I believe Desmond's privacy rights in this case were waived long ago when he became famous; I believe Desmond's publicity rights are similarly irrelevant, as wikipedia is not using this image for commercial exploitation. I made a slight crop of the image to rid it of the black border; if such a crop constitutes "creative input" and qualifies the new image for copyright protection, then I explicitly disclaim any and all copyright on the image.
