consensus line, I could see it, though by the English translations it would seem there was an extra year of expirations (noting again that only the Japanese text is the truly relevant one). For a Japanese speaker, what do the transitional sections at the end of the 1971 law say about existing works being protected? For a non-retroactive law, usually they only protect works still under protection when the new law takes effect, but perhaps there was a subtlety which extended works which were still protected under the old law (i.e. as of the last instant of the previous year) which would effectively extend that extra year in question. So, I'll defer to Japanese speakers on this one, and if 1957 is the generally understood line, I'm OK with it. It's good to get the documentation though, thanks for the link. 松重美人写真の著作権裁判との兼ね合い[edit]

w:ja:ファイル:MIYUKI Bridge 20140531.JPGをコモンズに移動できるかについてw:ja:利用者‐会話:Taisyo#ファイル:MIYUKI Bridge 20140531.JPGについてで議論があり、その結論によっては本テンプレートが成立しなくなる可能性があるので、議論の場をここに移すことで合意しました。

事実関係：

w:ja:ファイル:MIYUKI Bridge 20140531.JPGにはw:ja:松重美人（1913年 – 2005年）による写真が含まれている。
松重美人の写真は1945年8月6日に撮影され、1週間後に現像された。日本では1946年7月6日に新聞で、アメリカでは1952年9月29日に雑誌で出版された（w:ja:松重美人#写真の公表・出版を参照）。
1997年に写真の著作権に関する裁判があり、1997年6月の広島地裁判決文と1998年6月の広島高裁判決文のいずれにも請求内容に「原告/控訴人が（中略）各写真について、著作権を有することを確認する。」と記載されており、写真の著作権切れあるいは著作権の保護期間に関する記載がない。

判決本文にもある通り、写真の著作権（判決にも明記）とそれに伴うネガの所有権を争う裁判になっております。もし、著作権が消滅していれば、ネガの所有権の話で完結するのではと思います。そのことから、1997年判決時点で著作権が生きていると判断するのが安全と思ったからです。

私（ネイ）の見解：

ネガの所有権を判定するには結局だれが撮影したかを判断するしかなく、地裁判決文には「原告が本件各写真を撮影したことの証明はない（中略）その余の点について判断するまでもなく、原告の請求はいずれも理由がないから、これを棄却することとする」とあります。つまり、著作権が切れているかどうかを判定しなくても結論を出せるので、その判定を行わなかったというだけです。

Comment 判決文並びに会話ページの内容を閲覧しましたのでコメントさせて頂きます。まず結論から申し上げますと、松重美人事件で写真の著作権の保護期間について判示されていないのは、この事件の争点ではないものと判断されたように思います。判決文を読んでも原告（控訴人）や被告（被控訴人）からこれらに関する主張がなされたようには見受けられません。昭和59年最判の顔真卿真蹟複製事件の判事の通り、有体物としての所有権と無対物としての著作権は明確に区別されます。原告は確かに「著作権を有することを確認する。」と請求しておりますが、実際には有体物の所有権（民法）を争うものであり、無対物としてのパブリックドメインかどうかを争ってはいないように見えます（有体物と無対物の違いはこちらの論文がわかりやすいでしょうか。）。松重美人事件の判決文に記載がないのも、両者間で争いがなく、また、主張もなされなかったことによりただ触れていないだけであり、旧著作権法の保護期間を否定したようには見えません。旧著作権法下における写真の著作物がパブリックドメインであることは東京地裁判決「ローマの休日」他’５３年作品の保護期間事件でも触れられており、本テンプレートに瑕疵があるとは思われません。--Y.haruo (talk) 12:22, 29 January 2021 (UTC)[reply]

Comment 議論を起こしていただきありがとうございます。揉めてではないのでご安心を。私の様な解釈も出来るよな・・・もし、これを突っ込まれたら自己擁護出来ないなと言ったところです。ただ、終戦後に中国新聞で掲載されていますので、そちらを原版にして上げることもできる（マイクロフイルムはあるし、その様な著作権切れも上げている）。実際の解釈はどうなのだろうと個人的にも気になっている所です。昨日、新たに撮影してきましたので、問題なければ上げる準備もしております。安心できる解釈をと言ったところです。--Taisyo (talk) 08:12, 31 January 2021 (UTC)[reply]
