It is stated. See the template on the image page: it says "Tagged as {{PD-Iraq}} but I don't think it qualifies because it hinges on the "5 years for non-artistic works" clause.". Hello, and welcome to Wikimedia Commons!

I'd like to clarify some things that have been misunderstood by the communities visiting us recently:

  • This is Wikimedia Commons, not Wikipedia. While we feed images to Wikipedia (and Wikiquote, Wiktionary, and many other projects), we are not the same entities. There has been a bit of confusions on the matter.
  • Wikimedia Commons is a repository for free media. That is, the media hosted here needs to be either licensed under one of a number of free licenses (GFDL or CC-BY-SA for a couple of examples) or be public domain. We can't host the logo for Nike, for instance, or the latest episode of 24, as there is neither license for us to carry those images here, nor is there a Fair Use claim that we could apply. If the media is not free of encumbering restrictions, we don't host it at this site, period.
  • Other projects make their own decisions about what media to host locally. If a local project (Wikipedia, for instance) decides to host the image, Commons isn't concerned in the matter. That's beyond the scope of this project.
  • The deletion debate is not a vote. There is an ongoing deletion debate, however please note that it is a debate that is bound by our local policies and the law, which we attempt to comply with as much as possible. Simply posting "Yes, keep the image!" or "No, delete it!" will do nothing to clarify what the result should be.
  • This one is the most important: You CAN help! If you know something about the intricacies of copyright law and can help clarify the position of the shot and video, please feel free to explain so that we can make an informed decision. Try to keep it as simple as possible.
