Freies Werk wegen fehlender Schöpfungshöhe, noch abgesehen vom nicht verifizierbaren Herstellungs- und Veröffentlichungszeitpunkt, der in den Grundlagen mit Sicherheit zumindest Ende des 19. Jahrhunderts liegt. Die rein handwerkliche Leistung, die jedermann mit durchschnittlichen Fähigkeiten ebenso zustande brächte, mag sie auch auf anerkennenswertem Fleiß und auf solidem Können beruhen, liege außerhalb der Schutzfähigkeit, betont die deutsche Rechtsprechung (so das Landgericht Berlin in einer Entscheidung zu Btx-Grafiken).
