- They are not "Legally obliged to join", they have a formal opt-out under the Amsterdam Treaty. See W:Schengen Area#EU member states with opt outs. They have voluntarily incorporated much of the Schengen acquis, but still retain (together, as part of their own Common Travel Area) a controlled border with the Schengen Area. - No. See here: https://www.auswaertiges-amt.de/de/service/visa-und-aufenthalt/schengen/207786#content_6 Custom controls are no passenger controls. Schengen has nothing to do with custom controls.
