This "need" is simply the matter of an editor's personal preference. As far as the law is concerned, the subject was photographed in public with no expectation of privacy. The image is used editorially (non-commercially) and is part of a significant social commentary. These are uses long supported by the courts. Lastly, the image is both true and accurate. You may be right that there is no legal problem with this image. However, Commons does not appreciate photos of people who have not given their consent, as per Commons:Licensing#Checklist, since Commons is not a host for editorial non-commercial media. / Fred Chess 12:51, 5 November 2006 (UTC)[reply]
What do you mean? Almost 100% of commons is editorial non-commercial content (the parts that aren't fair use, anyway). And you have no idea whether or not consent was given. Rklawton 03:58, 7 November 2006 (UTC)[reply]
