Hi I'm looking for help on this image. I posted this request on the Commons' Helpdesk too.

I was advised on wikipedia that this image would be in the public domain because the American subject died in 1910 so it can be assumed the photo was published before 1923 in the US. However I see that here you're a bit stricter about when and where the image was published. So two questions:

• Is it OK to have the image without knowing exactly when and where it was first published?
• And if so, which of the public domain "licenses" do I choose? None of them seem to be for a pre-1923 image.
