Public Domain?[edit]

although a CC 2.0 attribution license is claimed by the BPL, this photo was published in 1919, and this photo does not represent a significant new creative work derived from the photo. therefore, from what i understand of U.S. copyright law, this photo is now free and clear of any copyright restrictions whatsoever. (see, e.g., http://fairuse.stanford.edu/Copyright_and_Fair_Use_Overview/chapter8/8-a.html) unless i misunderstand something, there is no additional right granted simply for converting an otherwise public domain image into a digital format, and therefore no licensing restrictions may be imposed by BPL or any other party. i am no expert on copyright (or any other IP) law but unless some evidence can be shown that this image is not in the public domain, i request that the claimed licensing restriction be removed, and that this image be marked as in the public domain, free for any use. thanks.
