This seems not applicable here. Germany (nor France in that case) has no copyright on this patch. The nazi political party who created them no longer exists. And who could be proud to clame a copyright on that kind of thing!? So in my opinion, copyright violation is not applicable here (unless it's a copy for a copyrighted photography...)

for the star of david it should say "jude" which is jew in german.
