Non fair-use?[edit]

It was my decision to upload this image using the fair-use criteria. A less restrictive status may be applicable, but I am risk averse. In other words, I did not want to incite an argument. I did not hazard guesses about what might be "best"; rather, my only concern was to be uncontroversial. --Tenmei (talk) 15:17, 14 March 2011 (UTC)[reply]
I actually think there's nothing that forbids uploading it to commons as free because by Japanese law +50 years must pass since author's death, and by US laws (if we're going to take into account that this painting is kept in Boston Museum of Fine Arts) it's +70 years, so to my mind we're quite safe here because 70 years since his death elapsed in 1990.
