Fair use instead of federal government/FBI work[edit]

Although this photo was released by the FBI in 1994, it appears to be a state driver license photo (for a false identity document).

A Google News Archive search reveals that Bulger was not arrested in 1994. A search for other mugshots of Bulger find numerous others that are clearly mugshots, but not this one. Note also the missing identity board that would have the name of the arresting agency, and his name and identification number.

Although this photo was released by the FBI, the creator of the work is likely the state motor vehicle agency that created it.

I believe the use rationale, as a precaution, should be pre-emptively changed from federal government/FBI work to fair use (newsworthy, bad resolution, not yet replaceable).

You have presented no evidence that this photograph is from a driver's license, but the ultimate source of the photograph is, indeed, unknown. It may be work of Federal Government or not. Feel free to nominate it for deletion if you want to. --Karppinen (talk) 11:27, 24 June 2011 (UTC)[reply]
Karppinen - I'm on your side! I think the image should stay, I'm simply suggesting a change in the use rationale. Since we don't know the creator of the image (and it's quite possibly not federal government), we should take the safe route and label it as fair use that meets all 10 policy requirements at http://en.wikipedia.org/wiki/Wikipedia:Non-free_content_criteria.
