This photograph was published for the first time under copyright in the year 2000. The copyright owners are James Allen and John Littlefield. The Wikipedia Commons administrator who posted this and other lynching photos has apparently violated their copyright. This exact photo (with added sepia tone) appears as numbers 54. and 55. in their book, Without Sanctuary: Lynching Photography in America. The caption used here on Wikipedia Commons to this photo is also taken directly from this book, published in 2000 under copyright.

This photo of the lynching of Lige Daniels is also the cover photograph in the book Without Sanctuary: Lynching Photography in America by James Allen, Hilton Als, United States Rep. John Lewis and historian Leon F. Litwack. (Twin Palm Publishers: 2000) ISBN 9780944092699 Publication of these photographs on this Wikipedia page violates the authors' copyright and could subject Wikipedia to legal action.

Unfortunately, the Wikipedia Commons administator who posted these photographs did not respect the authors' copyright, and did not mention the exact source of this copyrighted collection of photos. Wikipedia Commons is given as the source of these photographs in the Wikipedia lynching articles but that is false too. Without Sanctuary: Lynching Photography in America is clearly the source.

This image was republished in 2000, but the republisher does not hold the copyright. As a photograph, it was first "published" when it was developed back in 1920, and it was republished as a postcard in the 1920s. Photographs (at the time) were only copyrighted if they were registered with the U.S. Copyright Office, and this was not. (Even if it had been, the copyright would have expired). This particular scan was from the postcard, as was the copy included in Without Sanctuary. The authors of that book do not hold the copyright, since they merely republished a work that had long since been in the public domain. Quadell (talk) 23:30, 12 November 2007 (UTC)[reply]

A number of the photos on the lynching page gallery in wikipedia are from the collection to which these authors do assert copyright. So you have a difference of opinion with the book publisher and website publisher. This and related photos uploaded around the same time do not state origin, which is a wikipedia requirement. That they are all from the same collection should be stated, whether or not you assert that the authors have no rights under the law.Skywriter 03:34, 13 November 2007 (UTC)[reply]
